The issuance of an Administrative Permit allows for the operations as indicated on the site plan prepared by WFC Architects, received on October 16, 2024, and stamped approved on November 13, 2024. Special Conditions: None. Inspections: Final Inspection. If the proposed activities do not meet the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Permit will be required. Proposed Modification to the Communication Facility As reflected on the construction drawings prepared, signed and sealed by WFC Architects, last revised January 31, 2024 (the "Drawings"), Verizon Wireless is proposing the following modifications to the Communication Facility: • Within the existing concealment pole (the "Pole"): Remove and replace three (3) existing antennas with three(3)new antennas,and remove six(6)existing diplexers and replace with three (3) new quadplexers; and • Within Verizon Wireless' existing equipment compound (the "Compound"): One (1) existing cabinet to be removed and replaced with two (2) new cabinets; remove and replace one (1) existing battery cabinet; twelve (12) RRH's to be removed and replaced with nine (9) new RRH's; and three (3) new quad diplexers and three (3) new quad triplexers to be installed. The proposed modifications will be contained within the Pole and Compound. No ground disturbance is proposed. Eligible Facilities Request The Spectrum Act states that "a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." (See, 47 U.S.C. § 1455(a)(1)). An "eligible facilities request" is defined to include any collocation, 2 r bG removal,or replacement of equipment, such as that proposed herein. (See,47 U.S.C. § 1455(a)(2)). The FCC adopted rules providing legally binding guidance on key terms of the Spectrum Act, notably defining "substantial change" with certain thresholds. (See, Report and Order FCC 14-153, 29 FCC Rcd. 12865 (FCC October 17, 2014); see also, Report and Order FCC 20-153, 2020 WL 6501650 (FCC October 27, 2020)). As depicted in the Drawings, the proposed modification does not exceed the thresholds established by the FCC: (a) the antennas will be concealed within the Pole and the height of the Pole will remain the same; (b) there will be no protrusions from the edge of the Pole; (c)the Compound will contain less than four(4) equipment cabinets for the technology involved; (d) the proposed modifications to the Communication Facility would not require any excavation or deployment beyond the site; (e) it would not affect the concealment elements of the existing Communication Facility, as all components will remain within the Pole and Compound,which is screened; and(f)there are no prior conditions of approval that would render the proposed modification work to be non-compliant. In sum,the modification qualifies as an"eligible facilities request"under the Spectrum Act and FCC rules, because it does not exceed any of the thresholds, such that it would "substantially change"the physical dimensions of the existing tower. As stated above, the FCC requires that qualifying eligible facilities requests be approved within 60 days, subject to tolling for incompleteness. (See, 47 C.F.R. § 1.6100(c)(2), (3)). Since the proposed modification of the Communication Facility involves removal and replacement of equipment that will not substantially change the physical dimensions of the wireless tower, the Town may only require documents that are relevant to determining that same qualifies as an eligible facilities request.
