Dear Mr. Fischetti:
In response to your on site meeting with myself and Jamie Richter of December 20tn
last, I researched property issues surrounding this location and reviewed your proposal
with the Board of Town Trustees on our January 11, 2012 field surveys at the above
referenced location.
While a serious drainage problem exists for the area and has been witnessed by.
several members of the Trustee Office over the years, a review of the facts concerning
your proposal make it problematic for the Board to forward your proposal at this time:
1) The Land Preservation Committee which enables public purchase of environmentally
sensitive lands through the use of 1/4% Community Preservation Funds, is principally
interested in very sizeable properties with significant ecological benefit to the
community such.as preserving rare plant and animal communities, protecting ground
water and providing public access on a town-wide scale.
2) The location in question would complicate and make acquisition very costly for the
Town as it is actually two single and separate.tax map parcels, which, on face value, do
not seem to meet any threshold for preservation as currently practiced by the Town:
3) The recently negotiated drainage easement adjacent to the Battaglia property may be
sufficient.to meet Town drainage requirements for the area.
4) Drainage improvements, such as may be created from the above easement, are now
being prioritized on an as needed, funding available basis with prioritization largely
coming under the Town's MS4 program.
5) Trustee involvement at this time in what will likely be a preservation & drainage "loss
leader" might divert attention from pending projects.
6) Untimely inquiries concerning privately held parcels, when local government is not in
a position to act, may have unintended consequences and actually deter future
acquisition.
I am sorry that due to the forgoing, the Trustees are not in a position to forward this
proposal to the Town Board/Land Preservation Committee at this time. You may wish to
contact non-governmental land preservation organizations in an effort to see what
assistance or advice they might have.
