The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, November 4, 2024:
WHEREAS, this site plan is for the proposed creation of a 7,918 sq. ft. multiple dwelling
unit consisting of five (5) apartments at 1,199 sq. ft. each, associated driveways and

The Southold Town Planning Board adopted the following resolutions at a meeting held on
Monday, November 4, 2024
WHEREAS, on August 28, 2024 the applicant submitted a Subdivision Application for review by
the Southold Town Planning Board; and
WHEREAS, this proposal is for the standard subdivision of a 17.46-acre parcel into 5 lots,
where Lot 1 is .83 acres, Lot 2 is .80 acres, Lot 3 is .81 acres inclusive of a .11-acre flag, Lot 4
is 1.03 acres inclusive of a .20-acre flag and Lot 5 is 13.68 acres and includes a 3.05-acre
development area, 10.25 acres of open space and .38 acres of wetlands in the R-40 Zoning
District.; and
WHEREAS, on September 23, 2024 the Southold Town Planning Board found the application
complete; and
WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town Planning
Board shall have the authority to modify or waive, subject to appropriate conditions, any
provision of these subdivision regulations, if in its judgment they are not requisite in the interest
of the public health, safety and general welfare, except where such authority would be contrary
to other ordinances or state law; and
WHEREAS, the Southold Town Planning Board has determined that the following provisions of
the Southold Town Code §240 Subdivision of Land are not requisite in the interest of the public

health, safety, and general welfare because this subdivision application is proposing to reduce
the number of new lots to 4 lots, and therefore are eligible for a waiver:
a. Existing Resources Site Analysis Plan (ERSAP);
b. Yield Plan;
c. Primary & Secondary Conservation Area Plan; and
WHEREAS, the Planning Board has determined the proposed action to be Unlisted as it does
not fall within the Type I or Type II actions pursuant to the State Environmental Quality Review
Act (SEQRA) 617.5; and
WHEREAS, on October 7, 2024, the Planning Board, at their Work Session, reviewed the
submitted map and found that all requirements have been met pursuant to Article V Sketch Plat;
therefore be it
RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of,certain
provisions, hereby waives the following provisions of subdivision:
a. §240-10 (A): Existing Resources Site Analysis Plan (ERSAP);
b. §240-10 (8): Yield Plan;
c. §240-10 (C): Primary & Secondary Conservation Area Plan; and be it further
RESOLVED, that the Southold Town Planning Board has determined that this proposed action
is an Unlisted Action under SEQRA as described above; and be it further
RESOLVED, that the Southold Town Planning Board grants a Conditional Sketch Plan
Approval upon the map entitled "Cluster Subdivision Sketch The Old Town Farm LLC"
prepared by Kenneth Woychuk Land Surveying, PLLC, dated December 20, 2023, with the
following conditions:
a. Submit a complete Preliminary Plat Application with a Preliminary Plat containing the
following corrections and additions:
i. Label the plat "Preliminary Plat of The Old Town Farm Clustered Standard
Subdivision".
ii. Show the locations of proposed concrete monuments to mark the new lot
corners and limit the non-disturbance buffer.
iii. Add a label "5" to the Open Space.
iv. Shift the reserve area on Lot 5 so that it abuts the west parcel boundary,
eliminating the 50' wide open space area between them.
v. Remove the 75/75 Conservation Subdivision Calculation and the 80/60
Conservation Subdivision Calculation tables.
vi. Remove the label Lot 2 in the reserve area.
vii. Label the Coop Enclosure, 96.2' Plastic Greenhouse and Covered Storage
"To. be Removed".
viii. Provide the width and length of the access to the Lot 5 Reserve Area where
single family residence could be constructed.

ix. Design a "common driveway" pursuant to Chapter 240. Subdivision of Land
Article X11. Design Standards§ 240-45. Lots; streets; common driveways;
flag lot design. and one curb cut to access Lots 3 and 4. The maximum
number of lots using a common driveway shall be two if the common
driveway has one entrance on a public road. Label "common driveway."
Show the outline of the common driveway on the subdivision map as a
dotted line, and submit a separate Common Driveway plan with design
details.
x. Show the 100'. wide Board of Trustee jurisdiction from the freshwater
wetland on the plat.
Sketch Plat Approval is valid for six months unless an extension of time is requested and
granted by the Planning Board. The next step in the subdivision process is to submit the
Preliminary Plat Application.

e. Preliminary Plat Review; and
WHEREAS, pursuant to the Resubdivision policy set by the Planning Board on
February 2011, this application is eligible for a decision from the Planning Board prior to
receiving approval by the Suffolk County Department of Health Services (SCDHS) as it
meets the following criterion set forth in that policy:
• Where no new development potential will be created in the parcel to which the
land is transferred; and
WHEREAS, this application is EXEMPT from review by the Local Waterfront
Revitalization Program as no new development potential will come as a result of this
Resubdivision; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is a Type II Action under SEQRA according to 617.5(c)(16) "granting of individual
setback and lot line variances and adjustments;" therefore be it
RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of
certain provisions, hereby waives the following provisions of subdivision:
