POLICY: At the beginning of scheduled Town Board meetings, the attending public is
encouraged to briefly address the Town Board relating to agenda resolutions prior to their
enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.
The video of the meeting is usually available to watch live during the meeting. Minutes with
adopted resolutions are available 1-2 days after the meeting. A full copy of the minutes, agenda
and meeting video can be viewed by going to the official Town of Southold website:

(1) Move pointer over "Government" on the Town website home page. You will find the title
"Town Supervisor/Town Board". Under this title you will see "Southold Town Board Meetings

"Access", then "Southold Town Board Meetings and Agendas.

meeting by clicking on the camera symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor's Executive Orders regarding the
COVID-19 pandemic in-person access to the Public will now be permitted. The meeting will
still be accessible via Zoom and streamed live on the Town's website. The meeting can be
viewed live by going to the Town's website at www.southoldtownny.gov

menu appears, under "Town Supervisor/Town Board", click on "Southold Town Board Minutes
and Agendas"which takes the user to the Town of Southold Meeting Portal page. Once on the
Meeting Portal page, click on the date of the meeting you wish to view and then click on
"Video". A recording of the meeting will also air on Channel 22 and will be posted on the
Town's website
Instructions and link to attend the meeting will be available on the Town's website or by calling
the Town Clerk's office at (631)765-1800. A telephone number will also be provided to allow
members of the public to attend via telephone.
Written comments and/or questions may also be submitted via email to the Town Clerk at

Pursuant to the requirements of the Executive Order of the Governor of the State of New York, a
transcript will be prepared of the public hearing, and a copy shall be filed with the Town Clerk
and placed upon the Town's website.

KEKJS Headquarters LLC SFC
WHEREAS the Town of Southold has established a Transfer of Development Rights (TDR)
Program whereby Sanitary Flow Credits can be transferred into a TDR Bank from open space
lands purchased by the Town of Southold, and
WHEREAS an application for transfer of Sanitary Flow Credits was filed by KEKJS
Headquarters LLC seeking transfer of 0.71 credits to the property known as SCTM 4 1000-102.-
5-19 located at 28495 Main Road, Cutchogue, NY 11935 in the Mattituck-Cutchogue School
District, and
WHEREAS the TDR Bank currently has credits on deposit from lands purchased by the Town of
Southold that are located within the Mattituck-Cutchogue School District, and
WHEREAS, the sending parcel for these credits is 1000-101.-1-8.2, a parcel preserved in
perpetuity as open space by the Town of Southold in 2024, sending 16.4 credits to the Town
TDR Bank, all of which remain unused, and
WHEREAS the applicant seeks to utilize 0.71 credits on land in the Hamlet Business District
(HB) zoning district, a designated receiving district, to convert an existing accessory garage to
one accessory apartment at the aforementioned property, and
WHEREAS the Town Board classified this action as Type II under SEQRA on September 24,
2024, and
WHEREAS this action is exempt from LWRP review,
WHEREAS the Town Board held a public hearing on September 24, 2024, at which time all
persons were given the opportunity to be heard and that hearing has been closed, and
NOW therefor be it
RESOLVED that the Town Board has evaluated the effects of the proposal transfer and finds
that the district contains adequate resources, environmental quality and public facilities,
including adequate transportation, water supply, waste disposal and fire protection, and further
finds that there will be no significant environmental damaging consequences and that such
development is compatible with the comprehensive planning efforts of the Town, and the Town
Board incorporates the report of the Planning Board dated April 5, 2024; and it is further
RESOLVED that the Town Board of the Town of Southold hereby transfers 0.71 sanitary flow
credits from the Town TDR Bank to by KEKJS Headquarters LLC for its development at 28495
Main Road, Cutchogue, NY, SCTM 41000-102.-5-19, and it is further
RESOLVED that upon issuance of the Sanitary Flow Credit Certificate, the Planning
Department shall enter the deduction of the 0.71 sanitary flow credits from the sending parcel's
balance in the Sanitary Flow Credit Log, and be it further
RESOLVED that the applicant shall receive a Sanitary Flow Credit Certificate for the 0.71
credits, which shall not be signed by the Town Supervisor and released by the Town Clerk to the
applicant until the covenants and restrictions required by Town Code Section 117-11 have been
filed and such filing has been approved by the Town Attorney; and be it further
RESOLVED that the Town Clerk shall forward this resolution to the Tax Assessors Office, the
Land Preservation Department, the Government Liaison and the Planning Department for
inclusion into the Town database and GIS system.

