T~lephone SO 5-2660 MINUTES SOUTHOLD TOWN BOARD OF APPEALS February !4~ 1963 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M., Thursdays February 14~ 1963 at the Town Office~ Main Road, Southoldt New York. There were present: Messrs. Robert W. Gillispie, Jr., Chairman, Charles Grigonis~ Jr., Serge Doyen, Jr., and Fred Hulse, Jr. PUBLIC HEARING: Appeal No. 542 - 7:30 P.M. (E.S.T.), upon application of John DeAlbertis~ Old Shipyard Lane~ Southold, New York, for a variance in accordance with the Zoning Ordinance~ Article III, Section 303 and Article X, Secti~ 1000A, for per- mission to divide property into two lots each containing less than the minimum area and one containing less than the minimum frontage. Location of property: south side Wilm&rth Avenue and north side Washington Avenue, Greenport, NewYork~ bounded north byWilmarth Avenue~ east by A. Mo Tasker Estate, south by Washington Avenue, and west by Adele E. Busso. Fee paid $5.00. T~E CF~AIRMAN: Is there anyone present who wishes to speak for this application? MR. JOHN DeALBERTIS~ Southold: I think it is covered pretty well in the application° THE CHAIRMAN: What is the size of some of the other lots in the area? MR. DeALBERTIS: Some are 50 ft. and some are 100 ft. If this variance is granted I will sell the lots and one house will go up on one of the lots this spring° MR. HOWARD TERRY: The filed map in that area has a l~t of 50 fto lots. T~IE CHAIRMAN: Did you own this property before zoning? MR. DEALBERTIS: Yes. I was going to build on them myself, but I bought in Southold instead. (The Board discussed the general area with Mr. DeAlbertis~) T~E C~L~IRMAN: Is there anyone present who wishes to speaka~ against this application? (There was no response°) After investigation and inspection the Board finds that this parcel, which waspurchased prior to Zoning, fronts on two streets. The best division of this property to enable it to be utilized as two lots is across the center~ leaving one lot of approximately 12,208 Sqo ft. of area and 102.02 ft. frontage, and the other with approximately 11,965 ~qo ft. of area and 97.99 ft. frontage° The area is comprised ofma~yundersized lots~ some with 50 ft. frontage. The filed map bounding this parcel to the east~ known as "Washington Heights" was originally laid out in 50 lots. Southold Town Board of Appeals -3- February 14~ 1963 The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hard- ship ~eated is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district° On motion of Mr. Gillispie, seconded by Mr. ~igonis~ it was RESOLVED that John DeAlbertis, Old Shipyard Lane, $outhold, be granted permission to divide property into ~wo lots each contain- ing less than the minimum area and one containing less than the minimum frontage. Location of property: south side Wilmarth Avenue and no~th side Washington Avenue, Greenport, New York. The parcel fronting on Washington Avenue will contain approximately 12,208 sq. ft.~ with 102.02 ft. frontage and 120.05 ft. in depth. The Parcel on Wilmarth Avenue will contain approximately 11~965 sq. ft.~ with 97.99 ft. frontage and 120.05 fto in depth. Everts~ 1011 South Flagler'Drive, West Palm Beach, Florida, for a variance in accordance with the Zoning Ordinancez Article III, Section 303 and Article X, Section 1000~ for permission to divide property into two lots each having less than 100 ft. frontage. Location of property: west side private right-of-way known as Truman Path, located on the south side Main Road, East Marion~ New York. Property bounded north by E. J. Pedlowe~ east by Truman Path, south by Albert Vogt~ and west by Marion Lake. Fee paid $5.00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspaper and notice to the applicant. I believe the application covers everything pretty wello Southold Town Board of Appeals -4- February 14, 1963 (The Board discussed the layout of the area° It was determined that the lot sizes on either side of the proposed division are from 50 ft. in width to 100 ft. and 150 ft. in widths) THE CHAIRMAN: Are there any other questions? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that this area was laid out prior to Zoning on an unfi~ d map known as "Bay Lake Park" and the lot sizes were 50 ft. in width~ Several of the lots were sold in their original size of 50 ft. in width~ some were sold in 100 ft. widths and some 150 ft. in width. This request for two 75 ft. lots i~ definitely felt to be in conformity with the area. Th~ depth of the proposed lots will be an average of approximately 252 feet. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; th~hard- ship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; the variance does observe the spirit of the Ordinance and will not change the character of the district. Penny~ Inco Main Road~ Greenport, New York~ for a special exception in accordance with the Zoning Ordinance~ Article III, Section 300, Subsection t1~ for permission to erect and maintain a directional sig~for George L. Penny Lumber~ Inc. on the property of John G. Poliwoda, south side Route 27A~ approximately 500 feet west of Atbertson Lane, Greenport~ New York. Fee paid $5.00. The Chairman opened the hearing by reading application for a special exception, legal notice of the hearing, affidavit attest- ing to its publication in the official newspapsr and notice to the applicant. On motion of Mr. Grigonis~ seconded by Mr. Doyen~ it was RESOLVED, 3~ that Appeal No. 544 of George L. Penny Lumber, Inc., Main Road, Greenpott, for permission to erect and maintain a directional sign, be adjounned indefinitely due to the uncertainty relating to the probable change in the sign sections of the Building Zone Ordinance. Vote of the Board: Ayes:- Mr. Giliispie, Mr. Grigonis~ Mr. Doyen~ and Mr. Hulseo On motion of Mr. Gillispie~ seconded by Mr. Grigonis~ it was RESOLVED that the minutes of January 31~ 1963 be approved as submitted. (E.S.T.), Thursday, February 28~ 1963, Town Office, Main Road, Southold, New York ~ time and place for hearing upon application of Eliza S. Barker, Love Lane, Mattituck, New York~ for a variance in accord- ance with the Zoning Ordinance, Article IV, Section 406, for permission to exceed the minimum percentage of usable lot area and reduce the rear setback. Location of property: west side Love Lane~ Mattituck, New York, bounded north by G. Ho Riley, east b y Love Lanes south and west by G. Ho Riley. Vote of the Board: Ayes:- Mr. Gillispie, Mro Grigonis, Mr. Doyen~ and Mr. Hulse. On motion of Mr. Doyen, seconded by Mr. Hulse~ it was RESOLVED that the Board of Appeals set 8:00 P.M. (E.S.T.), Thursday, February 28, 1963, Town Office, Main Road, Southold, New York as time and place for hearing upon application of Baker and Fickeissen~ $outhold, New York~ a/c Ephriam Cross~ Bay Shore Road, Greenport~ New York, for a variance in accordance with the Zoning Ordinance, Article III~ Section 304, for permission to reduce the front yard setback to 32 feet. Location of property: east side Bay Shore Road, Greenport~ New York, Lot NOo 51 on map of Peconic Bay Estates, bounded north b~E. Landsberry, east by Peconic Bay, south by W. Jo Moyer~ and west by Bay Shore Road. Vote of the Board: Ayes:- Mr. Gillispie, Mr~ Grigonis, Mro Doyen, and Mr. Hulse. On motion of Mr. Huise~ seconded by Mr. Grigonis, it was RESOLVED that the Board of Appeals set 8:15' P.M. (E.S.To)~ Thursday, February 28~ 1963, Town Office, Main Road, Southold, New York as time and place for hearing uponapplication of-William G. Cox, Track Avenue~ Cutchogue~ New York, for a variance in accord- ance with the Zoning Ordinance~ Article III, Section 303 and Article X, Section 1000A~ for permission to divide property into two lots leaving one lot with insufficient frontage. Location of property: south side TrackAvenue, Cutchogue, New York, Lots 53, 54 and 55 on map of M. S. Hand, bounded north by Track Avenue, east by N. Plimpton and Jo Mitchell, south by So Annabel and V. Annabel, and west by S. J. Ryniec. The next meeting of the Southold Town Board of Appeals will be held 7:30 P.M.~ Thursday, February 28~ 1963 at the Town Office, Main Road, Southold~ New York° The Board of Appeals received letters of opposition addressed to the Town Board and Planning Board relative to the proposed change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District on the property of Ruth Wells at Bay View, Southold~ New York.
