DECLARATION OF COVENANTS
THIS DECLARATION made this 8 A day of Jana , 2025 by PETER J. SABAT,
residing at 3000 Beebe Drive,Cutchogue,NY 11935,hereinafter referred to as"DECLARANT":
WITNESSETH:
WHEREAS, DECLARANT is the owner of certain real property located at 3000 Beebe
Drive, Cutchogue,NY 11935, in the Town of Southold, County of Suffolk, State of New York,
described in the Suffolk County Tax Map as District 1000, Section 103.00 Block 03.00 Lot
017.001, which is more particularly bounded and described as set forth in Schedule A annexed
hereto,hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of
Trustees of the Town of Southold(hereinafter the"Trustees")pursuant to Chapter 275 of the Town
Code of the Town of Southold or its successor,and various activities conducted upon the property
may thus be subject to the regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT therefore made application to the Trustees for a permit
pursuant to the Wetlands Law of the Town of Southold to undertake certain regulated activities;and
WHEREAS,as a condition of the granting of a Wetlands Permit#10665 to undertake such
regulated activities, the Trustees required a 15-foot wide "non-disturbance buffer" with a 4-foot
wide access path to the dock along the landward edge ,of wetlands and a 10-foot
non-turf buffer"landward of the existing 15-foot wide non-disturbance buffer;and
WHEREAS,the DECLARANT has considered the foregoing and has determined that the
same will be for the best interests of the DECLARANT and subsequent owners of the Property.
NOW,THEREFORE,the DECLARANT does hereby covenant and agree as follows:
1. Upon the substantial completion of the aforementioned permitted activities there shall
be established and perpetually maintained a 15-foot wide"non-disturbance buffer"as
defined by Chapter 275 of the Town Code,to wit:"A vegetated area,as designated by
the Board of Trustees, immediately landward of the wetland boundary, shoreline
structure, or other line designated by the Trustees where no operations, maintenance,
placement of signs or other activities may take place,except that man-made debris may
be removed from such area by hand without the permission of the Board of Trustees",
with a 4-foot wide access path to the dock along the landward edge of wetlands, as
depicted on the Site Plan prepared by Frederick Robert Weber dated October 22,2024
and stamped approved by the Town of Southold Board of Trustees on October 29,
2024,as shown on Schedule B annexed hereto;and
2. Upon the substantial completion of the aforementioned permitted activities there shall
be established and perpetually maintained a 10-foot wide"non-turf buffer"as defined
by Chapter 275 of the Town Code, to wit: "A designated area where turf grass,
pesticides and fertilizers are not permitted", located landward of the existing 15-foot
wide non-disturbance buffer,as depicted on Schedule B annexed hereto;and
3. All existing trees will be preserved and there will be no removal of any wetland
vegetation.If any trees are removed during construction,they will be replaced at a 2-
to-1 ratio with native trees of 2"-3"caliper;and
4. These covenants shall rum with the land and shall be binding on the DECLARANT,
his/hedtheir heirs,assigns,purchasers,or successors in interest and may only be modified
after a public hearing and upon resolution of the Trustees.

` WHEREAS,the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED,that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program,and,
RESOLVED,that the Board of Trustees APPROVE the application of PETER SABAT to
demolish existing one-story dwelling and deck with existing foundation to remain and re-used for
construction of a new two-story dwelling in same footprint with a landward addition, a front
covered porch, a south addition, a new screened porch to a covered porch on south side, two
new roofed over porches with decks above;existing seaward deck to be removed and replaced
with an irregularly shaped bluestone patio; new connecting bluestone patio to the'west leading
to a pool patio with a proposed in-ground swimming pool, spa and kitchen area;demolish
existing garage and construct new three-car garage with attached pool house, covered patio,
and enclosed outdoor shower, Install pool enclosure fencing,two A/C pads and pool equipment;
existing sanitary system to be replaced with a new low-nitrogen I/A style system installed
landward of dwelling; install gutters to leaders to drywalls to contain roof runoff; establish and
perpetually maintain a 15'wide non-disturbance buffer area with a 4'wide access path to the
dock along the landward edge of wetlands;all existing trees will be preserved and there will be
no removal of any wetland vegetation;with the condition to establish and perpetually maintain a
10' non-turf buffer landward of the existing 15'non-disturbance buffer,all trees to be
maintained;any trees removed during construction be replaced at a 2 to 1 ration with native
trees of 2-T caliper, and the foundation of the pool and patio not to exceed T in height; all as
depicted on the site plan prepared by Frederick Robert Weber,received on October 22,2024,
and stamped approved on October 29, 2024.
Permit to construct and complete project will expire three years from the date the permit is
signed. Fees must be paid, if applicable,and permit Issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

