The 6 purpose of tonight ' s first public 7 hearing is to consider certain changes 8 to Chapter 75 of the Town ' s Code 9 entitled Alarm Systems . The proposed 10 change to be considered by the Board is 11 to establish that all fees shall be set 12 from time to time by resolution of the 13 Town Board . The proposal also defines 14 the reach of the chapter to all 15 jurisdictions . To all areas within the 16 jurisdiction of Southold Town Police 17 Department . In the folder here , I have 18 a copy of the Affidavit of Publication 19 of the legal notice in the Suffolk 20 Times , along with a copy of the invoice 21 for a payment of that . I have a copy of 22 the legal notice itself, setting the 23 public hearing . I have a copy of a 16 letter from the Town Planning Board 17 here , Supporting this amendment . I have 18 a letter to the LWRP Coordinator . Okay . 19 So I have a letter to the LWRP 20 Coordinator asking whether this is in 21 conformance with it , with the LWRP . And 22 as of this morning, we had not received 23 the letter with his assessment back . I 24 have a notice that were sent to adjacent 25 jurisdictions . An affidavit of OCTOBER 8, 2024 REGULAR MEETING 11 1 publication of the legal notice in the 2 Suffolk Times . I have a copy of the 3 legal notice itself, advertising the 4 public hearing . I have an affidavit of 5 posted signed by our Deputy Town Clerk, 6 Lynda Rudder, affirming that it was 7 posted on the Town Clerk ' s Bulletin 8 Board in the back . I have a copy of the 9 resolution adopted by this Town Board 10 setting tonight ' s public hearing . And I 11 have just been provided with a LWRP memo 12 stating that this is consistent with the 13 LWRP . So it appears that the folder is 14 in order . 15 SUPERVISOR AL KRUPSKI JR . : Thank 16 you . Mr . DeChance, are all the public 17 notices and postings in order? 18 TOWN ATTORNEY P . DECHANCE : The 19 public notices are in order, Mr . 20 Supervisor . The Board should be aware 21 that the matter needs to be held open 22 for SEQRA coordination, review, and 23 adoption . 24 SUPERVISOR AL KRUPSKI JR . : All 25 right . Thank you . We will hold the OCTOBER 8, 2024 REGULAR MEETING 12 1 public hearing, though? 2 TOWN ATTORNEY P . DECHANCE : Yes . 3 SUPERVISOR AL KRUPSKI JR . : There 4 is no one with a hand up on Zoom. Would 5 anyone here like to comment on the 6 proposed change? 7 ROBERT DUNN : On the use 8 regulations for -- Robert Dunn, Peconic . 9 COUNCILMAN BRIAN MEALY : Mr . Dunn, 10 can you just -- we know who you are 11 you ' re the seventh board member . But 12 could you just announce yourself and 13 your address -- 14 ROBERT DUNN : I just did . I 15 realized I didn ' t and then I did . 16 COUNCILMAN BRIAN MEALY : Thank you . 17 ROBERT DUNN : The pet care facility 18 at the -- in the B District, you think 19 we might -- you might want to put some 20 notice there about outdoor use? A lot 21 of these places have daytime kennels on 22 the outside . And whether you ' re in a B 23 District or not, there are people living 24 there . And should they have to listen 25 to barking all day? So there needs to OCTOBER 8, 2024 REGULAR MEETING 13 1 be some finessing there, I would think, 2 for noise . I mean, I think it ' s 3 appropriate to allow them in that 4 district . I ' m not debating that . I ' m 5 not debating anything you do here, other 6 than just this one thing that I think 7 may have just been overlooked . What do 8 you do if you have eight dogs in the 9 yard next to you? You have to live in a 10 Business District in an apartment 11 upstairs from those eight dogs . And 12 you ' ve got a baby, who sleeps in the 13 daytime , with howling dogs behind him? 14 I don ' t know about that . 15 COUNCILMAN GREG DOROSKI : We did 16 discuss this when we were talking about 17 it in Code Committee, and there is a 18 line in the definition, pet care 19 facility . The use of outdoor areas for 20 services provided must be supervised to 21 prevent the occurrence of objectionable 22 noise or other nuisances beyond the 23 boundaries of the site , which is 24 located . All household pets must be 25 controlled at all time . So on and so OCTOBER 8, 2024 REGULAR MEETING 14 1 forth . It talks about waste disposal . 