RESOLVED that the Town Board of the Town of Southold hereby amends resolution 42024-
828, adopted at the September 24, 2024 regular Town Board meeting, as follows:
WHEREAS, the following properties are in arrears of Fishers Island Sewer District rents which
remain outstanding and unpaid: SCTM 1000-12.-1-9 in the amount of$5,670.00; SCTM 1000-
9.-9-20 in the amount of$2,835.00 nnd SCTIN! inns 9. 10 1 .i; and
WHEREAS, Chapter 215-17 of the Town Code "Actions to Collect Rents"provides that the
Town Board may annually cause a statement to be prepared setting forth the amount of each lien
for sewer rents in arrears, the real property affected thereby and the names of the person in
whose name such real property is assessed; and further provides that such Statement shall be
presented to the Town Assessor for the purpose of levying the involved parcel for the amount of
the arrears in the same manner as may be provided by law for the collection and enforcement of
Town Taxes; now, therefore, be it
RESOLVED, that the Town Board authorizes the preparation of this annual Statement in
accordance with Chapter 215-17 and directs that the Statement be presented to the Town
Assessor for the purpose of levying the amounts contained in such Statement against the real
property identified herein liable for the arrears. The amounts to be so levied are to be collected
and enforced in the same manner and at the same time as may be provided by law for the
collection and enforcement of Town Taxes; all subject to the approval of the Town Attorney.

WHEREAS, the Department of Solid Waste has identified an account(001840) with an
outstanding balance of$65.28, that has been deemed uncollectable; and
WHEREAS, the debtor is deceased and accordingly, it has been determined that further attempts
to collect the debt would be futile and not cost-effective; and
WHEREAS, the cost of locating and prosecuting the claim would exceed the amount owed;
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Southold, that:
1. The account identified as 001840 is hereby deemed uncollectable.
2. The Solid Waste Coordinator of the Department of Solid Waste is authorized to write off

2024 Fall Clean Up
RESOLVED by the Town Board of the Town of Southold that the Highway Department Fall
CLEANUP is limited to LEAVES ONLY (which are to be placed in biodegradable brown paper
bags) and will commence on Monday, December 2nd, 2024 in both ORIENT POINT and
LAUREL working toward the center of town; be it further
RESOLVED that, during the Fall Leaf Cleanup, ONLY leaves should be placed in the unpaved
portion of the Town right-of-way (in biodegradable bags) for collection. Once the Highway
Department has completed the area, they will NOT return; be it further
RESOLVED BRUSH and/or BRANCHES will NOT be removed; be it further
RESOLVED that the Fishers Island Fall Cleanup will also commence on Monday, December
2nd, 2024. .
RESOLVED that the Town Compost Facility in Cutchogue will accept residential brush free of
charge for the month of December (I - 30), and residential leaves free of charge for the months
of November and December; and that this grace period is for those residents who wish to take
their brush directly to the Town's compost site themselves; and that there shall be no reduction
in tip fees for commercial vehicles; and be it further
RESOLVED that for the purposes of this resolution, residential vehicles shall be defined as any
vehicle with a resident disposal permit issued by the Town Clerk of the Town of Southold
carrying less than one ton of debris (including trailers), or for vehicles without a permit, any
vehicle with a less than one ton carrying capacity (including trailers); and that commercial
vehicles shall be defined as any vehicle with a commercial disposal permit issued by the Town
Clerk of the Town of Southold, or for vehicles without a permit, any vehicle with a carrying
capacity of one ton or greater; and be it further
RESOLVED that the tip fee waiver/reduction described herein shall not apply to stumps of any
type; and that it applies to the charge for the weight of the debris ONLY, and not to single entry
fees for vehicles without permits, which will still be charged as appropriate.

