ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of the meeting is usually available to watch live during the meeting. It is the express intent of the Town to change and supersede such statutes to permit the same. LEGISLATIVE FINDING, PURPOSE AND INTENT The Town Board hereby finds and determines that in order to ensure the proper government, protection, order, conduct, safety, health and well-being of persons and property in the Town, particularly with respect to certain land developments and projects within the Town, it is necessary to obtain the reasonable and necessary counsel of legal, engineering, and other professionals in connection with engineering, scientific, land use planning, environmental, legal or other similar professional reviews/assessments/advice concerning the adequacy, procedural or substantive aspects of applications, including for site plan approvals, subdivision approvals, or for any other land use or development permits or approvals required by the Town Planning Board. Such counsel ensures that conformity with all applicable governmental laws, codes, rules, regulations and procedures, ensuring the proper and necessary government, protection, order, conduct, safety, health and well-being of persons and property in the Town of Southold. The cost of retaining such competent engineers, attorneys and other professional consultants should primarily be paid by those who initiate and seek to benefit from such developments, projects, rather than by general Town funds which are raised by assessments and/or general taxes paid by the taxpayers of the Town. Section 4. CODE AMENDMENTS Article XXIV Site Plan Approval 280-131 Review Procedure N. Review by independent technical consultants: (1) The Planning Board may determine that a referral to an independent technical consultant(s) is deemed necessary to complete their review of an application, with the technical consultants' fees to be reimbursed by the applicant. (3) Reimbursement Process: [a] Estimate of Costs: Upon determining the need for technical assistance, the Planning Board shall provide the applicant with an estimate of the costs for hiring the necessary consultants and experts. [b] Deposit: The applicant shall deposit the estimated amount with the Town Clerk prior to the commencement of the review. [c] An escrow account for the applicant shall be established with the Town Comptroller's office. Said escrow account shall be established prior to the Town's referral of the application to its consultant(s). Said escrow account shall be funded by the applicant in an amount to be determined by the Planning Board. The Planning Board may suspend its review of the application until an escrow account is established and funded. [d] Withdrawals from said escrow account may be made from time to time to reimburse the Planning Board for the cost of its consultant(s') professional review services actually incurred. Whenever the balance in such escrow account is reduced to 1/4 of its initial amount, the Planning Board shall notify the applicant; thereafter, the applicant shall deposit additional funds into such account so as to restore its balance to 1/2 of the initial deposit or to such sum as deemed necessary by the Planning Board. If such account is not replenished within 30 days after the applicant is notified in writing of the requirement for such additional deposit, the Planning Board may suspend its review of the application. [e] Adjustment: If the actual costs exceed the initial estimate, the applicant shall be responsible for the additional costs. Conversely, if the actual costs are less than the estimate, the remaining balance shall be refunded to the applicant. [f] The consultant(s) will work under the direction of the Town Planning Director. Copies of the consultant(s') qualifications, findings and reports will be provided to the applicant. (4) Failure to Reimburse Consultant Fees: [a] Application approvals shall not be issued unless the applicant is in compliance with this Chapter. [b] There may be an instance where Consultant Fees have been incurred by the Town but not yet billed to the applicant, or where fees have been billed but are not yet past due by the applicant, but where the Planning Board is ready for approval of an application. In such case, the Planning Board may condition approval on compliance with this Chapter prior to issuance of any building permit associated with such application. [c] In Addition to any other remedy herein or otherwise, should an applicant or owner fail to reimburse Consultant Fees in accordance with this Chapter, regardless as to whether the subject application was ultimately approved or otherwise, the Town may seek recovery thereof in a Court of competent jurisdiction. Section 5. APPLICATION This local law shall apply to ALL [new and pending] applications for site plans in the Town of Southold. Section 6. VALIDITY AND SEVERABILITY Should any word, section, clause, paragraph, sentence, part or provision of this local law be declared invalid by a Court of competent jurisdiction, such determination shall not affect the validity of any other part hereof. Section 7. REPEAL, AMENDMENT AND SUPERSESSION OF OTHER LAWS All other ordinances or local laws of the Town of Southold which are in conflict with the provisions of this local law are hereby superseded or repealed to the extent necessary to give this local law force and effect. The address is 3460 Elijahs Lane, Mattituck, New York. The property is situated on the east side of Elijahs Lane, south of the railroad tracks. The property is located within the Agricultural-Conservation (A-C) Zoning District; and WHEREAS, the proposed acquisition is for a development rights easement on part of the property, consisting of approximately 15.08± acres (subject to survey) of the 17.25± acre parcel. The 2.17±-acre Reserve Area will remain linked to, and be prohibited from being subdivided from, the area subject to the easement. The exact area of the acquisition is subject to a Town- provided survey acceptable to the Land Preservation Committee and the property owner; and WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase price is $76,023 (seventy-six thousand, twenty-three dollars) per buildable acre, estimated at $1,146,426.84 (one million, one hundred forty-six thousand, four hundred twenty-six dollars and eighty-four cents) for the 15.08±-acre easement. Purchase price will be adjusted at time of closing based on final survey acreage determination, plus acquisition costs; and WHEREAS, the property is listed on the Town's Community Preservation Project Plan List of Eligible Parcels as property that should be preserved due to its agricultural value; and WHEREAS, the purchase of the development rights on this property conforms with the provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands Preservation) of the Town Code, and WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront Consistency Review) of the Town Code and Local Waterfront Revitalization Program ("LWRP") and the LWRP Coordinator has recommended that this action is consistent with the LWRP; and WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition, and recommends that the Town Board acquire the development rights easement; and WHEREAS, the Town Board deems it in the best public interest that the Town of Southold purchase the development rights on this agricultural land; and, WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Purpose The purpose of this Local Law is to allow the Town of Southold to override the limit on the amount of real property taxes that may be levied by the Town of Southold, Suffolk County, New York pursuant to General Municipal Law 3-c and to allow the Town of Southold to adopt a town budget for town purposes and any other special or improvement districts governed by the town board for the fiscal year 2025 that requires a real property tax levy in excess of the "tax levy limit" as defined by General Municipal Law § 3-c. The Town of Southold has made significant efforts to reduce spending in an effort to avoid piercing the tax levy limit, however, in order to account for the increase in costs to provide town services and fund town operations for 2025, while at the same time maintaining the Town's high credit rating and general fund reserves, will likely require adoption of a budget in excess of the tax levy limit. Section 2. Authority This local law adopted pursuant General Municipal Law § 3-c (5)which expressly authorizes a local government's governing body to override the tax levy limit by the adoption of a local law approved by a vote of sixty percent(60%) of the Town Board. Section 3. Tax Levy Limit Override The Town Board of the Town of Southold, County of Suffolk, is hereby authorized to adopt a budget for the fiscal year 2025 that requires a real property tax levy in excess of the limit established by and set forth in General Municipal Law § 3-c.