2 ROBERT DUNN : I don ' t doubt waste 3 disposal . I don ' t doubt -- the 4 objectionable . I don ' t doubt the 5 professionalism of anybody who goes into 6 any of these business . I ' m not 7 questioning that . I ' m just questioning 8 the reality, the harsh reality of having 9 ten dogs next to your bedroom window 10 outside . 11 COUNCILMAN GREG DOROSKI : Do you 12 think it ' s not enough to say the 13 occurrence of objectionable noise? 14 ROBERT DUNN : You ' re going to go 15 object to a dog? 16 COUNCILMAN GREG DOROSKI : Well , I 17 think it sets it up that the neighbor 18 can complain . And if there ' s an 19 objectionable noise coming off the site, 20 then code violations -- 21 ROBERT DUNN : So if you guys think 22 that ' s not . 23 COUNCILMAN GREG DOROSKI : We 24 thought it was pretty clear . There were 25 no decibel requirements . It ' s OCTOBER 8, 2024 REGULAR MEETING 15 1 basically, at least in my reading, no 2 noise is allowed to permeate the 3 boundaries of the site . So any noise 4 that ' s objectionable is a no-no . Which 5 I think in some sense is better than our 6 current noise code, which talks about 7 decibels and it ' s kind of open for 8 interpretation . 9 ROBERT DUNN : I hear what you ' re 10 saying, but it ' s just dogs are not 11 controllable . 12 COUNCILMAN GREG DOROSKI : Well , I 13 think it ' s the responsibility of the pet 14 care facility manager . If they want to 15 have the dogs outside, they need to be 16 controlled . If not , violations will be 17 issued . It ' s in violation of the code 18 as it ' s written . It may not be a 19 reality, but I think, you know, we ' ve 20 seen other pet care facilities . You 21 know in other towns where it ' s worked . 22 Currently in our town, it ' s allowed in 23 the LB District . And we really haven ' t 24 seen any issues there . I think as the 25 Town Board was discussing it , this came OCTOBER 8, 2024 REGULAR MEETING 16 1 in as a request in a in a B zone . It 2 made sense if it was allowed in the LB 3 Zone , which is actually more closely 4 located with residential property . 5 ROBERT DUNN : I ' m not debating that 6 either . I agree with you . I agree with 7 you . I just see a problem coming -- a 8 potential problem coming up . And if you 9 happen to live next to that or to that, 10 it could be a -- 11 SUPERVISOR AL KRUPSKI JR . : I 12 understand that . These are all subject 13 to site plan approval . So they will be 14 reviewed . 15 COUNCILMAN GREG DOROSKI : That ' s 16 another good point . 17 SUPERVISOR AL KRUPSKI JR . : You 18 can ' t just open up a business tomorrow . 19 So this is subject to Planning Board 20 review for a site plan . So that noise 21 outdoor area for storage pets would be 22 considered as how it ' s going to impact 23 the neighbors . Certainly visually and 24 noise-wise . 25 SUPERVISOR AL KRUPSKI JR . : That OCTOBER 8, 2024 REGULAR MEETING 17 1 would require public noticing -- 2 ROBERT DUNN : Your wisdom on 3 somebody else down the road . I agree , I 4 would -- 5 SUPERVISOR AL KRUPSKI JR . : It 6 would be public notice , too . So the 7 neighbors would be publicly noticed that 8 this is being proposed next to them. So 9 they would have an opportunity to go and 10 say it ' s just going to be screened . How 11 is it going to be controlled? Hours of 12 operation, all those things would have 13 to be considered . 14 ROBERT DUNN : Okay . It ' s an issue 15 because I -- 16 SUPERVISOR AL KRUPSKI JR . : So 17 noted . And we have to keep this hearing 18 open also . So this will be . 19 COUNCILWOMAN JILL DOHERTY : No, we 20 don ' t anymore because we have the 21 response -- 22 COUNCILMAN GREG DOROSKI : We do , we 23 don ' t have the SEQRA determination . We 24 have LWRP . 25 ROBERT DUNN : I mean, it all sounds OCTOBER 8, 2024 REGULAR MEETING 18 1 logic to me, to you . Next door to 2 you -- to live next door . Is anyone 5 here would like to adjust the Board on 6 any issue? 