Raynor of the Tide Group, Inc. for a waiver fi:om the provisions of Local Law #3 of 2©02 (and extensions thereof) entitled "Temporary Moratorium on the Processing, Review of, and making Decisions on applications for Major Subdivisions, Minor Subdix4sinns and Special Exception Use Permits and Site Plans containing Dwelling Unit(s) in the Town of Southold' pursuant to Section 6 "Appeal Procedures", to permit the Planning Board to consider an application for a major subdivision for the parcel of property known as SCTM# 1000-97-01-1; and WHEREAS the application involves the subdivision of a 29.1 acre parcel into 12 lots; and WHEREAS the Town Board has reviewed the file, conducted a public heating, and considered all pertinent documents; and WHEREAS the criteria that the applicant must meet is set forth in Section 6. (Appeal Procedure) of Local Law #3-2002 and the extensions of said Local Law, and the section states: Section 6. APPEAL PROCEDURES a. The Town Board shall have the authority to vary or waive the application of any provision of this Local Law, in its leg/sIafive discretion, upon frs determination, that such variance or wa/ver is requ/red to alleviate an extraordinary hardship affecting a parcel of property. To grant such request, the Town Board must find that a variance or waiver Mil not adversely affect the purpose of this local law, the health, safety or welfare of the To~vn of Sou/hold or any comprehensive plamning being undertaken in the Town. The Town Board shall take into account the existing land use in the immediate vicinky of the property and the impact of the variance or waiver on the water supply, agrianltural lands, open and recreational space, rural character, natural resources, and transportation infrastructure of the Town. The application must comply with all other applicable provisions of the Southold Town Code. WHEREAS the Town retained a "moratorium group" consisting of in-house and outside planners and attorneys who have developed a "Comprehensive Implementation Strategy" of the Comprehensive Plan of the Town of Southold, and certain comprehensive planning currently being undertaken includes, but is not limited to, 80% preservation of open space throughout the Town and a 60% reduction in density, clear establishment of the Hamlet Centers, and a possible Transfer of Development Rights component (a full description of the "action" is set forth in the SEQRA Resolution dated January 7, 2003 for the Southold Comprehensive Implementation Strategy which is incorporated by reference into 'dais decision); and WHEREAS, planning work is proceeding during the moratorium, which was extended January 6, 2004 for an additional 180 days.. The issues facing the Town of Southold and possible solutions to those issues are complex. Legislative solutions have not yet been agreed upon, and tlne Town continues to face significant development pressure; and WHEREAS the Town Board finds that there exists an extraordinary hardship affecting this property, in that there is a great need for more industrial zoned properly throughout the Town. This parcel has been recently rezoned to Light Industrial allowing development of industrial businesses to commence on this site satisfying a town-wide need for locations for these businesses; and WI-IEREAS the Town Board finds that the application is not in contrast with the extensive planning initiatives being undertaken by the Town, or the Comprehensive Plan of the Town of Soutkold; and WHEREAS the Town Board finds that this application will not adversely affect the purpose of the Local Law # 3 of 2002 and the extensions thereof; and W}IEREAS the Town Board of the Town of Southold finds that the application will not adversely affect the health, safety, or welfare of the Town of Southold; and WHEREAS the Town Board of the Town of Southold finds that the major subdivision application has a minimal impact on water supply, rural character, natural resources and transportation infrastructure of the Town; and WI~EREAS the Town Board of the Town of Southold finds that the application has no effect on agricultural lands and open and recreational space or rural character of the Town; and VCHEREAS based on the application, ail relevant documentation, the comments set forth at the public hearing on this matter, the comprehensive planning currently being undertaken by the Town, the above referenced facts, and the criteria set forth in Local Law No. 3 of 2002 and the extensions thereof, Section 6. COUNCILMAN WICKHAM: I have notice that /he legal has appeared as a notice on the Town Clerk's bulletin board and it has also appeared in the newspaper. There are several comments here from, the key comment is from our Planning Board, dated May 3, 2004. "In this memo, the Plarming Board will only address this request in the context of land use planning, consideration of any comment upon any other reasons are beyond the scope of the review. The parcel is located on the north east corner of Route 48 and Depot Lane. The proposed action involves the subdividing of a 29 acre parcel into 12 lots. Three of the lots lie within the LIO zoning district, the remainder in the LI district. The site was the subject of a subdivisiun application in. I990 under the name of North Fork Industrial Park, when the entire site was zoned Light Industrial Office. Conditional sketch approval was granted in 199i and conditional preliminary approval in 1992. Continued extensions of the preliminary approval were granted by the Planning Board until conditional final approval was granted in 1996. The approval was for 8 lots and listed eight conditions that had to be rs.et before the subdivision plat could May 4, 2004 2 Public Hearing - Tide Waiver be signed and filed. While the conditional final approval expired in 1997, the applicant resubmitted a request for final approval in 1998. Since that time, most of the conditions of approval have been met, save for two critical ones. The applicant opted to construct the roads and recharge basin instead of