RESOLVED that pursuant to the provisions of Chapter 17 (Community Preservation Fund) and
Chapter 70 (Agricultural Lands) of the Town Code, the Town Board of the Town of Southold
hereby sets Tuesday, October 22, 2024, at 7:00 p.m., Southold Town Hall, 53095 Main
Road, Southold, New York as the time and place for a public hearing for the purchase of a
development rights easement on property owned by D & S Hayfields, LLC. Said property is
identified as part of SCTM 41000-108.-3-1. The address is 3460 Elijahs LEE, Mattituck, New
York. The property is situated on the east side of Elijahs Lane, south of the railroad tracks. The
property is located within the Agricultural-Conservation (A-C) Zoning District and
approximately 17.25± acres. The proposed acquisition is for a development rights easement on
part of the property, consisting of approximately 15.08± acres (subject to survey) of the 17.25±
acre parcel. The 2.17±-acre Reserve Area will remain linked to, and be prohibited from being
subdivided from, the area subject to the easement.
The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owner. The easement will be acquired using
Community Preservation Funds. The purchase price is $76,023 (seventy-six thousand, twenty-
three dollars)per buildable acre, estimated at$1,146,426.80 (one million, one hundred forty-six
thousand, four hundred twenty-six dollars and eighty cents) for the 15.08±-acre easement.
Purchase price will be adjusted at time of closing based on final survey acreage determination,
plus acquisition costs.
The property is listed on the Town's Community Preservation Project Plan as property that
should be preserved due to its agricultural value.
FURTHER NOTICE is hereby given that a more detailed description of the above-mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.

WHEREAS, on June 24, 2011, the New York State Legislature enacted Chapter 97 of the New
York State Laws of 2011, hereinafter referred to as "General Municipal Law§3-c" ; and
WHEREAS, General Municipal Law §3-c expressly authorizes local governments, such as the
Town of Southold, to override the tax levy limit by the adoption of a local law approved by a
vote of at least sixty percent(60%) of the total voting power of the Town Board for the Town of
Southold;
WHEREAS, the New York State Comptroller has determined that pursuant to General Municipal
Law § 3-c the tax levy cap for the fiscal year 2025 will be 2%, and;
WHEREAS, the Town Board has determined that to maintain the Town's high bond rating
healthy fund balance reserves may require a real property tax cap levy in excess of the limit
established by General Municipal Law § 3-c; now therefor be it
RESOLVED the Town Clerk be and is hereby authorized to publish the attached public notice to
consider adopting a Local Law to Override the Tax Levy Limit established in General Municipal
Law § 3-c once in the October 17, 2024 issue of the newspaper designated as the official
newspaper for this purpose, and post same on the sign board at Town Hall; and be it further

A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED BY AND
SET FORTH IN GENERAL MUNICIPAL LAW § 3-C
Section 1. Purpose
The purpose of this Local Law is to allow the Town of Southold to override the limit on the
amount of real property taxes that may be levied by the Town of Southold, Suffolk County, New
York pursuant to General Municipal Law 3-c and to allow the Town of Southold to adopt a town
budget for town purposes and any other special or improvement districts governed by the town
board for the fiscal year 2025 that requires a real property tax levy in excess of the "tax levy
limit" as defined by General Municipal Law § 3-c.
The Town of Southold has made significant efforts to reduce spending in an effort to avoid
piercing the tax levy limit, however, in order to account for the increase in costs to provide town
services and fund town operations for 2025, while at the same time maintaining the Town's high
credit rating and general fund reserves, will likely require adoption of a budget in excess of the
tax levy limit.
Section 2. Authority
This local law adopted pursuant General Municipal Law § 3-c (5)which expressly authorizes a
local government's governing body to override the tax levy limit by the adoption of a local law
approved by a vote of sixty percent(60%) of the Town Board.
Section 3. Tax Levy Limit Override
The Town Board of the Town of Southold, County of Suffolk, is hereby authorized to adopt a
budget for the fiscal year 2025 that requires a real property tax levy in excess of the limit
established by and set forth in General Municipal Law § 3-c.
Section 4. Severability
If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or
the application thereof to any person, firm or corporation, or circumstance is invalid or
unconstitutional, the court's order or judgment shall not affect, impair, or invalidate the
remainder of this local law, but shall be confined in its operation to the clause, sentence,
paragraph, subdivision, or part of this local law or in its application to the person, individual,
form or corporation or circumstance, directly involved in the controversy in which such
judgment or order shall be rendered.
Section 5. Effective date
This local law shall take effect immediately upon filing with the Secretary of State