7 KAREN MCLENNAN : Thank you very 8 much for giving me an opportunity to 9 speak . My name is Karen McLennan . I ' m 10 a doctor of audiology . I reside at 11 52325 Unit 16 , County Road 48 . I ' m here 12 representing the 40 some odd tenants 13 that live at the North Fork Beach 14 condos . My father-in-law purchased the 15 unit -- two units originally, and now we 16 are the current owners . So we ' ve been 17 out here for 20 plus years and have 18 loved every minute of it . It ' s a 19 precious town . So we are concerned 20 about the coastal erosion . We are 21 concerned about the road, with severe 22 weather threats potentially occurring 23 more frequently . We are concerned about 24 the state of our beach, the state of the 25 road, the condition of the road OCTOBER 8, 2024 REGULAR MEETING 20 1 deteriorating . We have a significant 2 amount of erosion currently at our beach 3 front, and which only leads to more 4 concern for the homes in the community . 5 So as a representative of the condo, 6 we ' re here to let you know that we ' d 7 like to work together . If there ' s 8 anything we can do to -- to move the -- 9 the -- preserving the beach, the 10 roadway, we ' re more than happy to 11 contribute . And we welcome thoughts on 12 how to continue to protect our coastal 13 areas and the community at large . And 14 we ' re here to work with you . Thank you 15 very much . 16 SUPERVISOR AL KRUPSKI JR . : But 17 just to be clear, you ' re just west of 18 Town Beach? 19 KAREN MCLENNAN : Yes . 20 SUPERVISOR AL KRUPSKI JR . : Okay . 21 So yes , we are well aware of that 22 situation there . In fact , Councilwoman 23 Smith and I took a look at it one day . 24 And I ' ve also been out there separately 25 to look at it . We had many discussions OCTOBER 8, 2024 REGULAR MEETING 21 1 with the Town Highway Department and the 2 Town Engineer . We are currently getting 3 it surveyed, so we know exactly what we 4 have to work with there . And then 5 we ' ll -- I really welcome your outreach . 6 So we can work together there and try 7 to . 8 KAREN MCLENNAN : Thank you . 9 SUPERVISOR AL KRUPSKI JR . : And 10 we ' re addressing this all over town, 11 where the coastal erosion processes , 12 which have been active in the past , are 13 now really rating because of the sea 14 level rise . So we ' re taking that very 15 seriously there . 16 KAREN MCLENNAN : Great . Thank you 17 very much . Either myself or other 18 subcommittees focused on this particular 19 aspect of our condo will be attending 20 future meetings and they also welcome 21 the opportunity to work with you . I 7 live in Cutchogue . Before I begin my 8 business before the Board today, which 9 is in climate change, two observations . 10 I love democracy . As Winston Churchill 11 said, "Democracy is the worst form of 12 government except for all of the 13 others . " Second observation I ' d like to 14 make is Al Krupski , I ' m loving your tie . 15 Thank you . 16 SUPERVISOR AL KRUPSKI JR . : Thank 17 you . Glad you came tonight . 18 JOHN GIBBONS : I ' m here today to 19 speak to you, not just for myself, but 20 on behalf of the membership of the 21 Greenport and Southold American 22 Legion -- the membership of the 23 Greenport and Southold American Legion 24 posts , Mattituck Post is , I believe, no 25 longer functioning . So they ' re not OCTOBER 8, 2024 REGULAR MEETING 23 1 involved in this . We ' re here asking 2 that the Town Board consider honoring a 3 man who served the Town with 4 distinction, and served the country with 5 incredible valor . And I ' m talking about 6 George Sullivan, the long-term Receiver 7 of Taxes . I have several documents that 8 I ' d like to read into the public record . 9 I have copies that I ' ll give to all of 10 you, but I think I ' d rather read it 11 first and let you actually just listen 12 to it . The first is a letter to Al 13 Krupski , the Supervisor of the Town . 