posting a performance bond. The roads and recharge basin have since been constructed and while some minor additional work is required, this condition is close to being met. Health Department approval had not been received due to the unavailability of access to public water but the Suffolk County Water Authority has recently indicated (verbally) that it could supply this subdivision fi:om its existing main along Route 48. In March of this year, the Town Board held a public hearing on rezor~mg a portion of the subject property from LIO to LI. The LI district permits lots of 40,000 square feet. The applicant is asking for a waiver of the moratorium in order to proceed with an amended subdivision application that would permit the prior subdivision application to move forward albeit with a modification to permit the creation of some lots that conform to the new LI zoning bulk area requirements. The Planning Board has reviewed the request for waiver and recommends that the Town Board approves the waiver request for the following reasons: 1. There is a need for more industrial zoned lots suitable for sale and development in the To~vn and 2. Although the proposed action proposes no permanent preservation of 75% of the parcel, the Town's proposed preservation goals were directed at preserving land from residential development." There follows fi~rther a recitation of the facts related to this and I don't have any further substantive comments in the file. SUPERVISOR HORTON: Thank you, Councilman Wickham. Are there comments fi:om the floor on regard to this public heating? Mr. Raynor. HENRY RAYNOR: Good evening, Mr. Supervisor. I will be very brief. We are here basically pursuant to Section 6 of the local law. SUPERVISOR HORTON: Your name and place of residence for the record. MR. RAYNOR: My name is Henry Raynor, representing Tide Group and our subdivision, which Mr. Wickham has explained is 29 acres zoned both LI and LIO. I believe you have maps on file with your Board as well as the Planrfing Board, we have fonvarded the fees. I just want to emphasize that going forward with this there is no residential use and that is really our overwhelming request for a waiver from the moratorium. Number two, this fulfills a need that has been demonstrated by the business community here before your Board and several others. To date, we have still not heard anything fi:om Suffolk County Water Authority with regard to water availability, at least nothing in writing or verbally and if the Board has any questions, I would be more than happy to entertain them. Thank you for your consideration. SUPERVISOR HORTON: Thank you. Are there other comments from the floor? Yes, Ms. Norden. MELANIE NORDEN: Melanie Norden, Greenport. Could you clarify for me what the application is actually for? Is it Lig~ht Industrial Office buildings, building? What is the application, actually? SUPERVISOR HORTON: The application is for a waiver... MS. NORDEN: I understand that. May 4, 2004 Public Hearing - Tide Waiver 3 SUPERVISOR HORTON: ...from the moratorium and the property is split zoned, I believe 10 acres or about 19 acres or 15 acres are zoned L][O and 15 acres or thereabouts are zoned L[. And the application before the Board is to allow them to proceed through the plarming process. MS. NORDEN: The planning process but planning what, actually?. What is the plan? SUPERVISOR HORTON: A commercial subdivision. MS. NORDEN: So, a commercial subdivision meaning a number of commercial buildings or what is the actually subdivision plan entail? SUPERVISOR HORTON: I don't know what the subdivision plan entails. I think it is actually to subdivide the lots, I don't know if there are building plans for those lots. JUST[CE EVANS: It is a waiver so they can just go forward. MS. NORDEN: No, I understand that but go forward with what, is my question? COLINCILMAN ROMANELLI: For a light industrial or light industrial office subdivision, for whatever the code allows. MS. NORDEN: Okay. And the reason for the waiver of the moratorimn is there a hardship in this case? VT. ny are they applying for the waiver? Under what conditions? COIYNCILMAN ROMANELL[: So they can move fop~vard. MS. NORDEN: No, I understand that. COUNCILMAN ROMANELLI: There is no residential, it is not a residential structure at ail. The reason for the moratorium in my mind, was mostly for residential subdivisions, that was our main concern of development of residential subdivision. Tlzis parcel of land, will be no residential subdivisions and why lock them up in it? MS. NORDEN: Gotcha. But the moratorium ~vas not specifically just for residential subdivisions, was it? COUNCILMAN ROMANELLI: No, it was for major and minor subdivisions but let's be honest, the intent of it was mainly for the residential subdivisions. We would be kidding ourselves if we say that wasn't the intent of the moratorium. SUPERVISOR HORTON: I do think that and I don't know if the application said that or not but I thir& there is a strong argument to be made for hardship. You have got two businesses in town, one is Matfituck Sanitation, that currently exists in a residential neighborhood and would like to move out of the residential neighborhood for obvious reasons up to that property. I don't know if they are owners or lessees, but they are looking at that area, looking at that property to relocate the bulk of their operation. And also there is an excavating company that is also looking to operate on that property and is May 4, 2004 4 Public Hearing - Tide Waiver currently not able to operate in their past property and I believe they are partners in th/s. Is Artco a partner in this? Well, okay, they are looking to operate their business there as well and can't operate as it stands. I think there is certainly a hardship argument that could be strongly made. MS. NORDEN: Let me just ask you, the Tide Group Inc., is that the owner of record of the property? SUPERVISOR HORTON: Is that correct? Tide Group Inc.? Yes. MS. NORDEN: Just the group itself then? Because