Lauren Standish,Secretary " P.O.Box 1179 " Southold,NY 11971 Telephone(631)765-1889 Conservation Advisory Council Town of Southold At the meeting of the Southold Town Conservation Advisory Council held on Tues., October 15, 2024 the following recommendation was made: Moved by Carol Brown, seconded by Nancy May, it was RESOLVED to NOT SUPPORT the application of JONATHAN REBELL & NOAH LEVINE to construct 65' stairs to beach consisting of 4' wide stairs plus two 4'X 6' platforms, two 4'X 5' platforms, two 4'X 4' platforms with last set of stairs retractable and aluminum. Elevation of stairs to be at least 3' above grade. Project includes a 4' non- disturbance area at top of bluff with pressure treated beams anchored into the ground along landward edge of non-disturbance buffer. Maintain a 20' non-turf buffer along the entire length of the top of the bluff. Cut back portion of the top of bluff, reducing the angle of repose from 42 degrees to 35 degrees. Add three 2"X 12" erosion control terracing structures planted with Cape American beach grass within the disturbed area. Located: 4790 Blue Horizon Bluff, Peconic. SCTM#74-1-35.56 Inspected by: Carol Brown, Nancy May The CAC does Not Support any construction on the failing concave bluff and recommends the bluff is re-vegetated with native plantings. Located: 4790 Blue Horizon Bluffs, Peconic. SCTM# 1000-74-1-35-56 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP. Traditionally, beach stairs in this area are at risk of loss due to the high erosion of the bluff and the action is recommended as inconsistent. The bluff restoration and stabilization plan mitigates loss concerns. It is recommended that the 25' Non-disturbance buffer is shown on the survey and that the use of CCA treated materials be minimized. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Trustee permit#9755 for this project expired. We have a NYDEC permit. We have amended the scope of the project which triggers the requirement of a Coastal Zone Erosion Hazard permit. We are proposing to cut back a small portion of the top of the bluff, hence reducing that angle of repose of the bluff from about 42 degrees to 35 degrees. We will add limited retaining structures in the area and plant the area with cape American beach grass. These efforts will support the growth of vegetation, hence stabilizing the bluff to allow for the installation of beach access stairs. We have included a non-disturbance buffer and access path. Enclosed you will find: Revised plans which includes a revised project description. Please note that the plan has been certified by Joseph Fischetti of Fischetti Engineering. .