14 It ' s signed by myself as a veteran, Jack 15 Martellotta, as the commander of the 16 Greenport American Legion Post, and 17 David DeFriest, the commander of the 18 Southold American Legion Post . "Dear 19 Supervisor Kruspski . Traditionally, 20 Southold Town has honored individuals 21 who have provided distinguished service 22 to the Town by naming various town owned 23 properties in their honor . This ensures 24 that their contributions and service to 25 the town will be honored in perpetuity . OCTOBER 8, 2024 REGULAR MEETING 24 1 Lieutenant George R . Sullivan has 2 provided distinguished service to the 3 Southold Town as a longtime Receiver of 4 Taxes . Lieutenant Sullivan is also a 5 genuine American hero who served 6 gallantly in the United States Marine 7 Corps during the Vietnam conflict . His 8 heroism in combat earned him the Navy 9 Cross , the nation ' s second highest medal 10 for gallantry in combat . We asked the 11 Town Board to name a Town Park as a 12 lasting tribute to the service, 13 sacrifice, and gallantry, both of 14 Lieutenant Sullivan and all Southold 15 Town veterans . The following documents 16 are provided in support of this request . 17 One, the United States Department of 18 Defense military awards for valor, 19 descriptions of medals to the Navy 20 Cross ; second, the citation for awarding 21 the Navy Cross to Lieutenant George 22 Sullivan; third, a resolution proposal 23 for renaming a park in honor of 24 Lieutenant George R . Sullivan, and all 25 military veterans . The membership of OCTOBER 8, 2024 REGULAR MEETING 25 1 the Southold and Greenport American 2 Legion posts unanimously endorse this 3 resolution . " And I can say with 4 confidence that every veteran would 5 endorse what we are asking here today . 6 Every veteran from Southold Town . The 7 document that I ' m going to read now is 8 the U . S . Department of Defense Military 9 Awards for Valor, description of medals . 10 And Navy Cross is the second highest 11 medal decoration that may be awarded to 12 a member of the United States Navy, the 13 U . S . Marine Corps , and members of the 14 Coast Guard when operating under the 15 authority of the Department of the Navy . 16 It is awarded for extraordinary heroism, 17 while engaged in action against an enemy 18 of the United States , while engaged in 19 military operations involving conflict 20 with an opposing foreign force, or while 21 serving with friendly foreign forces 22 engaged in armed conflict against an 23 opposing armed force in which the United 24 States is not a belligerent party . 25 Actions that merit the Navy Cross must OCTOBER 8, 2024 REGULAR MEETING 26 1 be of such a high degree that they are 2 above those required for all other U . S . 3 combat decorations , but do not merit the 4 award of the Medal of Honor . The Navy 5 Cross is equivalent to the Distinguished 6 Service Cross , in the Army, and the Air 7 Force Cross and the Air Force . Just so 8 you understand, there are four awards 9 for combat valor . The lowest is a 10 Bronze Star, and when I say lowest , it ' s 11 still a significant achievement to be 12 awarded one of these valor awards . So 13 there ' s the Bronze Star, the Silver 14 Star, the Navy Cross , and the Medal of 15 Honor . I don ' t think -- I shouldn ' t say 16 this , but I ' m not sure that Southold has 17 ever had anyone receive the Medal of 18 Honor or even the Navy Cross . Now a 19 historian might prove me wrong, but it ' s 20 a significant award . What I ' m going to 21 read now is the citation for the award 22 to George R . Sullivan . There ' s a term 23 in there . It ' s a military term, 24 deflated area . It means an area that ' s 25 because of the terrain, either natural OCTOBER 8, 2024 REGULAR MEETING 27 1 or man-made, provides relative safety 2 from enemy fire . This is the citation 3 for the award presented to George 4 Sullivan . The President of the United 5 States of America takes pleasure in 6 presenting the Navy Cross to First 7 Lieutenant George R . Sullivan, the 8 United States Marine Corps Reserve , for 9 extraordinary heroism while serving as a 10 platoon commander with Company L 3rd 11 Battalion, 4th Marines , 3rd Marine 12 Division reinforced -- Fleet Marine 13 Force, in the Republic of Vietnam on 14 17th, March, 1967 during Operation 15 Prairie II . While in a search and clear 16 mission in the vicinity of Dong Ha and 17 Cuong Trie Province , 2nd Lieutenant 18 Sullivan ' s