(631) 765-1809 aw- xvxa�� Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 21, 2024 ZBA FILE: #7956 NAME OF APPLICANT: Stephen Haratunian and Arda Haratunian PROPERTY LOCATION: 1205 Sound Avenue Extension, (Adj. to Long Island Sound), Southold,NY SCTM#1000-50-2-13 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru 14-25, and the Suffolk County Department of Planning issued its reply dated August 16, 2024 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 24, 2024. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and is therefore CONSISTENT with the LWRP. A 15 ft. wide no-turf buffer was required on the property pursuant to the Board of Southold Town Trustees#8745 and#8745C permits. PROPERTY FACTS/DESCRIPTION: The subject conforming 70,459 square foot parcel(buildable area of 29,791 square foot) located in the Residential R-80 Zoning District. The northerly property line measures in total is 241.03 and adjacent to Long Island Sound, the easterly property line measures southeasterly 163.55 feet, the easterly at 219.50 feet,then southwesterly at 116.06 feet. The property at this point then measures northwesterly at 100.00 feet and is adjacent to Sound View Avenue,then moves northeasterly measuring 75 feet and then measures northwesterly 439.36 feet. The parcel is improved with a two-story frame dwelling and a16.4 feet by 22.3 feet garage located southeast of the dwelling. There is 16 feet by 36 feet in-ground swimming pool located southwest of the dwelling along with 23.5 feet by 15.2 feet one story pool house located south of the pool as shown on the survey map prepared by Nathan Taft Corwin III, LS, and last revised March 22,2024. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXII, Section 280- 116A(1); and the Building Inspector's May 22, 2024 Notice of Disapproval base on an application for a permit to construct a trellis accessory to a single-family dwelling; at; 1) located less than the code required 100 feet from the Page 2,November 21,2024 #7956, Haratunian SCTM No. 1000-50-2-13 top of the bluff; 2) less than the code required minimum side yard setback of 20 feet; located at: 1205 Soundview Avenue Extension, (Adj. to Long Island Sound), Southold,NY. SCTM#1000-50-2-13. RELIEF REQUESTED: The applicant requests variances to construct a trellis accessory to an existing single-family dwelling The proposed construction,on this 70,459 square foot parcel(buildable area of 29,791 square foot) located in the Residential R-80 Zoning District,is not permitted pursuant to Article XXII, Section 280-116A(1), which states "All building or structures located on lot upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." The survey shows the construction at 84 feet 5 inches from the top of bluff. Additionally,the proposed accessory structure, is not permitted pursuant to Article III, Section 280- 15 which states,accessory structures on lots measuring between 60,000 and 79,999 square feet in total size require a minimum side yard setback of 20 feet. The existing construction has a side yard setback of 12 feet 10 inches. ADDITIONAL INFORMATION:No letters in opposition were receive from neighbors. The bluff is well vegetated. Site Plan drawings of the proposed trellis were prepared by Ural. Talgat.Architect, and dated July 9,2024. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7,2024, at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is a waterfront community. The subject property is very well screened on all property lines by very mature large vegetation and the proposed trellis will not be seen by neighbors or from the street. The existing dwelling is located closer to the bluff at 45.5 feet where the trellis is proposed with an 84.5 feet bluff setback. The neighborhood contains other properties with swimming pools and similar structures,which are popular to keep the sun away and provide shade. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed location is the only area available for the proposed trellis near the existing pool because the pool house is located at the other end of the pool with a conforming bluff setback.The location is as far away from the bluff as it can be in order to provide a shaded area near the as built pool 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 35.8% relief from the code for the side yard setback, and 15.6% relief from the code for the setback from the top of the bluff. However, the location of the proposed trellis is the only location that is viable, and the existing dwelling is closer to the bluff at 45.5 feet. 4. Town Law V67-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has/been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a trellis while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried,to GRANT the variances as applied for,and shown on the Site Plan(last revised July 16,2024)and Architectural Plan (dated July 9, 2024)prepared by Ural Talgat,Architect. SUBJECT TO THE FOLLOWING CONDITIONS: 1. A 15 feet wide non-turf buffer required by Board of Southold Town Trustees shall be installed and maintained. 2. The proposed trellis shall remain with open walls and non-habitable. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 22, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268,Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Jan. 14, 2016. ADDITIONAL INFORMATION: A letter from Suffolk County Soil and Water technician Ann Marie Calabro was received by the Board on February 23,2016.The bluff on the subject property was found to be in"fairly stable condition with dense overgrown vegetative cover." To prevent bluff destabilization, it was recommended that heavy machinery,equipment,and supplies be stored and/or used at a minimum of 25 feet from the bluff top edge. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4,2016,at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(hXn1 - Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This community is characterized by,dwellings which are located substantially closer to the bluff than 100 feet.Furthermore,the proposed construction effectively results in the in-place replacement of the existing two-story dwelling and attached decks with a landward expansion only on the landward side of the house toward the road and not toward either adjoining properties. 2. Town Law $267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The existing dwelling exists at a non-conforming top of bluff setback and cannot be relocated landward sufficiently enough to warrant complete demolition, removal and relocation of the dwelling_and foundation due to the size and configuration of the property, the orientation of the bluff,and the existing location of the in-ground swimming pool and pool patio located immediately south/landward of the existing.dwelling.Therefore a proposed reconstruction in-place will require a top of bluff setback variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 66%relief from the code. However, the proposed reconstruction will have the same non-conforming top of bluff setback to what presently exists.In addition,the applicant proposes to covenant in perpetuity an existing 15 foot wide,3,090 square-foot non-turf buffer adjacent to the bluff crest,which will help mitigate potential erosion to the bluff 4.