Law entitled, "A Local Law in relation to an Amendment to Chapter 75, Alarm Systems,"
which reads as follows:
LOCAL LAW NO. 2024
A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 75,Alarm
Systems,"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this Local Law is to update Chapter 75 to allow fees to be set from time to time
by Town Board resolution and definition of area covered by this chapter
II. Amendment- The Southold Town Code is hereby amended by removing the
struck through words and adding the underlined words as follows:
§ 75-2. Definitions.
For the purpose of this chapter, the following definitions shall apply:
FIRE DEPARTMENTS - Buildings owned by the fire districts of Fishers Island, Orient, East
Marion, Greenport, Southold, Cutchogue, Mattituck.
TOWN OF SOUTHOLD - All of the Town of Seu ,^l,a e el,,ding Fishers islan All areas in
the iurisdiction of the Southold Town Police Department,including the incorporated Villn
of Greenport and Fishers Island.
§ 75-4. Fees. To be set by Town Board Resolution

B. Fire Departments shall be exempt from all fees
§ 75-6. Charges for false alarms; rules and regulations.
A. Any owner or lessee of property having a fire or police alarm device or system of fire

police alarm devices on his or its premises, with the exception of all Fire Departments, on
the effective date of this chapter shall pay to the Town a charge for each and every false
emergency alarm to which the Fire or Police Department responds, in each calendar year.-

B. The z All charges shall be paid to the Town Clerk. Failure to pay any such charges
shall subject such owner, lessee or user to the penalty provisions of this chapter.
Penalties for offenses.
Any person, firm or corporation who or which does not pay any charge or fee established in this
chapter or who or which violates any provision of this chapter shall be subject to a fine fret—ift
exeess of e250 to be set by Town Board resolution for each offense. A separate offense shall
be deemed committed upon each day during which a violation occurs or is committed, and such
violation may constitute disorderly conduct, in which event such person shall be a disorderly
person.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I PURPOSE
To include loitering into the Town of Southold Code. The Chapter 197 shall be
renamed "Peddlers, Solicitors, Loitering and Transient Retail Merchants".
IL AMENDMENT
§ 197-1. Legislative intent.
The purpose of this chapter is to prevent business practices of peddlers, solicitors, loitering, and
transient retail businesses from existing in the Town of Southold with certain exceptions, as
otherwise provided herein, by providing for the registration and regulation of the conduct of
certain peddlers, solicitors, loitering and canvassers and otherwise eliminating such practices.
§ 197-2. Definitions.
As used in this chapter, the following terms shall have the meanings indicated:
LOITERING - Encompasses one or more of the following acts:
A. Obstructing, molesting or interfering with any person lawfully upon the street,
sidewalk, park or other public place.
B. Remaining in a public place for the purpose of annoying or harassing any
person lawfully upon any street, sidewalk, park or other public place.
PUBLIC PLACE - Any place to which the public is invited, including the quasi-public
area in front of or adiacent to or within any store, shop, restaurant, bar, luncheonette or
other place of business, and also any parking lots or other private or public property not
owned by or under the dominion of the person charted with a violation of this chapter.