`7 TERMS AND CONDITIONS
The Permutes Peter Sabat 3000 Beebe Drive Cutcha a New York as part of the consideration
for the issuance of the Permit does understand and prescribe to the following:
1• That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages,of suits arising directly or indirectly as a result of any
Operation performed pursuant to this permit,and the said Pennittee will,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
Of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3• That this Permit should be retained indefinitely,or as Iong as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents,and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal andlor alterations in the
location of the work herein authori4e4 or if,in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel.Such evidence shall be provided within ninety(90)calendar
days of issuance ofthis permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit

Dear Mr. Patanjo:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 16, 2024 regarding the above matter:
WHEREAS, Jeffrey Patanjo on behalf of PETER SABAT applied to the Southold Town Trustees
for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated July 30, 2024, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
October 16, 2024, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVE the application of PETER SABAT to
demolish existing one-story dwelling and deck with existing foundation to remain and re-used for
construction of a new two-story dwelling in same footprint with a landward addition, a front
covered porch, a south addition, a new screened porch to a covered porch on south side, two
new roofed over porches with decks above; existing seaward deck to be removed and replaced
with an irregularly shaped bluestone patio; new connecting bluestone patio to the west leading
to a pool patio with a proposed in-ground swimming pool, spa and kitchen area; demolish
existing garage and construct new three-car garage with attached pool house, covered patio,
and enclosed outdoor shower; install pool enclosure fencing, two A/C pads and pool equipment;
existing sanitary system to be replaced with a new low-nitrogen I/A style system installed
landward of dwelling; install gutters to leaders to drywells to contain roof runoff; establish and
perpetually maintain a 15' wide non-disturbance buffer area with a 4' wide access path to the
dock along the landward edge of wetlands; all existing trees will be preserved and there will be
no removal of any wetland vegetation; with the condition to establish and perpetually maintain a
10' non-turf buffer landward of the existing 15' non-disturbance buffer; all trees to be
maintained; any trees removed during construction be replaced at a 2 to 1 ration with native
trees of 2-3" caliper; and the foundation of the pool and patio not to exceed 1' in height; all as
depicted on the site plan prepared by Frederick Robert Weber, received on October 22, 2024,
and stamped approved on October 29, 2024.
Permit to construct and complete project will expire three years from the date the permit is
signed. Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

TERMS AND CONDITIONS
The Permittee Peter Sabat, 3000 Beebe Drive, Cutchogue New York as part of the consideration
for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
1.0. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the

PROJECT DESCRIPTION—10-6-2024
Project includes the demolition of the existing single-story residence and deck with
existing foundation to remain as existing and be re-used for construction of new
residence with same footprint (26'x60' irreg.) and the addition of second story. A 2' x 22'
addition will be added to front of house, a 5.3' x 19.5' addition will be added to south
side of house, a 5' x 12' covered porch will be added to front of house, a new 14' x 19.5'
screened porch will be added to south side of house, the existing 8' x 12' sunroom will
be removed and replaced with an 8' x 12' open porch w/deck above, the existing 12' x
16' wood deck will be removed and replaced with a 12.5' x 16' irreg. bluestone patio,
new connecting patio to west, new covered 12'x19.5' portion south of screen porch.
The existing 24' x 24' garage will be demolished and a new 24' x 47' garage constructed
to house three cars, 5'x14' covered section on west side, and a pool house with 3.7' x
7.7' outdoor shower and patio to serve the proposed 16' x 32' in-ground swimming pool
along with an 8'x6' spa and associated pool backwash drywell and 50' x 33' (overall &
irregular) bluestone patios. Two 3' x 3' a/c pads will be installed on the north side of
house.
The existing conventional sanitary system will be replaced with a new low-nitrogen I/A
style system placed in a more landward location than existing. Roof drainage will be
provided to capture all runoff and a silt fence will surround the property until final
stabilization is reached. A 15' wide non-disturbance buffer along the wetland line will be
added and have a 4' wide walking path to gain access to the dock. All existing trees will
be preserved as part of this project and no removal of any wetlands or native Baccharis
will take place.

existing one-story dwelling and deck with existing foundation to remain and re-used for
construction of a new two-story dwelling in same footprint with a landward addition, a
front covered porch, a south addition, a new screened porch to a covered porch on
south side, two new roofed over porches with decks above; existing seaward deck to be
removed and replaced with an irregularly shaped bluestone patio; new connecting
bluestone patio to the west leading to a pool patio with a proposed in-ground swimming
pool, spa and kitchen area; demolish existing garage and construct new three-car
garage with attached pool house, covered patio, and enclosed outdoor shower; install
pool enclosure fencing, two A/C pads and pool equipment; existing sanitary system to
be replaced with a new low-nitrogen I/A style system installed landward of dwelling;
install gutters to leaders to drywells to contain roof runoff, establish and perpetually
maintain a 15' wide non-turf buffer area with a 4' wide access path to the dock along the
landward edge of wetlands; all existing trees will be preserved and there will be no
removal of any wetland vegetation. Located: 3000 Beebe Drive, Cutchogue. SCTM#

