Tele 0hone SO 5-2660 MINUTES SOUTHOLD TOWN BOARD OF APPEALS April 25, 1963 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M., Thursday~ April 25, 1963 at the Town Office, Main Road, Southold, New York. There were present: Messrs. Robert W. Gillispie, Jr.~ Robert Bergen, Charles Grigonis~ and Fred Hulse, Jr. Absent: Mr. Serge Doyen, Jro pUBLIC HEARING: 7:30 P.M. (E.S.T.), upon application of Emilie Haunstetter, Mattituck Mote~ Bay Avenue, Mattituck, New York, for a special exception in accordance with the Zoning Ordinance, Article IV, Section 408, for permission to erect and maintain a directional sign on the property of Q. Caldwetl Hurdel, southeasterly corner of Main Road and Bay Avenue, Mattituck, New York. Property bounded north by Main Road~ east by Charles O. Terry, south by J. Klein, and west by Bay Avenue. Fee paid $5.00. Southold Town Board of Appeals -2- April 25, 1963 The Chairman opened the hearing by reading application for a special exception, legal notice of hearing~ affidavit attest- ing to its publication in the official newspaper and notice to the applicant. MRS. EMILIE HAUNSTE~TER~ Mattituck: I have a letter of permission from Mr. C. Hurdel Who owns the property where I wish to place the sign. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MRS. HAUNSTE~TER: I do. We had a directional sign last year but the sign had to be removed because a building was put up on the ~perty. THE CHAIRMAN: How far from the m~ain road is the motel? MR.. BERGEN: It is about three-quarters of a mile. TPiME CHAIRMAN: Is there anyone presentwho wishes to speak against this application? (There was no response.) After investigation and inspecticn the Board finds that the applicant has a motel located approximately three-quarters of a mile from the Main Road (Route 25) on Bay Avenue, Mattituck. In order to indicate the location of this motel it is important that a directional sign be placed at this location on the corner of Main Road (Route 25) and Bay, Avenue. The Board finds that the public convenience and welfare and justice will be s~rved and the legally established ~permitted use of neighborhood property and adjoining use districts ~ill not be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion of Mr. Gillispie~ seconded by Mr. Bergen, it was RESOLVED that~Emilie Haunstetter be granted permission to erect and maintain a directional sign on the property of Q. Caldwell Hurdel~ southeasterly corner of Main Road and Bay Avenue, Mattituck~ New York. The sign size is to be 4 ft. by 6 ft. with the words ,Mattituck-Motel~ Turn Here" and an arrow Southold Town Board of Appeals -3- April 25, 1963 indicating the direction. The lower edge of the sign is to be at least 3 feet from the ground level, upper edge no higher than 12 fro 6 in. and the sign is to be located at least 5 feet from any Property line. (E.S.T.), upon application of James Gallo, Pine Tree Road~ Cutcho~e, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 300, Subdivision 7, for permission to erect a private detached garage in the front yard area approximately 100 feet from the front-property line. Location of property: east side Pine Tree road, Cutchogue~ New York~ Lot No. 10 and S~ of 11 on map of Nassau Farms, bounded north by Robert and Dorothy Oram~ east bY Little Creek~ south by Anna Garrett, and west by Pine Tree Road. Fee paid $5.00° The Chairman opened the hearing by reading application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspaper and notice to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. WII~IAM BEEBE, Cutchogue: Like it is stated in the application, these lots have water front which is considered the back yard and the reason why we are placing it here is because we do not want i% in back of the house on the water side. There is only 20 ft. on the south side of the house and 30 ft. on the north side. THE CHAIRMAI~: Will you confirm the pictures of the property we have in the file? MR. B~EBE: Ye~, those are of the property. Southold Town Board of Appeals -4- April 25, 1963 (The Board discussed with Mr. Beebe the location of the proposed garage° The original application indicated a garage 19 ft. by 24 ft. and 3 feet from the northerly property line. When Mr. Beebe remeasured he found that the garage would now be 20 ft. by 25 ft. and the closest point of the garage would be 5 feet from the northerly property line, there being 30 feet between the northerly corner of the house and the northerly property line. The Board questioned as to whether the location of the garage would block the rear yard of the ad3oining neighbor but it was determined the lots run on an angle and it would not affect the neighbor and there are several other garages along this street that are similarly located.) TPHE CHAI~: Is there anyone present who wishes to speak against this application? (There was no response. ) After investigation and inspection the Board finds that the applicant desires to build a private detached garage 25 ft. by 20 ft. approximately 162 ft. from the front property line on his property on the east side Pine Tree Road, Cutchogue. This is a water front lot with the house located approximately 187 ft. from the front property line. Most of tt~s houses on this side of tbs street are located near the water and the Board feels that the proposed location of the garage would be both practical and adequate. Applicant proposes to locate the garage just in front of the front line of the house, with the close, point of the garage 5 feet from the northerly property line and furthest point 10 ft. from the northerly property line. The closest point of the northerly side of the house is 30 feet from the northerly property line. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be ~hared by all properties alike in the immediate vicinity of this property and in the same use district; the variance does observe the spirit of the Ordinance and will not change the character of the district. On motion of Mr. Gillispie~ seconded by Mr. Hulse, it was Southold Town Board of Appeals -5- April 25, 1963 RESOLVED that James Gallo, Pine Tree Road~ Cutchogue, New York, be granted permission to erect a private detached garage 20 ft. by 25 ft. approximately 162 feet from the front property line. The closest point of this garage will be 5 fto from the northerly property line and the furthem~ point 10 ft. from the northerly property line. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen~ Mr. Grigonis~ and Mr. Hulse. PUBLIC P~ING: Appeal No. 558 - 8:00 P.M. (E.S.T.)~ upon application of Mr~ and Mrs. Thomas L. Burns~ 20 Stuyvesant Oval, New ¥ork~City~ New York~ for a variance in accordance with the Zoning Ordinance, Article III~ Section 307, for permission to reduce side yard s~tback to 10 feet on the southerly side of lot located on the east side Hobart Road and west side Founders Path, $outhold, New York. Lot No. 39 on map of ~ounders Estates. Property bounded north by Gemma M. King~ east by Founders Path, south by Teresa E. Hildebrand and west by Hobart Road. Fee paid $5.00. They propose 10 ft. side yards on each si~So This is an 80 ft. lot and they cannot get the required 15 ft. side yard. Also~ there is a nice row of trees and they want to preserve them. There is village water there. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.~ Southold Town Board of Appeals -6- April 25~ 1963 After investigation and inspection the Board finds that this is an 80 ft. lot with frontage on two streets, Founders Path and Hobart Road. This lot contains approximately 16,000 sq. ft. of area. The applicant proposes to erect a dwelling 60 ft. wide, therefore he cannot maintain side yards of 10 ft. and 15 ft. as reqRired~ an~ he is asking for a reduction to 10 ft. on each side so that the house may be centered on the lot. Most of the lots in this section are undersized in frontage and area and with side yards of much less than 10 ft. On motion of Mr. Gillispie, seconded by Mr. Grigonis, it was RESOLVED that Mr. and Mrs° Thomas Lo Burns be granted permission to reduce side yards to 10 ft. on each side on their lot located on the east side Hobart-Road and west side Founders Path~ Southold, Lot No. 39 on map of ~ounders Estates. vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Grigonis~ and Mr. Hulse. Mr. Peter Senko, Sterling Road~ Cutchogue appeared before the Board for an informal discussion relative to the side yard setbac~ on an addition being erected by his neighbor Mortimer Conkling. Mr. Senko was advised that first a survey must be obtained by a licensed engineer before he p~rsues any complaint or further action. (E.D.S.T.)~ Thursday, May 9, 1963, Town Office, Main Road, Southold~ New York as time and place for hearing upon application of~William ~Wickham, a/c Stephen Hanrahan and Constance Hanrahan, the Ridge, Woodbury, New York~ for a special exception in accordance with the Zoning Ordinance, Article III~ Section 306~ for permission to reduce the front yard setback on a corner lot to 25 feet on o~ road~ namely Fleetwood Road, Location of property: northwest corner of East Road and Fleetwood Road, Cutchogue, New York, bounded north by C. Burberry, east by Fleetwood Road, south by East Road, and west by Raymond and Muriel Rignel. Location of property: northeast corner of~East Road and Betts Street, Cutchogue~ New York, bounded north by C. Burberry~ east by Stephen &~Constance Hanrahan, south by-East Road and west by Betts Street. Vote of the Board: Ayes:- Grigonis, and Mr. Hulse. On motion of Mr. Grigonis, Mr. Gillispie, Mr. Bergen, Mr. seconded by Mr. Hulse, it was RESOLVED that the Board of Appeals set 8:00 P.M. (E.D.S.T.)~ Thursday, May 9, 1963, Town Office, Main Road, ~uthold, New York as time and place for hearing upon application of Claude Southold Town Board of Appeals -8- April 25~ 1963 Davis and Marie Davis, Mattituck, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 307~ for permission to reduce the side yards on a 95 foot lot to 6 feet and 13.25 feet. Location of property: east side Olejule Lane, Mattituck, New York, bounded north by Thelma M. Van Deusen, east by Oleju!e Lane, south by L. Llewellyn, and west by proposed canal. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Grigon~s, and Mr. Hulse. On motion of Mr. Hulse, seconded by Mr. Gillispie~ it was RESOLVED that the Board of Appeals set 8:30 P.M. (E.D.S.T.)~ Thursday, May 9~ 1963~ Town Office, Main Road, Southold~ New York, as time and place for hearing upon application of George Ahlers~ a/c Catherine Ruschman~ for a special exception in accordance with the Zoning Ordinance, Article III, Section 306, for permission to°reduce front yard setback to 32 feet. Location of property: Lot No. 306 on map of Nassau Point Club Properties, Inc., Cutchogue, New York, bounded north by Edward Kelley, east by Arthur Schwarz, south by Old~0ve Road, and west by Haywaters Road. Voteof the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Grigonis~ and Mtn Hulse. It was FURTHER RESOLVED that legal notice of hearings be published in the official newspaper on Friday, May 3, 1963.
