THURSDAY, OCTOBER 17,2024
A special meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold
Town Hall Annex, Second Floor Conference Room, 54375 Main Rd at Youngs Avenue, Southold on
Thursday, October 17, 2024 commencing at 4:30 P. M.
The public had access to view and listen to the meeting as it was happening via Zoom. However, this
meeting was not a public hearing and no testimony was solicited or received.
Present were:

4:38 P. M. Chairperson Weisman opened the meeting in order to call for Executive Session.
Vote of the Board: Ayes: Member Weisman(Chairperson) Planamento Acampora and Lehnert This
resolution was duly adopted(4-0).
EXECUTIVE SESSION:
4:38 P. M. Motion was offered by Chairperson Weisman, seconded by Member Acampora to enter into
Executive Session in order to receive Attorney Advice. Vote of the Board: Ayes: Member Weisman
(Chairperson), Planamento,Acampora and Lehnert. This resolution was dull adopted(4- .
5:04 P. M. Motion was offered by Chairperson Weisman, and seconded by Member Dantes to exit
Executive Session. Vote of the Board: Ayes: Members Weisman (Chairperson) Dantes Acampora
Planamento, and Lehnert. This Resolution was duly adopted ,5-0).

WORK SESSION: Began at 5:12 P.M.
A. Requests from the Board Members for future agenda items.
B. The Board discussed requests for Extensions,Amendments to Decisions, and De Minimus
approvals.
C. De Minimus approvals and decision amendments should only be available to the applicant(s) within
one year from the issuance of the Board decision.
D. The Board discussed required board training for years 2024 and 2025. Any training conducted can
be rolled over to a following year, if necessary.
E. The Chairperson had discussed a proposal with the Town Board. The Town Attorney will assist in
CLE Live Stream Education.
POSSIBLE RESOLUTION TO CLOSE/ADJOURN THE FOLLOWING HEARINGS:
PRISTINE PROJECTS,LLC#7943 —(Adjourned from October 3, 2024) Request for a Waiver of Merger
petition under Article II, Section 280-10A,to unmerge land identified as SCTM No. 1000-63-1-5 which has
merged with SCTM No. 1000-63-1-4, based on the Building Inspector's May 13, 2024 Notice of
Disapproval; which states that a non-conforming lot shall merge with an adjacent conforming or non-
conforming lot held in common ownership with the first lot at any time after July 1, 1983 and that non-
conforming lots shall merge until the total lot size conforms to the current bulk schedule requirements
(minimum 40,000 sq. ft. in the R-40 Residential Zoning District); located, 155 Sunnyside Road, Southold,
NY. SCTM Nos.1000-63-1-4 and 1000-63-1-5. RESOLUTION: A motion was offered by Chairperson
Weisman, seconded by Member Dantes to ADJOURN HEARING to November 7, 2024. Vote of the
Board:Ayes:All. This Resolution was duly adopted. (5-0)

RESOLUTIONS:
a) RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member
Acampora to authorize advertising of hearings for the Regular Meeting to be held on Thursday,
November 7, 2024 which will commence at 9:00 A.M. for Executive Session and Regular Meeting
to begin at 10:00 A.M. Vote of the Board: Ayes: Member Weisman(Chairperson), Planamento,
Acampora, Dantes and Lehnert. This Resolution was duly adopted (5-0).
b) RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member
Acampora to approve minutes from the Regular Meeting held on October 3, 2024. Vote of the
Board: Ayes: Member Weisman(Chairperson), Planamento,Acampora, Dantes, and Lehnert. This
Resolution was duly adopted (5-0)
c) RESOLUTION ADOPTED: A Motion was offered by Chairperson Weisman, seconded by
Member Lehnert, to GRANT a DeMinimus Approval to File#7949 Soundhaus/Jeremias, 2635
Soundview Avenue,Mattituck,NY. SCTM No. 1000-94-1-12.1; to "allow the removal of the
extension of the Lirst platform and keep the platform in the staircase with the originally approved
size remain (4 ft. by 6 ft.) that was granted by the Trustees on February 2, 2007". Vote of the
Board: Ayes: Member Weisman(Chairperson), Planamento, Acampora, Dantes, and Lehnert.
Resolution was duly adopted (5-0 .
d) RESOLUTION ADOPTED: A Motion was offered by Chairperson Weisman, seconded by
Member Planamento,to DENY the request for a De minimus Approval for Appeal No. 7827, QJSG
Properties, LLC, 38015 Route 25, Orient,NY. SCTM No. 1000-15-2-15.7 to "to change the design
of a proposed Artist Studio'Vote of the Board: Ayes: Member Weisman(Chairperson)
Planamento, Acampora, Dantes, and Lehnert. Resolution was duly adopted ,5-0).
e) RESOLUTION ADOPTED: A Motion was offered by Chairperson Weisman, seconded by
Member Acampora, to AMEND decision of December 15, 2022, File#7705 Peros, 815 Rabbit
Lane, East Marion,NY. SCTM No. 1000-31-17-18 "to remove condition to install an IIA
Innovative Advanced Septic System". Vote of the Board: Ayes: Member Weisman(Chairperson),
Planamento, Acampora, Dantes, and Lehnert. Resolution was duly adopted (5-0).

There being no other business properly coming before the Board at this time,the Chairperson declared the
meeting adjourned. The meeting was adjourned at 5:28 P. M.