platoon was approaching a 19 suspected Viet Cong controlled village 20 when it came under tense small arms and 21 automatic weapons fire from a well 22 concealed enemy force of estimated 23 battalion size . After skillfully 24 employing his men in order to bring a 25 heavy volume of fire on the enemy OCTOBER 8, 2024 REGULAR MEETING 28 1 positions , 2nd Lieutenant Sullivan 2 observed an enemy automatic weapon to 3 his front and realizing the necessity of 4 neutralizing the well fortified 5 position, he courageously moved across 6 open fire swept terrain, to within 10 7 meters of the Viet Cong emplacement and 8 silenced the enemy weapon with a 9 grenade . After he had directed a 10 machine gun team into a forward position 11 to deliver suppressive fire at the 12 enemy, he observed that the team' s 13 weapon had malfunctioned . 14 Unhesitatingly, he moved through 15 concentrated enemy fire to the team' s 16 location and cleared the weapon . 17 Meanwhile, another machine gun team had 18 begun moving with their weapon forward, 19 but both Marines were wounded and fell 20 in an exposed area to enemy fire . 21 Courageously, 2nd Lieutenant Sullivan 22 again disregarded the heavy enemy fire 23 and unmindful of his own personal 24 safety, moved to their position and 25 carried them to a deflated area, OCTOBER 8, 2024 REGULAR MEETING 29 1 undoubtedly saving their lives . Later 2 while moving among his men encouraging 3 them and directing their fire, he was 4 painfully wounded in his shoulder, arm, 5 and both legs . Although unable to move, 6 he continued to direct the actions of 7 his platoon while requesting air 8 support , medical evacuation for the 9 wounded, and a resupply of ammunition . 10 And only after reinforcements had 11 arrived under the cover of darkness did 12 he allow himself to be evacuated by his 13 intrepid fighting spirit, selfless 14 courage , bold initiative, and unswerving 15 devotion to duty at great personal risk, 16 Second Lieutenant Sullivan reflected a 17 great credit upon himself and upheld the 18 highest traditions of the Marine Corps 19 and the United States Naval Service . 20 What we are asking is that Southold Town 21 renamed a park in honor of Lieutenant 22 George Sullivan, but also knowing 23 George ' s modesty, we ' re asking that that 24 park be named not only in his honor, but 25 in honor of all Southold Town veterans . OCTOBER 8, 2024 REGULAR MEETING 30 1 The resolution proposal , and, of course, 2 this is just for your consideration, we, 3 the members of the Southold Greenport 4 American Legion posts , suggest that a 5 town property be named in honor of 6 Lieutenant George R . Sullivan and all 7 Southold Town veterans who have 8 honorably served this country . We hope 9 you agree that, much like Veterans Park 10 on Peconic Bay and Mattituck, a tribute 11 to a true American hero, and all 12 veterans should be a place of high 13 visibility and significance . We suggest 14 that the following Southold Town parks 15 are suitable for this honor . Silver 16 Smiths Corner Park, Young ' s Avenue Park, 17 the Southold Town Beach . And I helped him out, and now I 5 am chair of that running that golf 6 outing . And we call it the changed to 7 the George Sullivan golf outing . Tom 21 Stevenson . Orient . I almost said 22 Southold . I was lucky enough to know 23 George Sullivan, when I was in my 24 younger days here in Southold . And his 25 humility, just unbelievable . But how do OCTOBER 8, 2024 REGULAR MEETING 34 1 you stay a warm person like that still 2 after what he went through, Sorry, but a 3 special guy . I love the idea of town, 4 Town Beach . Plus the history there . I 5 don ' t know if you know the revolutionary 6 war history there . Meeks Raid, which is 7 what I consider the origin of the U . S . 8 Special Forces . You know, let ' s look it 9 up, Meeks Raid, unbelievable stuff . 10 That ' s not why I came here, but a third 11 way to tie that in, and Bill Ruland, 12 also a special guy, who ' s not with us , 13 but I had suggested to him, why not look 14 at an artificial reef off of Town Beach . 