it would be helpful to know if there were other private owners of this property and if there names could be included in the pnblic record. SUPERVISOR HORTON: Mr. Raynor, would you care to enter those into the public record? MR. RAYNOR: No probiem at ali, Mr. and Mrs. James Comiskey, Mr. and Mrs. John DiVello, Mr. and Mrs~ Henry Raynor. That is it. MS. NORDEN: Okay, great. Thank you. SUPERVISOR HORTON: Are there other comments from the floor on this? Yes, Mr. Nickles. JOHN NICKLES, JR.: Good afternoon, John Nickles, Jr. Southold. I am a littte surprised, actually, that this did fall under the moratorium because I thought that I had read it pretty clearly. But if in fact it is just supposed to catch ali major and minor subdivisions than I see why but as John said, the intent absoiutely was to look at the R-80 and the AC zones for residential use and the commercial zones ~ thought, were only going to be looked at if it was going to be some type of residential use in that subdivision if that was what the intent was for. So, anyway, I think that the time has come to go forward with this particular piece of property. It has been sitting around in limbo for a long time with different regulations that have gotten in the way, lack of public water and I think thai certainly the Town has the authority and should vote to approve exempting this application. Thank you. SUPERVISOR HORTON: Thank you, Mr. Nicldes. Are there other comments? Yes, Mr. Skabry. TOM SKABRY: Tom Skabry. ~ just have one question for the Town Board, if they can answer for me. By making a special exception of the moratorium for plmming for a business, does this make the moratorium as a whole exposed for legal battles from people who want to plan for residential developers? SU~PERV~SOR HOP, TON: No, this process is to prevent or safeguard the Town and Town Board from those types of challenges. That the Town Board has the authority, the legal authority is built into the moratorium language to make waivers fi:om the moratorium. MR. SKA~RY: All right. Thank you. I just want to make it a point that I am not here, even though am in a CSEA shirt, I am not here to promote business or residential -totally separate. SUPERVISOR HORTON: Understood. Are there other coroanents from the floor? Yes, Mr. Wills. May 4, 2004 5 Public Hearing - Tide Waiver FRANK WELLS: Frank Wills, Mattituck. I have a question. If you move across the other side of Depot Lane, to what I call a monstrosity of a building, are there any roles or regulations that we will not all of a sudden have a~other one of these monster buildings coming up on the other side of Depot Lane? COUNCELMAN ROMANELLt: What other side? MR. WILLS: The Gray center. SUPERVISOR HORTON: The what center? MR. WILLS: I believe it was built by a man named Gray. SUPERVISOR HORTON: On the comer of Cox. COUNCILMAN W[CKHAM: We now have an Architectural Review Panel that we didn't have at that time that will review all commercial buildings and ][ think we have a strong site plan capability in the Plamning Department that will, I am not sure if guarantee is the right word, but will give me assurance that we will have, that whatever buildings are put up, will fit the character of the Town. MR. WILLS: I mean, the other one doesn't fit in this commmfity but there it is. So the reason that am bringing it up is, let's not have another one. AIthough the proposed action proposes no permanent preservation of 75% of the parcel, the Town's proposed preservation goals were directed at preserving land from residential development. Facts related to the property follow: Land Use - The property is bordered by farmed land to the north and County Route 48 to the south. The eastern border of the property abuts the Town's closed Sanitary Landfill and its composting operation. The western border of the property is Depot Lane and the Goodwin property. Residential development exists on the Goodwin property and in the Church Lane neighborhood approximately 415 feet to the east, The subject parcel is split-zoned as LIO and LI. The L[O district requires a minimum area of 120,000 square feet per lot. The LI district requires a minimum area of 40,000 square feet per lot. The properties to the north and east are zoned LIO and LI. Transportation ~nfras~ruc~ure - The proposed action is located on County Route 48 and Depot Lane. The original proposed subdivision provided for access onto Depot Lane. Natura~ Resources - The site has already been partially improved with road and drainage facilities. The prior assessment of the original subdivision pursuant to the State Environmental Quality Review Act Section Article 8, Part 617 resulted in a Negative Declaration. Cu~tura~ and Archeo~ogica~ Resources - The occurrence of significant cultural or archeologica~ resources is unknown, Water Supply - The SCWA has indicated that water supply can be extended to this property via the CR 48 main, Sanitary disposal within the proposed subdivision is expected to be accomplished by on-site underground sewage leaching systems. Rura~ Character- The proposed action would result in the creation of twelve new bui~dable Iots for industrial uses. The scenic vista is proposed to be protected through a heavily planted landscaping barrier along CR 48 and Depot Lane. Agricu~tura~ Lands - Historically the parcel was in agriculture and construction activities have already removed some of the soils. Therefore, this proposal has already resulted in a permanent loss of prime agricultural soils. Open Space and Recreation Space -Due to the zoning designation of the parcel, the potential for recreational use is low, In conclusion, it is the Planning Board's finding that the proposed proiect fully supports the planning objectives of the Town of Southold to consolidate industrial uses in central locations with good access to main east-west transportation arteries; and to preserve the Rural, Cultural, Commercial and Historical Character of the HamJets and surrounding areas by siting industrial uses away from those centers.