At the meeting of the Southold Town Conservation Advisory Council held on Tues.,
October 15, 2024 the following recommendation was made:
Moved by Carol Brown, seconded by Nancy May, it was
RESOLVED to SUPPORT the application of PETER SABAT for the demolition of the
existing dwelling and deck with existing foundation to remain and used for construction of
new dwelling with same footprint and the addition of a second-story. A 2'X 22' addition to
be added to front of house, 5.3'X 19.5' addition added to the south side of house, 5'X 12,
covered porch and 14'X 19.5' screened porch. Existing 8'X 12' sunroom will be removed
and replaced with 8'X 12' open porch with deck above, existing 12'X 16' wood deck will be
removed and replaced with a 12.5'X 16' bluestone patio, new connecting patio to the
west, new covered 12'X 19.5' portion south of screen porch. Existing garage to be
demolished and new 24'X 47' constructed to house three cars, 5'X 14' section on west
side and pool house with 3.7'X 7.7' outdoor shower and patio to serve the proposed 16'X
32' in-ground swimming pool along with an 8'X 6' spa and associated pool backwash
drywell and 50'X 33' bluestone patios. Two TX 3' a/c pads installed on the north side of
house. Existing conventional sanitary system to be replaced with an I/A septic system in a
more landward location than the existing. Roof drainage to capture all run-off and a silt
fence will surround the property until final stabilization is reached. Install a 15' non-turf
buffer along the wetland line with a 4' wide walking path to gain access to dock. All
existing trees will be preserved and no removal of any wetlands or native Baccharis will
take place.

PETER SABAT requests a Wetland Permit to demolish existing one-story dwelling and deck with
existing foundation to remain and re-used for construction of a new two-story dwelling in same
footprint with a landward addition, a front covered porch, a south addition, a new screened porch to
a covered porch on south side, two new roofed over porches with decks above; existing seaward
deck to be removed and replaced with an irregularly shaped bluestone patio; new connecting
bluestone patio to the west leading to a pool patio with a proposed in-ground swimming pool, spa
and kitchen area; demolish existing garage and construct new three-car garage with attached pool
house, covered patio, and enclosed outdoor shower; install pool enclosure fencing, two A/C pads
and pool equipment; existing sanitary system to be replaced with a new low-nitrogen I/A style
system installed landward of dwelling; install gutters to leaders to drywells to contain roof runoff;
establish and perpetually maintain a 15' wide non-turf buffer area with a 4' wide access path to the
dock along the landward edge of wetlands; all existing trees will be preserved and there will be no
removal of any wetland vegetation. Located: 3000 Beebe Drive, Cutchogue. SCTM# 1000-103-3-

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the LWRP.
It is recommended that existing trees be preserved and turf be minimized to further Policy 6.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

screened porch will be added to south side of house, the existing 8' x 12' sunroom will
be removed and replaced with an 8' x 12' open porch w/deck above, the existing 12' x
16' wood deck will be removed and replaced with a 12.5' x 16' irreg. bluestone patio,
new connecting patio to west, new covered 12'x19.5' portion south of screen porch.
The existing 24' x 24' garage will be demolished and a new 24' x 47' garage constructed
to house three cars, 5'x14' covered section on west side, and a pool house with 3.7' x
7.7' outdoor shower and patio to serve the proposed 16' x 32' in-ground swimming pool
along with an 8'x6' spa and associated pool backwash drywell and 50' x 33' (overall &
irregular) bluestone patios. Two Tx 3' a/c pads will be installed on the north side of
house.
The existing conventional sanitary system will be replaced with a new low-nitrogen I/A
style system placed in a more landward location than existing. Roof drainage will be
provided to capture all runoff and a silt fence will surround the property until final
stabilization is reached. A 15' wide non-turf buffer along the wetland line will be added
and have a 4' wide walking path to gain access to the dock. All existing trees will be
preserved as part of this project and no removal of any wetlands or native. Baccharis will
take place.

Town Hall, 53095 Main Road, Southold, New York, concerning this property.

SUBJECT OF PUBLIC HEARING: For a Wetland Permit to demolish existing one-story dwelling and deck l
with existing foundation to remain and re-used for construction of a new two-story dwelling in same
footprint with a landward addition, a front covered porch, a south addition, a new screened porch to a
covered porch on south side, two new roofed over porches with decks above; existing seaward deck to be
removed and replaced with an irregularly shaped bluestone patio; new connecting bluestone patio to the
west leading to a pool patio with a proposed in-ground swimming pool, spa and kitchen area; demolish
existing garage and construct new three-car garage with attached pool house, covered patio, and enclosed
outdoor shower; install pool enclosure fencing, two A/C pads and pool equipment; existing sanitary system
to be replaced with a new low-nitrogen I/A style system installed landward of dwelling; install gutters to
leaders to drywells to contain roof runoff; establish and perpetually maintain a 15' wide non-turf buffer
area with a 4' wide access path to the dock along the landward edge of wetlands; all existing trees will be
