Moore, Esq. 51020 Main Road Southold, NY 11971 RE: CARMEN BROOKS 1232 THE GLOAMING, FISHERS ISLAND SCTM# 1000-10-9-16 Dear Ms. Moore: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, December 18, 2024 regarding the above matter: WHEREAS, Patricia C. Moore, Esq. on behalf of CARMEN BROOKS applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 2, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 4 and 6 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the property is in a commercial area and keeping with the adjacent properties; the property is elevated substantially above the water, which satisfies concerns about the flood zone; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 18, 2024, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of CARMEN BROOKS for the existing 30.5'x32.2' dwelling, remove existing partial second floor and construct a full second-story addition; new 5'x9' front covered stoop and a 6.2'x30.1' seaward covered porch; with the condition to establish and perpetually maintain a 15' non-turf buffer; and as depicted on the site plan prepared by North Shore Surveyors LLC, received on January 3, 2025, and stamped approved on January 3, 2025. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) That the said-Board of Trustees and the.Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the saidPermittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee'is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel.'Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued'its reply dated April 24,2024 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred'for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 29, 2024. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, the proposed reconstruction is to replace in kind structures that are legally existing without proposed expansion.Therefore,the Board finds the action CONSISENT with the LWRP PROPERTY FACTS/DESCRIPTION: The subject property is a 9,121.36 sq.ft.non-conforming parcel located in a Business(B)Zoning District. The property is irregularly shaped and located on a private driveway with access to The Gloaming. Waterfront footage along Great Harbor measure 56.80±(tie line along high water), the property runs a total of 208.30 feet along the westerly property line, measures 66,11 feet along the southerly property line, and measures a total of 187.84 feet along the easterly property line.,The property is improved with an existing two story frame dwelling with an accessory garage as shown on a survey prepared by Louis H.Visconti,LLS,last revised April 2,2024. The buildings currently have a pre-co#27303 dated September 8,2000,and a building permit#49855, issued on October 6,2023 for alterations to the dwelling. BASIS OF APPLICATION: Request for Variances from Article XI, Section 280-49 and the Building Inspector's April 4, 2024, Notice of Disapproval based on an application for a permit to construct rear deck and front porch additions to a single family dwelling;at; 1)less than the code required minimum side yard setback of 25 feet;2)less than the code required minimum combined side yard setback of 50 feet; located at: 1232 The Gloaming, Inner Bay Shore Road,(Adj.to Great Harbor)Fishers Island,NY. Side yard setback of 2.2 feet where a minimum of 25 feet is required. 2. Combined side yard setback of 10.4 feet where a minimum of 50 feet is required. ADDITIONAL INFORMATION: The dwelling is currently undergoing renovations, and it was found that the existing front porch and rear deck were not adequately structurally supported. The proposed construction is to re- build in place with upgraded supports for the front porch and rear deck. There are two letters of support for this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1,2024 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing house with the subject porch and deck currently has a valid certificate of occupancy, and the proposed upgrades are to replace in kind the existing deck and porch. Therefore,there will be no undesirable change in the character of the neighborhood 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. Due to the irregular shape of the subject property, and the current non-conforming locations,any work to this structure would require variance relief. 1 3. Town Law 5267-b(3)(b)(3). The variances granted herein are mathematically substantial: 1. The side yard setback represents a 92%relief from the code. 2. The combined side yard setback represents 80%relief from the code. However, due to the fact that these legally existing structures are being reconstructed in place and in-kind, there is no adverse impact or change in what already exists on the'property. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a reconstructed rear deck and front porch while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
