2 D & S HAYFIELDS , LLC
3 COUNCILMAN GREG DOROSKI : So the
4 purpose of tonight ' s first public
5 hearing, and I ' m gonna read a summary
6 here , is to consider the purchase of a
7 development rights easement on property
8 owned by D & S Hayfields , LLC . Said
9 property is identified by Suffolk County
10 Tax Map Numbers listed, located at 3460
11 Elijah ' s Lane , Mattituck . The purchase
12 price is $ 76, 023 per buildable acre,
13 estimated at $ 1 , 146 , 426 . 80 for the 15 . 08
14 plus/minus acre easement, on the 17 . 25
15 plus/minus acre parcel . The 2 . 17
16 plus/minus acre reserve area will remain
17 linked to, and be prohibited from being
18 subdivided from the area subject to the
19 easement . The full text of the proposed
20 local law is available for review in the
21 Town Clerk ' s Office and on the Town ' s
22 website . In the folder here , I have a
23 copy of an LW -- no . This is a copy of
24 the Planning Board letter . Comments
25 from the Planning Board, supporting

1 acquisition of this , and saying that
2 it ' s a Type II action not subject to
3 SEQRA review . Copy of a letter from our
4 LWRP Coordinator, verifying that this is
5 consistent with the LWRP . I have a copy
6 of an Affidavit of Publication of the
7 legal notice in the Suffolk Times , with
8 a copy of the Legal Notice that was
9 published . The invoice to pay for that
10 legal notice . I have a copy of an
11 Affidavit that the legal notice was
12 posted on the back bulletin board,
13 signed by our Town Clerk, Denis
14 Noncarrow . A copy of the legal notice
15 setting tonight ' s public hearing . And I
16 have a copy of the resolution adopted by
17 this Town Board to set this public

1 Coordinator, Lily McCullough, to address
2 the Board and the public .
3 MS . MCCULLOUGH : Good evening . I
4 am Lily McCullough . I am the Southold
5 Town Land Preservation Coordinator . I ' m
6 here to talk about the D & S Hayfields ,
7 LLC PDR project . This is the property
8 on the map that ' s outlined in red, and
9 it ' s located on the east side of
10 Elijah ' s Lane in Mattituck . It ' s
11 roughly 17 . 25 acres . It is currently
12 planted in sod . It ' s part of an
13 adjacent sod operation . Just over the
14 LIRR tracks , on the same side of
15 Elijah ' s Lane . And it ' s located in the
16 Agricultural Conservation Zone . We will
17 be using community preservation funds to
18 acquire a 15 . 08 acre development rights
19 easement which restricts use of the land
20 to agricultural production . The dashed
21 white line on the map outlines a 2 . 17
22 acre development rights intact reserve
23 area in the north-western portion of the
24 property, excuse me . That will remain
25 linked to the easement area . The

1 purchase price is $ 76, 023 per buildable
2 acre , which brings the estimated
3 purchase price to $ 1 , 146, 426 . 84 . The
4 final purchase price is subject to a
5 final survey of the easement and reserve
6 area . So that $ 76, 023 might change the
7 price a little bit . Depending on what
8 the final surveyed acreage is . This is
9 a priority preservation project . It ' s
10 part of an active farm operation . It
11 contains over 90o prime soils , and it ' s
12 adjacent to a tremendous amount of
13 preserved farmland . It ' s going to -- so
14 it ' ll be a significant piece in a large
15 block of preservation between Elijah ' s
16 Lane and Alvah ' s Lane . It adds to an
17 existing about 290 acres of preserved
18 farmland between Elijah ' s and Alvah ' s
19 Lane , and it abuts 16 acres of preserved
20 land that ' s part of the same operation .
21 I ' ll also note that the Agricultural
22 Advisory Committee reviewed the project
23 and the proposed design, and they
24 concluded that this was a farm suitable
25 for preservation and farming in the long

1 run . I would like to thank the
2 landowners for participating in the
3 program . They ' ve preserved land with
4 the Town in the past . It ' s a voluntary
5 program . We can ' t do this work without
6 them . So it ' s a significant
7 contribution to the Town . I would
8 especially like to thank them for their
9 patience with this process . This was
10 one of my first applications that I
11 received after stepping into the role ,
12 and I appreciate their patience , as I
13 got my sea legs under me . And as we
14 together navigated some significant
15 hurdles . So many thanks to the
16 landowners . I ' m pleased to present the
17 project today . It ' s an important piece
18 in preserving Mattituck ' s agricultural
19 lands . And the Land Preservation
20 Committee and I request that the Board
21 proceed with this acquisition .

