Your letter appears to indicate that although the pool is clearly located outside Chapter 275 jurisdiction, a Town wetlands permit would be required for the entire project due to the pool fence's immediate proximity to the 100-foot wetland setback and the presumption that construction related disturbance would therefore occur within 100 feet of the wetlands boundary. Therefore,to avoid the potential for any construction related disturbance occurring within the wetlands regulated area and thus the need for a Town wetlands permit,the project has been modified to a) replace the previously proposed 16' x 32' pool located 110 feet from wetlands with a 18' x 25' pool located 112 feet from wetlands; and b)relocate the proposed pool enclosure fencing 5 feet farther from wetlands to a 106-foot setback, as depicted on the survey/site plan prepared by Nathan Taft Corwin III Land Surveyor, last dated November 4,2024,two (2)copies of which are enclosed herewith.
