This is a reverification of the Nationwide General Permit verification issued on January 24, 2025, which is hereby superseded by this letter. The proposed work includes seawall replacement. The site is located in the Town Creek waterway, in the Town of Southold, Suffolk County, New York. The specific applicant-provided details are as shown on the attached permit drawings titled "Proposed Bulkhead Replacement for Andrea Simitch & Val Warke Rev. Trusts on Town Creek, Southold, Suffolk County, NY", prepared by En-Consultants, dated September 18, 2024, and last revised April 7, 2025. These drawings indicate that the total impacts to waters of the United States involve the removal of an existing, partially collapsed concrete seawall and subsequent installation of 1-2 ton armor stone along 100 linear feet at the northern portion of the shoreline and vinyl bulkhead along 55 linear feet at the southern portion of shoreline with a 3-ft by 4-ft removable ladder, in- place of the historic concrete seawall. Work will occur during periods of low water. Based on the information submitted to this office, our review of the project indicates that an individual permit is not required. It appears that the activities within the jurisdiction of this office could be accomplished under Department of the Army Nationwide General Permit Number 13 — Bank Stabilization. The nationwide permits are prescribed as a Reissuance and Modification of Nationwide Permits in the Federal Register dated December 27, 2021 (86 FR 73522). The work may be performed without further authorization from this office provided the activity complies with the permit conditions listed in Section B, No. 13, Section C, any applicable. No claim shall be made against the United States on account of any such removal or alteration. This determination covers only the work described in the submitted material. Any major changes in the project may require additional authorizations from the New York District. Care should.be taken so that construction materials, including debris, do not enter any waterway to become drift or pollution hazards. You are to contact the appropriate state and local government officials to ensure that the subject work is performed in compliance with their requirements. This verification is valid until March 14, 2026, unless the nationwide permit is modified, reissued, or revoked. Southold Town 2500 Hobart Road,Town Creek Board of Trustees Town of Southold, Suffolk County General Concurrence—Modification of a Previously Reviewed Activity Dear Robert Herrmann: The Department of State(DOS)received your proposed modification of the above-referenced activity on June 12,2025.The DOS previously reviewed the original proposal and concurred with a consistency certification for it, or otherwise indicated it had no objection to authorization of the proposed activity. The proposed modification involves: Removal and replacement of the existing concrete seawall with vinyl bulkhead, armor stone, and native plantings. Proposed 55 foot vinyl bulkhead and 10 foot return to be constructed in place and 6 inches higher in elevation than the existing concrete seawall. In addition, approximately 100 linear feet of 1-2 ton armor stone will be constructed in place/landward of existing concrete seawall. Approximately 560 square foot area between armor stone and top of bank to be backfilled with clean sand/loam and planted with native vegetation. Proposed 3 foot by 4 foot removeable aluminum stairs will be placed seaward of the proposed vinyl bulkhead. The original plan was: Removal and replacement of the 156 linear foot existing concrete seawall with approximately 55 linear feet of vinyl bulkhead in place and 6 inches higher in elevation. Replacement of the remaining portion of existing seawall with approximately 101 linear feet of vinyl bulkhead in place or landward. The Department of State has determined the proposed modification, would not result in coastal zone effects that would be substantially different than those originally reviewed and that the modified proposal meets the general consistency concurrence criteria. Therefore, further review by the Department of State and its concurrence with an individual consistency certification for the proposed activity are not required. YE K Department O STATE of State This determination is without prejudice to and does not obviate the need to obtain all other applicable licenses, permits, and other forms of authorization or approvals which may be required pursuant to existing New York State statutes. Area of wetlands on lot: -0- square feet Percent coverage of lot: -0- °% Closest distance between nearest existing structure and upland edge of wetlands: 0 feet (ex.concrete seawall) Closest distance between nearest proposed structure and upland edge of wetlands: 0 feet (new vinyl bulkhead) Does the project involve excavation or filling? No X Yes (as required to remove existing seawall and install If yes, how much material will be excavated? TBD cubic yardsnew vinyl bulkhead) How much material will be filled? +/-70 cubic yards (clean sand/loam backfill) Depth of which material will be re -owed-or-deposited: +/-4 feet Proposed slope throughout the area of operations: N/A Manner in which material will be removed or deposited: Approximately 70 cy of clean sand/loam will be trucked in from an approved upland source to be used as backfill and to restore approximately 950 sf eroded embankment area to be planted with native vegetation. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The project proposes to replace an existing concrete seawall, located between two adjacent bulkheads, with a new vinyl bulkhead to maintain the historical means of protecting the embankment, upland property and structures against erosion and flooding. The site has been supported and protected from flooding and erosion by the existing concrete seawall since prior to 1951,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. In 2020,the prior owners reported to the Trustees significant storm damage the seawall suffered during the 2020 Christmas Eve storm, but personal circumstances prevented their carrying out the permitting and construction work necessary to replace the wall at that time.As a result, the new owners inherited the partially functional/partially collapsed seawall and a significantly eroded embankment. Therefore,to restore the bulkhead and embankment, they propose to construct a new bulkhead in place of the functional section of seawall, and in place or landward of the collapsed sections of seawall to ensure the new bulkhead is located landward of mean high water.Without replacement and maintenance of the bulkhead, the subject and adjacent properties would be exposed to further severe erosion and potential flooding, and damage to the residential structures located thereon. The project will provide the ecological benefits associated with removing the collapsed seawall from the intertidal zone;replacing a substantial concrete structure with an untreated vinyl sheathed bulkhead;and restoring and revegetating the eroded embankment. And all work will occur only from the landward side of the seawall to prevent damage to the existing wetland vegetation seaward of the collapsed seawall. The project will thus effectively maintain or improve the historically existing site conditions without any change in or significant adverse impact on the adjacent tidal marsh or waters of Town Creek. t 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification.
