SCTM# 1000-87-5-7 Dear Mr. Cole: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 15, 2025 regarding the above matter: WHEREAS, EN-Consultants on behalf of WALTER GLESS, AMY FEULNER, CHRISTOPHER GILLANDERS, GARY GILLANDERS, KEITH GILLANDERS, LAUREN STRUNK, PAUL GILLANDERS, BRIAN SINCLAIR & SUZANE CALTAGIRONE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 5, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 9 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: dialing back the seaward length of the dock; and 2 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 18, 2024, and again on January 15, 2025, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of WALTER GLESS, AMY FEULNER, CHRISTOPHER GILLANDERS, GARY GILLANDERS, KEITH GILLANDERS, LAUREN STRUNK, PAUL GILLANDERS, BRIAN SINCLAIR & SUZANE CALTAGIRONE to replace existing bulkhead with 83 linear foot low-sill bulkhead with a 15' return on south side; remove existing ramp and floating dock and construct a new dock consisting of a 4'x10 ramp to grade landward of low-sill bulkhead to a 4'x42' catwalk with Thru-Flow type decking, to a 4'x20' fixed "T" configuration dock with Thru-Flow decking; a rope handrail to be installed on one side of the catwalk; revegetate disturbed area landward of low-sill bulkhead with Spartina patens, Baccaris halimifolia, and Iva frutescens; and to trim the phragmites to not less than 12" by hand on an as-needed basis; and as depicted on the site plan prepared by Cole Environmental Services, received on February 18, 2025, and stamped approved on February 25, 2025. Re:Adjacent Dock at 700 Koke Drive 800 Koke Drive auth�lF5o_w� n Southold, NY 119'71 Board ofTrtrstees SUM No.: 1000-87.00-05.00-007,000 Dear Board of Trustees, At the Hearing on December 18, 2024, the Board noted that the configuration of the dock located at 700 Koke Drive was not permitted. According to the Board, since the configuration was not permitted, it did not applyto the pier line. After some research, however, we have found that the existing configuration is permitted. Permit No. 6939 was issued on August 20, 2008,for the following: "...the existing 41"x37.5' fixed dock,35"x145 ramp, and 6'x10'floating dock with two(2)tie--off piles, with the condition that if the dock, ramp,float or associated piles ever need to be replaced/repaired, they must be upgraded to rneet the requirements of the Southold l-own Code, Chapter 275-Wetlands and Shoreline and approved by the Board of Trustees, and as depicted on the site plan prepared by.Jerry Cibuiski, received on June 16, 2008." Please see Exhibit A. On February 18, 2009,the Board approved "the Amendment to Wetland Permit#6939 to replace the existing 6'x10'floating dock with a 6'x20'floating dock, and to replace the two pilings at the end of the float,with the condition the float is angled to the north and doesn't extend past the property line, and as depicted on the plan prepared by Paul Salerno dated February 18, 2009." Please see Exhibit B. On February 24, 2009, Paul Salerno submitted a letter noting that the ramp was extended from 14.5'to 17.5 feet. According to Mr. Salerno,the change was necessary to abide by the Board's wishes to remain within the property lines. Plans depicting the change were stamped approved by the Board on February 27, 2009. Please see Exhibit C. The configuration that exists today reflects what was approved by the Board on February 27, 2009. We would also like to note that no pier line exists for 800 Koke Drive. The pier line is"between the immediately adjacent existing permitted principal structures,docks, piers,wharves, or floats." Only one immediately adjacent structure exists—at 700 Koke Drive. 'The limiting factor for the dock length in this case is that it cannot exceed 25%of the waterway. The width of the waterway (MLW to MLW) is 1,420 feet. A quarter of the waterway would be 355 feet. The proposed dock extends approximately 59'from MLW,which is about 4.15%. In short,the proposed dock conforms to the limitations of Chapter 275 and is in keeping with the adjacent legal dock. At the meeting on the 18th. I was asked to resubmit the work plan by putting the ramp at a 20 degree angle. On the attachod plans, the floating, dock shifts over so that when I dock a boat, it will not extend over the neighbor's property or beyond the original line of the catwalk. I think this is what we wanted to accomplish. I had to extend the ramp from 14 1/2 feet to 17 1/2 feet due to the angle of the ramp. Please let me know if this is acceptable as I would like to obtain town approval before filing with the DEC. I greatly appreciated your guidance in this process.
