MINUTES
SOUTHOLD TOWN BOARD OF APPEALS
DecDmber 14~ 1961
A regular meeting of the $outhold Town Board of Appeals
was held 7:30 P.M.~ Thursday, December 14, 1961 at the Town
Clerk Office, Main Road, Southold, New York.
There were present: Messrs. Robert W. Gillispie, Jr.~
Chairman, Robert Bergen, Herbert Rosenber9, and Charles Grigonis, Jr.
Absent: Serge Doyen, Jr.
PUBLIC HEARING: Appeal No. 423 - upon application of
Christian F. Lampe, Peconic Bay Boulevard, Laurel, NeW York,
for a variance in accordance with the Zoning ordinance, Article
III, Sections 303e and 306, for permission to reduce frontage
and setback on a corner lot. Locatinn of property: south side
Peconic Bay Boulevard, Laurel, New York, bounded north by Peconic
Bay Boulevard, east by H. M. Brush~ south by other land of C. F.
Lampe and west by L. plecha~icius. Fee paid $15.00.
This hearing was opened November 30, 1961 but recessed to
this date as no one appeared to speak for the application and
answer questions of the Board.

Tbs Chairman reread the legal notice of the hearing and
the application for a variance. The Chairman also read the letter
to the Board from Mr. Lampe dated December 6, 1961.
THE'CHAIRMAN: I believe Mr. LampeSs intention was to retain
the right-of-way with the lot in the rear on the Bay. However,
that is not permitted since he would be leaving an 85 ft. lot and
a 15 ft. lot.
MR. ARNOLD REILLY: The adjoining lot to the hast has three
homes on it and it is the same area. All the homes through there
are on lots similar to this with two or more houses in an area like
this one.
MR. ROSENBERG: The only problem we can see is that Mr. Lampe
is not allowed to keep this right-of-way separate from the front
lot. He does not need a variance to divide the property, but he
cannot keep the right-of-way separate. The way this should be
done is to keep the 100 ft. front lot on the Boulevard with a right-
of-way reserved for the rear lot on the Bay.
(The Board discussed with Mr. Reitly the location of the house
and the garage on the lot. Mr. Reilly felt the garage would
probably be attached to the house and the house would be approximately
100 to 150 ft. from Peconic Bay Boulevard.)
~THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(There was no response°)
After investigation and inspection the Board finds that this
lot is part of land fronting 100 ft. on Peconic Bay Boulevard and
extending 610 fro more or less to Great. Peconic Bay.
The survey was completed June 26, 1951 and three lots were laid
out. The applicant proposes to lay out two lots each approximately
304000 sq. fto with 100 fto frontage. The frontage of the southerly
(Bay) lot is on an existing right-of-way~
The applicant applied for a variance to permit him to reduce
the Boulevard frontage to 85 ft. and consider the 15 ft. paved right-
of-way as part of the southerly lot.
Due to a misunderstanding on the part of the owner and the
builder this ~ not a requirement in the Ordinance. These lots

were in existence before the effective date of the Ordinance.
On motion of Mr. Gillispie~ seconded by Mr. Gr~gonis, it was
RESOLVED that application of Christian F. Lampe be denied
for decrease of frontage and side yard. No practical difficUlty
or unnecessary hardship has been found. Application for a variance
was made because of a misreading of the Ordinance.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr.
Rosenberg~ and Mr. Grigonis.
The minutes of the meeting of November 30¢ 1961 on motion of
Mro Gillispie, seconded by Mro Rosenberg, were approved as submitted.
Vote of the Board: Ayes:- Mr. Gitlispie¢ Mro Bergen¢ Mr.
Rosenberg, and Mro Grigonis.
The next meeting of the Southold Town Board of Appeals will
be held 7:30 PoM.~ Thursday, January 4, 1962¢ at the Town Clerk
Office, Main Road, Southold, New York.
On motion of Mr. Bergen, seconded by Mr° Rosenberg, it was
RESOLVED that the Board of Appeals set 7:30 PoM. (E. SoT.)~

east by Po Cassano, south by Manhanset Avenue and west by Anglers Rdo