§ 197-13. Loitering prohibited.
No person shall loiter in any way upon any street or in any public place in the Town of
Southold.
§ 197-14. Public urination prohibited.
No person shall urinate in any public place, other than within restroom facilities, or in
public view within the Town of Southold.
197-15. Public defecation prohibited.
No person shall defecate in any public place, other than within restroom facilities, or in
public view within the Town of Southold.
197-16. Penalties for offenses.
Any person required by this chapter to procure a license who violates its terms or who
violates any of the provisions of this chapter shall, upon conviction thereof, forfeit and/or
pay not less than $250 or more than $2,500 for the first offense and no less than $500 or
more than $5,000 for the second or any subsequent offense.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 30th day of July, 2024, a Local Law entitled "A Local Law in relation
to Amendments to Chapter 280 Zoning" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, Now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Amendments to Chapter 280 Zoning"reads as follows:
LOCAL LAW NO. 2024
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280 Zoning"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
L Purpose - The purpose of this local law is to allow for Day Care and Pet Care Centers.
IL Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words and remove the struck through words as follows:
Article I General Provisions
280-4 Definitions.
B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for the
purpose of this chapter, have the meanings as herein defined. Any word or term not noted
below shall be used with a meaning as defined in Webster's Third New International
Dictionary of the English Language, unabridged(or latest edition).
CHILD CARE DAY-CARE, HOME
A residential structure and property used principally as a residence, where child care is
provided by the resident for a total of five or fewer children other than those of the
caregiver. This use must be in accordance with the regulations governing home
occupations in this Zoning Code.
DAY-CARE CENTER
Any premises or part thereof maintained for the care of six or more infants,
toddlers or children, away from their own homes, for more than three hours but
fewer than 24 hours per day per child in accordance with all applicable regulations.
HOUSEHOLD PET
Any animal that has been bred or raised to live in the habitation of humans and is
food and shelter dependent. Household pets include, but are not limited to, does,
cats, birds, fish and rabbits.
PET BOARDING SERVICE
The provision of housing and care of a household pet in the absence of the owner for
a period of 24 hours or more with the exception of veterinary hospitals, so long as
the boarding area is in accordance with the applicable town, county and state
regulations.
PET GROOMING ESTABLISHMENT
A building, or part thereof, or premises maintained for the purpose of offering
bathing, clipping or combine of animals and for which a fee is charted. This
definition includes facilities that offer self-service bathing or grooming.
PET DAY-CARE
Any premises, or part thereof, maintained for the purpose of providing
socialization, training or housing, in the absence of the owner, for less than 24 hours
for household pets owned by the general public for which a fee is charted.
PET CARE FACILITY
A facility that provides one or more household pet care services, including a pet
grooming business, pet day-care, pet boarding service, obedience training,
socialization and accessory retail sales of pet products. The breeding and/or sale of
animals shall not be permitted in such a facility. Use of outdoor areas for the
services provided must be supervised to prevent the occurrence of obiectionable
noise or other nuisances beyond the boundaries of the site on which it is located. All
household pets must be controlled at all times to prevent their escape or trespass
onto neighboring properties. Animal waste must be disposed of in a manner that
will not pollute groundwater or cause odors to leave the premises, and in accordance
with the applicable town, county and state regulations.
Article VIII Residential Office (RO) District
§ 280-38 Use regulations
In the Residential Office (RO) District, no building or premises shall be used and no building or
part of a building shall be erected or altered which is arranged, intended or designed to be used,
in whole or in part, for any uses except the following:
A. Permitted uses.
(3) The following uses are permitted uses subject to site plan approval by the Planning
Board:
(h) Day-Care Center
Article IX Limited Business (LB) District
§ 280-41 Use regulations.
In the LB District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any uses except the following:
A. Permitted uses. The following uses are permitted uses. All permitted uses except single-
family and owner-occupied two-family residences require site plan approval.
(13) Day-Care Center
Article X Hamlet Business (HB) District
§ 280-45 Use regulations.
In the HB District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any uses except the following:
A. Permitted uses. The following are permitted uses and, except for those uses permitted under
Subsection A (1), (2), (3) and(20) hereof, are subject to site plan approval by the Planning
Board:

Article XI General Business (B) District
§ 280-48 Use regulations.
In the B District, no building or premises shall be used and no building or part thereof shall be
erected or altered which is arranged, intended or designed to be used, in whole or in part, for any
uses except the following:
A. Permitted uses. The following uses are permitted uses and, except for those uses permitted
under Subsection A (1), (12) and(13) hereof, are subject to site plan approval by the
Planning Board:

(16) Pet Care Facility
Article XXXIII Historic Preservation District (HPD)
§ 280-193 Use regulations
In the HPD, no building or premises shall be used and no building or part of a building shall be
erected or altered which is arranged, intended or designed to be used, in whole or in part, for any
use except the following:
A. Permitted uses. The following are permitted uses and, except for uses permitted under
Subsection A 1 , (4and(3)hereof, are subject to site plan approval by the Planning Board:

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
