S`EQRA DETERMINATION: The Zoning Board of (IAppeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 59,875 sq. ft. parcel has 169.40 ft. along the south side"of Strohson Road in Cutchogue. The property is improved with variable one-story and two-'sto'ry dwelling and detached garage as shown on the December 6, 1988 survey, revised January 17, 200, by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's Atgust 8, 2003 Notice of Disapproval, citing Section 100-30A.3, in its deniahof a building permit appllication concerning a proposed second-story addition at less than 50 feet from" the front property line.', FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 20, 2003, at which time written and oral evidence were presented. 1! Based upon all testimony, documentation; personal inspection of the property, and other evidence,J the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-story addition, of which a small triangular section is located in the 50 ft. front yard setback area, leaving a 457' setback from the front lot line facing Strohson Road. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an "desirable change in the character of the neighborhood or a detriment to nearby properties. Th proposed two-story addition is proposed at the northeast corner of the existing one-story dwelling, ith a setback of 457'from the front lot liner 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The addition has a greater front yard setback than the dwelling (32.6') or the garage (24.6'). To the south is an adjacent wetland area, and to the west' and north are front yards. The property is a corner lot with only one side yard. Page 2 December 4, 2003 Appl. No.5433—C. and B. Rodin 103-10-16 at Cutchogue 3. The relief requested is not substantial. The addition is more conforming in relation to the front setback than the 32.6' setback of the existing dwelling, and only a 36.17+- sq. ft. portion of the additionrequires relief under the code. 4. No evidence was submitted to indicate that the grantl,of the relief requested wolf have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. The addition is proposed at least 104 feet from the concrete block and stone seawall adjacent to tidal wetlands (East Creek). 5. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the,health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of th� above factors and appVying the balancing test under;New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Goehringer; and duly carried, to GRANT the variance as applied for, as shown on the site plan prepared by Robert I. Brown, R.A. date stamped by the ZBA September 9, 2003. This action does not authorize or condone any current o�future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. BROWN: You have the photos right there? 9 CHARWOMAN OLIVA: Kind of looks where the grass is growing up, it looks almost 10 three, four inches off the ground. This is for a variance concerning a proposed second-story 20 addition at less than 50 feet from the front property line at 70 Strohson Road, Cutchogue. 21 Would you like to comment on this, Miss Martin? 22 MS. MARTIN: Yes. Amy Martin and Robert Brown of H'airweather Brown Design, on 23 behalf of Charles and Barbara Rodin. This leis a properly, I think, 24 disapproved project as the existing structure is closer to the road than the proposed second 25 story. So the second story that is proposed is considered too close to the road on one November 20, 2003 27 1 2 little corner of the proposed second story by -- there's a 36 square foot area, triangle 3 of thesecond-storyproposed structure that is in nonconformance with the setback. However 4 it is land -- it is behind. the existing one-story structure that they're trying to add 5 to. MR. BROWN: It's stepped back. 6 CHAIRWOMAN OLIVA: It is a box here and then. It's rather confusing. 7 MS. MARTIN: What they want to do is just add a second story acrossfrom the 8 existing two-story: part just on the box but not as far to the road as this goes. 9 BOARD'. MEMBER TORTORA: Is the setback even going to connect with the garage? 10 MS. MARTIN: No. The setback even with this two-story part. And on the site 11 plan -- BOARDMEMBER TORTORA: This does 12 not look like -- there's something wrong. Here's the thing that threw me, the survey 13 shows the garage even with this. On the site plan the garage is, forward of this. 14 MS. MARTIN: This is the only nonconforming pare, this little thing 15 (indicating) . They're bringing the two-story out above this. The two-story structure is to 16 come across from the two-story existing, but it is well behind, the existing one-story 17 structure, and it"s actual, the nonconformity is a small triangle that's approximately 36 18 square feet and that's ahead of the 50 foot setback. 19 BOARD', MEMBER TORTORA: The problem here is on your survey. The survey shows that 20 the garage is even with the house level the survey shows that the garage is 24 . 6 feet from 21 Strohson Road, th4t' the house is 32.6, the site plan shows that the garage is, if you 22 look at it, what you submitted -- CHAIRWOMAN OLIVA: Garage is 23 slightly forward. For what it's worth, so long as the proposed addition is OK with the neighbors on the north and east it's OK with us.