22 AMENDMENTS TO 2024 CDBG
23 COUNCILMAN GREG DOROSKI : The
24 purpose of tonight ' s second public
25 hearing is to consider a Local Law to
OCTOBER 22, 2024 REGULAR MEETING 9
1 override the tax levy limit . The
2 purpose of this law is to allow the Town
3 to adopt the budget for the Fiscal Year
4 2025 . It may require a real property
5 tax levy in excess of the limit
6 established by the General Municipal
7 Law . The Town has made efforts to
8 reduce spending . But due to increased
9 costs for Town services and operations ,
10 the Board finds it necessary to adopt a
11 budget that exceeds the tax levy limit .
12 The full text of the proposed local law
13 is available for review in the Town
14 Clerk ' s office and on the Town ' s
15 website . In the folder here , I have a
16 copy of the Affidavit of Publication of
17 the legal notice in the Suffolk Times ,
18 along with a copy of the legal notice ,
19 and the invoice to pay for the
20 publishing thereof . I have a copy of
21 the legal notice . I have a copy of
22 verification that the legal notice ran
23 in the edition, the October 17th edition
24 of The Day, along with a copy of the
25 invoice for payment , and the legal

1 notice . A copy of an affidavit that the
2 legal notice was posted on the back
3 bulletin board signed by our Town Clerk,

14 you . All right . Does anyone who would
15 like to speak on this Public Hearing?
16 ROBERT DUNN : Robert Dunn, Peconic .
17 This is really just a discussion more
18 than a criticism . I fully trust you
19 guys , that if you need more money, you
20 need more money, and that ' s reality . My
21 question is , when you apply more money
22 for this year, that carries over to next
23 year and all the following years . So in
24 other words , we ' re supposed to be at 20 ,
25 and let ' s say you ' re added 20 on because

1 you need it -- justifiably needed to
2 this year, well , the next year we ' re
3 starting off with a new floor of 40 . If
4 you added 20 on that time . That could
5 be 8 % going back . You follow me to the
6 year before? And that can get into the
7 second -- not hurt making my part .
8 Pretty much you guys are going to have
9 to work real hard to get out of my
10 range . But if you had somebody who had
11 a $ 10 , 000 or $ 12 , 000 tax bill , not
12 uncommon here for a medium priced home .
13 You ' re talking about a thousand dollars .
14 That could be serious if someone retired
15 or on a lower income . So I just -- all
16 I ' m questioning, and I ' m really
17 questioning the thought and discussion
18 is about reverting . You follow me? You
19 can increase this year, but should it
20 carry forward next year? Or should
21 there be a notification of it, like on
22 the packing end, the side of your
23 cigarettes ? You know, it ' s really,
24 because it ' s -- I don ' t wanna call it
25 deceiving, but it ' s not -- it ' s not --

1 next year, if you don ' t do anything, if
2 you just keep it where it is , and next
3 year will be paying 4% more than we did
4 last year in theory .
5 COUNCILMAN GREG DOROSKI : I guess
6 what I ' d say to that, and I ' d really
7 commend the Supervisor on this and the
8 Town Comptroller . This year we ' re
9 approaching budget and as a multi-year
10 process . And we ' re not only talking
11 about the ' 25 budget . We ' ve been
12 talking about the ' 26 budget . That ' s my
13 first time as a on Board member that
14 we ' ve really had that longer view . And
15 I think to your point of the cumulative
16 impacts of budgets , it ' s important to
17 recall that we had a 0o increase last
18 year . And that 0o is putting us in the
19 position this year where we ' re being
20 forced to raise it that much higher .
21 Especially --
22 ROBERT DUNN : Then that ' s a good
23 note . And maybe that ought to be on the
24 side of the pack of cigarettes . That ' s
25 the point I ' m making . You know . All

1 the conversations are going to be the
2 mora . They raise the taxes .
3 COUNCILMAN GREG DOROSKI :
4 Absolutely . You know, the Supervisor --
5 you know, was kind of joking about --
6 ROBERT DUNN : Just to continue
7 that , that ' s why it bothers me that this
8 room is always empty . Because when they
9 make the complaints , they make the
10 complaints outside . That ' s not fair to
11 you . That ' s not fair to themselves .
12 Because they ' re questioning something
13 with no answer and no possibility for an
14 answer . I mean, again, I trust you
15 guys , if you need 20 more , and if you
16 need an extra 20 next year, I ' ll be fine
17 with that too . But I just -- it ' s a
18 cumulative thing . That was the right
19 word .
20 SUPERVISOR AL KRUPSKI JR . : And
21 thank you . And to Greg ' s point , we
22 don ' t take this lightly because --
23 ROBERT DUNN : I ' m sure you don ' t .
24 You don ' t do it every year .
25 SUPERVISOR AL KRUPSKI JR . : It ' s

1 not our money . And I was on the Board
2 in 2008 , and we had a very large tax
3 increase that year . And we made some
4 adjustments and the budget did flatten
5 out . The problem -- and I ' m on these
6 calls with the supervisors from all over
7 the -- I ' m on meetings with supervisors
8 from Suffolk County and the East End,
9 two separate groups . But also on these
10 Zoom calls with supervisors from around
11 the state . And they ' re all faced with
12 the same type of inflation for equipment
13 and for any kind of maintenance on
14 buildings . They ' re faced with employees
15 who got hit in their lives with the same
16 kind of inflation that need money to
17 live . And so these things , healthcare
18 have gone up about 15 to 170 .
19 ROBERT DUNN : Agreed . We ' re all
20 spending money, I mean .
21 SUPERVISOR AL KRUPSKI JR . : And so
22 all these things have to be addressed .
23 And at the same time, a lot of people
24 came to the Board throughout the year
25 and said, gee , we need greater services .

1 Greater services . And so it ' s trying to
2 manage all that at the same time . So we
3 do take it very seriously .
4 ROBERT DUNN : Then maybe The
5 reality should be, the 20 , should be 30 ,
6 and that might be a discussion going
7 forward .
8 COUNCILMAN GREG DOROSKI : That ' s a
9 New York State issue .
10 SUPERVISOR AL KRUPSKI JR . : We did
11 send a letter to the governor from the
12 13 Long Island Town Supervisors , saying
13 that some things should be exempt from
14 the 20 cap . Because the 20 cap is not a
15 bad thing, because it is -- it ' s an
16 arbitrary number . But it does keep
17 everyone ' s -- In the same place that you
18 should control the spending in any
19 municipality .
20 ROBERT DUNN : But that would be the
21 same , it was 30 . And what I ' m saying,
22 if you got to keep going back and asking
23 for money at the moment, then it kind of
24 --
25 SUPERVISOR AL KRUPSKI JR . : Some

1 things are also beyond the Town ' s
2 control of what the expenses are going
3 to be . And so like the healthcare
4 costs , things like that, are beyond the
5 control . Certain bonded indebtedness .
6 So there ' s a list of things that we sent
7 to the governor to ask for relief so we
8 can keep the tax cap, but things that
9 are beyond our control that shouldn ' t be
10 accounted in that .
11 ROBERT DUNN : Okay . I just wanted
12 to raise the issue . It ' s not like I ' m
13 saying --
14 SUPERVISOR AL KRUPSKI JR . : This is
15 statewide, this is --
16 ROBERT DUNN : It ' s not like I ' m
17 saying you ' re doing something wrong, I
18 just think it ' s a poor message . When
19 things aren ' t what they appear to be,
20 that ' s when the people who pay the taxes
21 begin to question the fairness and even
22 the honesty of people . And I just find
23 that to be wrong . Government shouldn ' t
24 be questioned like that .

7 ERIC MCCLURE : Eric McClure,
8 Mattituck . I ' ll just add to that the 20
9 cap . It ' s an artificial construct . It ' s
10 a political construct more than anything
11 else . Nobody likes the idea of raising
12 taxes half-hazardly . The Town ' s got
13 very limited revenue streams . And this
14 is one place where it can raise revenue
15 when necessary . So we ' ve seen the
16 inflationary pressures from the last few
17 years . You ' ve talked about the
18 healthcare cost and all those kinds of
19 things . So as Mr . Dunn had mentioned,
20 he has faith in the Town government to
21 act appropriately . So , I just wanted to
22 say that I think it ' s certainly
23 reasonable to do this . Thank you .

