Box 1179 Eric Sepenoski J l Southold, New York 11971 Liz Gillooly Telephone(631) 765-1892 Elizabeth Peeples � a0 Fax(631) 765-6641 C®UIdTI,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD December 11, 2024 Paul Frade 33 Galahad Lane Nesconset, NY 11767 RE: 8150 MAIN BAYVIEW ROAD, SOUTHOLD SCTM# 1000-87-5-23.6 Dear Mr. Frade: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, November 13, 2024 regarding the above matter: WHEREAS, PAUL FRADE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 24, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 4 and 6 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: 1-to-1 replacement for the 12 trees removed using 2-3" caliper native hardwood; establish and perpetually maintain a 10'-wide non-turf buffer landward of the proposed pool fence; and a drainage plan to address the edge of the driveway; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 13, 2024, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of PAUL FRADE to install an 18'x36' on-grade in-ground pool with 995sq.ft. pool patio and walkway; install a 29' long by 2.5' tall at highest point retaining wall; install a 48' long, 1.3' high upper retaining wall and a 48' long, 1.5' high lower retaining wall; install 4' high pool enclosure fencing; install 45sq.ft. pool equipment area; install a 4'x4' drywell for pool backwash; approx. 100 cubic yards of pool fill to be excavated with ±70 cubic yards of fill to be used to raise and level the proposed patio and walkway and slope grade from patio to the existing grade, and ±30 cubic yards of fill to be used around retaining walls; with the conditions of a 1-to-1 replacement of the 12 trees that were previously removed using 2- 3" caliper native hardwoods; establish and perpetually maintain a 10'-wide vegetated non-turf buffer landward of the proposed pool fence; all lighting be dark-skies compliant; and as depicted on the site plan prepared by Homeport Engineering, P.C., received on December 2, 2024, and stamped approved on December 3, 2024. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. I've been made aware that this was done by the homeowner without any authorization from the Town. The wetlands area and plantings around them must be preserved. The last thing that area needs is the construction of a pool so close to Corey Creek and the wetlands. Cutting down the trees displayed the homeowners disregard for preserving our ecosystem&his inability to abide by Town codes. In addition to fines for destroying 10+trees, my hope is that the owner is also held responsible for planting new trees for each one they cut down. If the town wishes to approve a pool, perhaps it can be located in another part of the property which is away from the wetlands (maybe along the side of the house). I am out of town next week so I cannot attend the hearing for the permit. I examined the proposed pool and hope that the Trustees will NOT approve a permit for the following reasons. 1. Although approved by a previous Trustee board, the house construction has compromised the water quality of that corner of Corey Creek. Corey Creek is one of the last creeks where the water is clean enough to shellfish year round. 2. The plans for the pool are far too close to the wetlands. Since pools require strong chemicals like Chlorine and Muriatic Acid for water disinfection, mismanagement of the chemicals so close to the wetland may further damage the creek. 3. The property itself slants downward from Main Bayview. Our adjacent Cove property has difficulty with erosion from the incline. The pool will divert natural runoff into streams that will cause damage and erosion. 4. According to Dr. Gobler's 2024 SUNY Stoney Brook water quality report, algae blooms were worse than ever in Peconic Bay and it's tributaries. We need to manage our estuary creeks well and allowing pools so close to wetland is not good management. 5. As an individual engaged in aquaculture and a next door neighbor I hope you will consider my concerns and reject this permit.