15 And since the Navy is retiring, they 16 retired three constellation class ships 17 just this month . Can they live fire, 18 sink when they ' re? No . But, I mean, a 19 700 foot ship, you know, blocking -- I 20 think you need something offshore there, 21 honestly . I don ' t know how else you ' re 22 going to stop those . It ' s way too much 23 wave . But nothing like what they ' re 24 going to get in Florida . Anyway, that ' s 25 not why I came in . And I got a zip off OCTOBER 8, 2024 REGULAR MEETING 35 1 to school board in a second here . But 2 the committee -- I was listening to the 3 work session, the committee discussion 4 was great . The handbook, I think that ' s 5 well , definitely needed . I ' ve been 6 serving for more than 10 years on the AG 7 Committee . Some years as chair, and I 8 think it would be helpful . Also being 9 on a School Board, the trainings , you go 10 through the ethics and financial ' s , 11 sexual harassment . Well , Robert ' s Rules 12 and parliamentary procedure, those are 13 not things that are going to come 14 necessarily to a volunteer that just 15 happens to get on a committee . So it 16 would also help the Town Board, you 17 know, without creating another committee 18 to study the committees and the 19 commissions . What -- What are they? 20 Task forces . Yeah, don ' t do that ' cause 21 we all know when you can ' t solve a 22 problem, you create a committee . But 23 the -- what else do I have? Sorry . I ' m 24 trying not to um too much . Oh, 25 Executive Session trainings , you know, OCTOBER 8, 2024 REGULAR MEETING 36 1 like , I mean, I know that like AG 2 Committee, we don ' t violate it because I 3 know what is and isn ' t , you know, so you 4 gotta like , time out, go back in a 5 special -- you know, regular session 6 because you can ' t, you know, let ' s not 7 just talk about anything we want to talk 8 about now because no one ' s listening and 9 the Zoom' s off . But I have noticed like 10 little inconsistency with, like -- which 11 committees have Zoom videos up or have 12 Zoom, which ones don ' t . Which ones have 13 minutes up, whether the minutes are 14 detailed, whether they ' re you know 15 because minutes aren ' t a transcript, but 16 now with technology, you know you can 17 just take your video and transcribe the 18 whole thing like this is word-for-word . 19 So I ' m sorry for ever, you know in 50 20 years read this . But I love that that 21 it ' s sort of in there forever because , 22 you know, I love democracy too . I ' m 23 willing to fight for it . The Zoning 24 Update Committee has no videos . There ' s 25 the minutes are very not detailed . The OCTOBER 8, 2024 REGULAR MEETING 37 1 new Water Committee , there ' s no presence 2 on the Town Website . There ' s no 3 minutes . I don ' t know what they ' re 4 doing . I can ' t get to everything . And 5 I ' m not gonna keep going here . Let ' s 6 all get out before it ' s dark . Yeah, I 7 think that was pretty much the gist of 8 it . Oh like attendance, you know, I 9 know the AG Committee, Chapter 71 , 10 established the AG Committee . So we ' re 11 like in the code , but like an ad hoc 12 committee wouldn ' t have all the you 13 know, like if our members don ' t make 14 half the meetings , the committee votes 15 to remove . Maybe votes to remove, but 16 the Town Board appoints . We appoint the 17 chair, but should you appoint the chair? 18 I don ' t know . Should there be a 19 co-chair? If the chair can ' t be there, 20 sometimes . Anyway, a lot of things 21 there, but I think it ' s great to dig in 22 there because it ' s really important, 23 even though not as important as , you 24 know, George Sullivan . But that ' s where 25 I ' m at . The Comp Plan, also , I ' m not OCTOBER 8, 2024 REGULAR MEETING 38 1 going to get too deep into that , but the 2 Comp plan sort of guides what the 3 committee should be doing, I think . So 4 that ' s the real decision maker . That 5 even outlasts the Town Board as the 6 makeups change . And the deliberations , 7 the public has a right to listen to the 8 deliberations of the public officials . 9 So that ' s why it ' s so important and I ' m 10 out .
