We are in receipt of your correspondence, received July 15,2024, requesting a de minimus approval
related to ZBA determination#5138, dated July 25,2002, in which variance relief was granted to
construct an in-ground swimming pool,upon the above re ferenced premises.
In your letter,you described your meeting with the Southold Town Board of Trustees and your
discussion with them about relocating the swimming pool more than 100 feet landward of the wetlands,
which would place the pool outside of Board of Trustee's jurisdiction. In this proposed location, the
pool will continue to be located in the side yard of the property.
I have reviewed your request, the hand drawn edits to a survey that you provided, and have determined
that the relocation of the swimming pool as depicted, is de minimus in nature.
Please provide this Board with two (2)original updated signed and sealed surveys of the proposed
change, and contact our office if you have any further questions.

Ladies and Gentlemen,
We are writing to you in connection with a�d �emini i`s_updaW to a variance that was granted on
a property that we are purchasing at1861 New Suffolk Avenue, Cutchogue. The variance that
was granted in 2002 is attached to this letter and was a variance for a 20 x 40 pool to be located
in the side yard of the residence at a distance of 85 feet from the wetlands that are behind the
house. At the time the variance was granted, the Trustees also granted a permit to install the
pool; however, that permit expired after two years, while the variance granted by the Zoning
Board remains in effect.
The de minimis changes that we would like to make are as follows: we would first like to situate
the pool further away from the wetlands by placing the pool at approximately the midpoint of the
center of the side of the house, more than 100 feet from the wetlands, which would situate the
pool completely in our side yard (see attached proposed mock-up). We also would like to install
a small, five-by-five foot hot tub in the pool, thus increasing its length by five feet(20 x 45
instead of 20 x 40).
We met with the Trustees on July 9th and discussed our thoughts with them about relocating the
pool landward of the wetlands, which was met with a favorable response, as they encouraged
us to place the pool outside their jurisdiction.
We are excited to become members of the Southold community and look forward to many years
in our new home. Please let us know if you require additional information for us to make these
small changes to the approved permit, and thank you in advance for your consideration.

SE RA DE A I N: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of the
State's List of Actions, without an adverse effect on the environment if the project is implemented as
planned as a setback or lot line request.
ROPERTY FACT / PTI Nl: The applicant's property is located on the easterly side of a
private right-of-way which extends north from New Suffolk Avenue in Cutchogue. This lot is shown
as Lot 3 on the Minor Subdivision Map of Winds Way with a total lot area of 2.46 acres (upland and
marsh areas). The lot is improved with a 1-1/2 story frame house with deck as shown on the survey
prepared by Roderick VanTuyl, P.C. dated October 4, 1994,last amended June 7,1995.
BASIS OF APPLICATION: Building Department's April 1, 2002 Notice of Disapproval denying a
permit to construct an accessory swimming pool on the grounds that the pool is proposed partly in a
side yard instead of the required rear yard,provided under Zoning Code Section 100-33.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 25, 2002, at which time
written and oral evidence was presented. Based upon all testimony, documentation, personal
inspection of the property and the area, and other evidence, the Zoning Board finds the following facts
to be true and relevant.
AREA VARIANCE RELIEF REQUESTED: Applicants request a location of an accessory 20' x 40'
in-ground swimming pool behind the house, in the south yard area, with setbacks of 85 feet from the
westerly lot line and approximately 115 feet from the easterly(rear yard)line at its closest point.
REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and
personal inspection,the Board made the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties. The property is a large wooded lot. The topography
of the land consists of marsh land and restricted non-building areas, regulated under the wetland
ordinances by other agencies. Applicant is proposing placement of the pool in an area that is best
suited since this area is more level and provides a buffer between the structure and woodland adjacent
to the marsh on this 2.6 acre lot.
2. The benefit sought by the applicant cannot be achieved by some method, possible for the applicant
to pursue, other than an area variance. There is a steep slope from the residence to the meadow land
in the rear yard, a conforming area, which makes it difficult to locate a pool. In addition, the

applicant's have tried to maximize the distance between the pool and the meadow lands to mitigate
potential impacts to the environment.
3. The variance granted herein is not substantial in relation to the code's required rear yard location
because only part of the in-ground pool will be located in the side yard. A major part of this pool
structure is behind the dwelling,at the south side of the site.
4. The alleged difficulty has been self-created and is due to the applicant's desire to enjoy an in-ground
swimming pool.
5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact
on physical or environmental conditions in the neighborhood. The variance granted is not substantial.
A:major part of this pool structure is behind the dwelling,at the south side of the site.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of anin-ground swimming pool while preserving and protecting the
character of the neighborhood and the health,safety and welfare of the community.
BOARD RESOLLUTION: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Chairman Goehringer, seconded by Member
Orlando,it was
RESOLVED, to GRANT the variance, as applied for in accordance with the pool location
shown on the survey prepared by Roderick VanTuyl, P.C. dated October 4, 1994, last amended July 7,