1 actually, because of this , I did not put
2 any raise for the Town Board in the
3 budget . Just to try to -- not that it
4 makes that big of fiscal impact , just to
5 set the tone that we take this very
6 seriously .

10 EFFIE GALANIS : Good evening .
11 First, I ' d like to say thank you for
12 allowing us to speak this evening . My
13 name is Effie Galanis . I am Board
14 President of the North Fork Beach
15 Condominiums , located at 52325 County
16 Road 48 . That ' s where Sound View meets
17 County Road 48 , just west of Town Beach .
18 Last week, you heard from another unit
19 owner, Karen McClellan . So we really do
20 appreciate that you ' ve been in contact
21 and have been so responsive . Me and
22 another unit owner, Barbara Papantoniou,
23 and Karen and I are part of the Beach
24 Preservation Committee at North Fork
25 Beach Condominium. So we did want to

1 just continue to show up, and show
2 support for the Town of Southold and let
3 you know that we are here to assist in
4 any way that might help the Town, as far
5 as the coastal erosion matter goes . It
6 is an ongoing matter for all of us . All
7 the unit owners at North Fork Beach
8 Condominiums , but also all the homes
9 along Soundview Avenue . As I ' m sure you
10 are very well aware . So please consider
11 continue -- to consider the issue . And
12 please let us know if there ' s something
13 that we can assist with in any way .
14 Barbara, I don ' t know if you want to add
15 anything?
16 BARBARA PAPANTONIOU : Sure . I just
17 think that this is really nice that we
18 have the opportunity to be able to
19 communicate as a public to our Town
20 officials . I thought it was important
21 to meet the Town officials , and see how
22 things are done and ran in Southold .
23 And you guys are doing a great job . I
24 know it ' s not just our section, and the
25 road is compromised, but I see you are

1 on top of it . There are so many
2 projects that you ' re working on
3 regarding to wetlands , conservation, so
4 on and so forth . So, I know that in the
5 future that we can work together . I did
6 study and have a degree in Geology and
7 Earth Environmental Sciences . I know
8 how important the impact is . And if we
9 have anything else to offer . But I
10 think it is preliminary now . I know
11 that it is on the agenda, and we ' ll be
12 at some point . So we ' re just here and
13 wanted to introduce ourselves .
14 SUPERVISOR AL KRUPSKI JR . : Thank
15 you . I appreciate that . We ' ve been --
16 I just spoke to the Town Engineer about
17 this just the other day . Once we get
18 the survey, we ' ll set up a meeting with
19 your group, any other interested
20 neighbors who are in the area .

22 fantastic .

24 Town Trustees , who would administer to

4 that . You saw there was a resolution on
5 for the Fisher ' s Island Seawall . It ' s
6 very similar situation . And we ' re in
7 the process of getting tidal work done
8 there . So we ' ll know what we ' re talking
9 about and we ' ll meet with the -- we ' ve
10 been in contact with the stakeholders
11 there as well . So this is a good start .

19 I managed to find time to get out on the
20 water this afternoon in Mattituck Inlet .
21 And I had missed the news in September
22 about the maintenance dredging . So went
23 around the bend and there were two
24 enormous barges and a big crane . Do
25 you, do you guys know -- are they

1 planning to get up into Long Creek at
2 all ? That ' s where --
3 SUPERVISOR AL KRUPSKI JR . : No, no .
4 That is just in the main channel . Going
5 straight towards the federal anchorage .
6 And it took years to get the Army Corps .
7 We never really thought it would be
8 done . They have to actually barge the
9 material out . It ' s incompatible with
10 beach nourishment . So it ' s going to be
11 barged out . I think out of state .
12 Because it ' s really mucky material . So
13 that should last for a long time, that
14 work . So we ' re very grateful . We
15 worked with the, of course, with the
16 Town Trustees , New York State DEC, as
17 partners . And we did have a meeting
18 here . The Army Corps ran the meeting,
19 and we included the Park District and
20 the Chamber .
21 ERIC MCCLURE : Great . Doesn ' t
22 solve my lower water at my dock .

24 ERIC MCCLURE : 20 years ago, but
25 there are other ways to figure that out .
