WITNESSETH
W-HERW~.tS~ said partnership is ~he o~r~er in fSe of a cer-
tain tract of land situated at East'Marion in the To~n of Sc~dthold,
Cot~mty of Suffolk~ and State of New York~ ~kmo~ and designated on
a certain map entitled "Map of Marion Manor, situate at East
Marion~ Town of Southoid, Suffolk Co., N. Y.~ surveyed November
25, 1952 by Otto W. Van Tuyl & Son, licensed surveyors, Greenport~
N. Y., o~med .and developed by Peter Blank & Son, East Williston~
L. I., N. Y.' and filed in the OFfice of the Clerk of the County
of Suffolk on March 18~ 1953, s~d under Map Number 2038.
WHEREAS, said'partnership is about to ~uprove, develop~
selt~ grant ~d convey plots on the above mantioned map,
NOM, THEREFORE~ for the purpose of restricting the use
for which same premises or a~y p~rcel thereof may herein be used
by ~ny subsequent o~mer thereof or any p~rcel thereof~ 'the said-
PETER BL~fL & SON does hereby declare that said premises ~hall be
subject to restrictions as follows:
A. USE: Each nmmbered lot on the aforesaid map Of
"Marion Manor" ~haii be used for private residence p. urposes .o~ly,-
and with the exception of lots ! through 5, .both inclusive, and
with the exception of lots 36 and 43 and lots 35 and 44, no build-
ing shall be erected or maintained thereon except a private dwell-
ing house designed for occupancy of a single family~ together with
such out buildings as are ap~ropriate ~nd usual for a private
residence.
As to lots i through 5, both inclusive, no building
shall be erected or maintaihed thereon except not more than two
dwelling houses~ each~dasigned for occupancy of a single family,
the most southerly of said dwelling houses to face the waterfront~
and the most northerly of said dwelling houses to face on Cleaves
Point Road, together with such out buildings as are apl.ropriate
and usual for a private residence.
As to lots 36 and 43~ 'said lots when taken together
shall be c,.nsider'ed as one lot and shall be sold and resold as
such and no building shall be erected or maintained thereon except
a private dwelling house designed ~ ~

together with such out buildings as are appr~,pri&te a~d usual for
a private residence.
As to lots 35 and 44~ said lots when takez~ together
shall be considered as one lot and s~hall be sold and resold as
such and no building-shall be 'erebted or maintained thereon except
a private dwelling.house designed for occupancy of a single family

together with such out buildings as are appropriate and usual
for a ~rlva~e residence.
As to the lot m~.rked "Reserved" and which abuts on
Main Road, said lot will be used for private~es~de~ce~ ~ ~ o~ly or
combined bus_.ness and res~de~ce for a a~ingle family only.
As to all lots marked ~Reserved. except for ~he lot
mar~ed "Reserved" which abuts on Main Road~ no buildings or im-
provements of any kind whatever shall be erected or maintained
thereon. ~
B. APPROVAL OF PL~S: No building of any kind shall
be erected, placed or altered ~n any numbered plot on this map
until the building plans, specifications and plot plans showing
the location 'of such building have Been approved in writing as to
conformity and harmony of external design with existing st~c-
tures in the subdivision and as to the location of the building
with respect to topogra?hy and finished ground level by Peter
Bl~nk & Son, its successors~ authorized sg~ents or assigns. In
the event said Peter Blank & Son, .it~ successors, authorized
agents or assigns~ fails to approve or disapprove such plans~
specifications and plot plans ]ith%n thirty days~after same have
been'submitted to it, such approvai~ will not b~ required and this
coven~at will be deemed to have been fully complied with.
C. DWELLINGS: No dwellir~g shall be erected or main-
tained on any numbered plot' on the aforesaid map, except a
dwelling having a ~round floor area of not less than 1,000 scuare
feet in the case of a one'story structure, and not less'than
1,500 square feet of livable combined ~!oor area in the case of
a one and one-half or two story dwelling. The height of any
dwelling shall not exceed twenty-six (26) feet from the ground
level.

be used as a residence temporarily or permanently, nor shall any
residence of a temporary character be permitted.
D. FREE SPACES: No Structure shall be erected on any
numbered plot nearer to any road th~n twenty-five (25) feet, ex-
cept for lots 32 to 47 both inclusive, on which no structure
shall be erected nearer to any road than twenty (20) feet, except
that on any numbered plot steps, uncovered porches and terraces~
no parts of which are more than two (2) feet above ground level,
chi~eys, leaders, gutters, and eaves may encroach not more than
three (3~ feet on such restricted area.
No dwelling or dwelling with ~ attached garage shall

side line and within a combined distance of twenty (20) feet from
both side lines.

No structure shall be erec'ted or maintained on any
plot within five (5) feat of any rear or side line.
E. F~CES: 14o fence of any kind shall be erected or
maintained on any portion of the said premises along the front
property line or from the front building line to the front lot
line. Ne fence of any kind shall be erected and maintained ex-

F, PETS: No pets of any kind whatever shall be kept or
harbored in any premises except not more than one dog and one cat.

The locat~on~ specification~ construction and maintainance of. the
domestic waterwell ~d sewerage disposal facilities shall be ~
accord~ce with the requirements of the Suffo~ Coumty Depar~ent

mentioned f:iled "Map of Marion Manor".
H. DUP~TiON: These covenants and restrictions are to'

ten years shall be filed for record, signed, executed and ackuow-
lodged by the then ovmers not including mortgagees, of not less
than two-thirds of ~the numbered 10t owners in said subdivision.
I. ~ODIFICATiONS: The company, its successors and
assigns~ whether or not o;~ming any part of the aforesaid lam. d,
shall have the right to alter~ modify or ann.~.l~ any of the cove-
nants, restrictions and~.conditions of this d~claration and shall
· also have the right to assign such right (with or wmt._out' b convey-
ance of title to any part of the aforesaid land) by an instrument
in recordable form. Should the company at any time assigns'Such
right, the assignee thereof shall succeed to all of the rights

This declaration shall be binding upon, and inure to
