Denis, PC AIA,filed pursuant to 19 NYCRR 1205 on November 26, 2003, and upon taking testimony and hearing argument thereon at a duly noticed hearing before the Southern Region Board of Review held at the Brookhaven Town Hall, Medford, New York, on December 4, 2003, and upon all other papers in this matter, the Board makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to alterations to a Group Al (one-family dwelling)occupancy,three stories in height, Type 5b (wood frame- unprotected)construction, located at 12040 Main street, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 705.2(c),which allows buildings to have a maximum height of three stories above a basement or cellar, or above finished grade where there is no basement or cellar, only when of Type 5A(wood frame- protected)construction and equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D -Installation of Sprinkler Systems in One-and Two-Family Dwellings and Mobile Homes (Reference Standard RS 57-7). [The petitioner requests a three story building of Type 5b (wood frame- unprotected)construction with a limited area NFPA 13D sprinkler system.] 9 NYCRR 713.1(d),which requires that the widths of stairs shall be not less than 2 feet 8 inches clear between handrails or between handrails and opposite wall surface. [The petitioner requests a stair to the third story with a clear width between the handrail and the opposite wall surface of 2 feet 5 inches.] FINDINGS OF FACT 1. The petition pertains to alterations to a Group Al (one-family dwelling)occupancy, three stories in height, Type 5b (wood frame- unprotected)construction. Restoration of the subject building and ensuing alterations fall under the provisions of 9 NYCRR 1231.3(c), which requires that when the alteration cost, including additions and repairs, exceeds 50 percent of the replacement cost of a building, the entire existing building shall conform with Part 1232,which requires that any new work such as alterations and additions shall comply with Subchapter B. 3. Subdivision 705.2(c)of Subchapter B of the Uniform Code permits a building of Group Al occupancy of Type 5A(wood frame-protected)construction to have a maximum height of three stories above a basement or cellar, or above finished grade where there is no basement or cellar, when equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D. 4. As part of the alterations, a third story was created containing one finished room designated as a study, approximately 10 feet by 14 feet, and a closet. 5. A dormer was constructed on the main roof to accommodate the third story room on the exterior. So, there is a full height wall on the exterior. 6. The Town of Southold only permits two and a half story one-family dwellings, not three story dwellings, and an application was made to the Town of Southold Zoning Board of Appeals to allow the third story. The Zoning Board of Appeals approved the variance with the condition that the room in question not be used now, or at any time in the future, for sleeping purposes. The owners thought that the zoning variance was all they required and were unaware of the State Code requirements per their testimony. 7. The petitioners have stated in their testimony that a limited area sprinkler system has been installed in the area of the third floor study. Because the first and second stories are finished, the petitioner argues that it is economically and physically impractical to install a sprinkler system throughout the entire house. 8. Subdivision 713.1(d) requires that the widths of stairs shall be not less than 2 feet 8 inches clear between handrails or between handrails and opposite wall surface. The stairs leading to the third story space are 2 feet 5 inches clear between the handrail and the opposite wall surface. 9. The petitioner has stated that interconnected smoke-detecting alarm devices, monitored by an approved central station, have been installed throughout the residence. Before the Uniform Code was amended in May 1999, the regional offices of the Department of State Division of Code Enforcement and Administration granted numerous routine variances for three-story, Group Al occupancies of Type 5b construction. The conditions imposed upon those variances included interconnected smoke-detecting alarm devices throughout the building, a limited area automatic sprinkler system installed in the third story and the stair or stairs leading from the second story to the third story, and the installation of a noncombustible ladder in any room containing habitable space or recreation room located on the third story. Petition No.2003-0433 Page 3 CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would create an excessive and unreasonable economic burden and would be unnecessary in light of alternatives which ensure the achievement of the Code's intended objective. DETERMINATION WHEREFORE IT IS DETERMINED that the application for variances from 9 NYCRR 705.2(c)and 713.1(d), be and are hereby GRANTED with the following conditions: 1. That the third story study not be used now, or at any time in the future, for sleeping purposes. 2. That all smoke alarms throughout the dwelling be interconnected and monitored by an approved central station. 3. That a limited area automatic sprinkler system be installed in accordance with NFPA 13D on the third story and in the stairway leading from the second story to the third story. Furthermore, it should be noted that the decision of this Board is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The proposed porch addition would extend approximately eight (8) feet seaward from a small cottage located on a well-vegetated bluff, which is landward of the bulkhead. The porch would not be visible to nearby residences, nor was any evidence presented to suggest that it would adversely impact nearby properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the applicant wishes to enjoy the waterfront vista of this property and no otheraltemative location provides a reasonable opportunity for this benefit. 3. The requested area variance is not substantial and represents a 19-foot reduction in the code required 75 ft. minimum setback to the wooden bulkhead, and an eight-foot increase in the preexisting 63-ft. setback. 4.
