PO Box 1212 Westhampton Beach, NY 11978 RE: VANSTON BEAR, LLC 5250 VANSTON ROAD, CUTCHOGUE SCTM# 1000-111-10-14 Dear Mr. Baird: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 16, 2024 regarding the above matter: WHEREAS, First Coastal Corp. on behalf of VANSTON BEAR, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 1, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 16, 2024, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of VANSTON BEAR, LLC to remove an 85' section of existing bulkhead and jetty along southern side of inlet and reconstruct in alignment with existing bulkhead using PVC sheathing; for a Ten (10) Year Maintenance Permit to dredge approximately 500 cubic yards of bottom material at mouth of dug boat basin; remove approximately 1,600 cubic yards of bottom material to create a deposition basin; place all dredged material on two upland areas and retain the material with staked hay bales; dried materials to be spread out above the Mean High Water line; with the condition of adhering to seasonal restrictions of the NY Department of Environmental Conservation for any work in the area; turbidity controls be placed to mitigate any saltation of the environment; with as much material on the north-east side of the property to be moved by the littoral drift as part of the natural movement of sand in the area; all as depicted on the site plan prepared by First Coastal Corp., received on August 1, 2024, and stamped approved on October 16, 2024. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) '..n" va:%>'c i 1?a Y TERMS AND CONDITIONS The Permittee Vanston Bear,LLC, 5250 Vanston Road, Cutchogue New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: L That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. Dredge 500 cubic yards the navigation channel between the re-aligned jetties and bypass the sand around the existing boat basin channel to an approved deposition location north of the channel. 4. Dredge 1,600 cubic yards from a deposition basin south of the re-aligned jetty to contain 2+ years of the anticipated littoral transport and bypass that sand around the existing boat basin channel to an approved deposition location south of the channel. 5. Monitoring and adaptive management plan to confirm dredging and bypassing rates and confirm project function. The applicant provides the following justification for the permit modification: A. The proposed dredging is completely consistent with previously issued department decisions extending from 1991 to the present, as described in detail below. B. The seaward end of the boat basin channel suffers from complete shoaling that precludes navigation between the boat basin and Peconic Bay within months of dredging. C. The existing NYSDEC permit (1-4738-00444/00020) allows up to 1,400 cubic yards of dredging within the channel and deposition on the upland. D. The current dredging window that closes on December 31 of every year means that the channel is completely shoaled, and navigation precluded before the normal boating season in May. E. Sand currently deposited in the channel, updrift of the jetty and offshore is prevented from moving naturally along the beach to the north causing erosion of that shoreline. Consequently, the north shoreline has retreated substantially since 1962. F. Sand bypassing is an accepted method of providing navigation and restoring natural sand flow, which will help restore the shoreline north of the channel. G. The current channel configuration (width, depth and length) at the seaward end of the jetties defining the channel does not provide sufficient capacity to contain this annual sand deposition and also allow navigation. The NYSDEC has previously issued a permit to dredge 1,150 cubic yards to create a deposition basin at this site in 1996 and 2004 and to use the material for beach restoration (1-4738-00444/00006-8 and 15-17). I. The sediment to be dredged is greater than 90% sand and less than 5% Total Organic Carbon and thus meets the NYSDEC standard for onsite sediment disposal. J. Alternatives to remedy this situation include: a. Expand the navigation channel by realigning the south jetty, dredge the expanded channel, establish a deposition basin south of the south jetty and bypass all of the dredged sand to the north shoreline in an approved location. b. Dredging just prior to the summer boating season in May of every year, which would be within the currently closed dredging window. c. Channel abandonment. K. The recommended alternative is "a" above. a. Expand the navigation channel by realigning the south jetty, dredge the expanded channel, establish a deposition basin south of the south jetty and bypass all of the dredged sand to the north shoreline to an approved location. b. Monitoring and adaptive management plan to confirm dredging and bypassing rates and confirm project function. L. The proposed activity will produce the following environmental benefits: a. Minimize environmental disturbance by reducing the frequency of future maintenance dredging and deposition. b. Provide enhanced navigation. c. Restore the natural flow of sand to the north nourishing that shoreline. d. Enhance endangered shorebird habitat to the north by stabilizing the shoreline. e. Enhance coastal resilience to the northern beach that is currently compromised by erosion. f. Be consistent with previous permits issued by the NYSDEC at this site. Existing Conditions / Site Overview The subject site is a boat basin and channel defined by bulkheading and two timber jetties located in the Hamlet of Cutchogue in the Town of Southold, NY. The boat basin and jetties were established and maintained under several NYSDEC, USACE and Town of Southold permits. The width of the channel is approximately 30 feet at its narrowest point. Since 2001 the updrift (south)jetty of the boat basin channel has been at sediment carrying capacity, i.e., the point at which impoundment of naturally accreting sediment reaches its limit and bypassing occurs to the adjacent, downdrift beach (Kraus, et al. 2016) (USACOE Engineer Manual 1110-2-1100, 2003). Sand has been spilling around the updrift (south)jetty, into the boat basin channel mouth, where it cannot escape through natural forces alone due to a small tidal prism (tidal prism is the total amount of water that flows into a harbor/basin or out again with movement of the tide, excluding any freshwater flow (USACOE Engineer Manual 1110- 2-1100, 2003) and weak prevailing currents. Currently, the shoaling of the channel mouth precludes navigation to and from the boat basin and Peconic Bay within months of the dredging. Water quality in the boat basin is also adversely impacted due to the lack of flushing and natural sand flow to the north (updrift) beach is also interrupted resulting in erosion of the northern shoreline. Relocate and reconstruct the existing south existing timber jetty. 2. Dredge the navigation channel between the re-aligned jetties with sand bypassing around the existing boat basin channel to an approved deposition location north of the channel. 3. Dredge a deposition basin south of the re-aligned south jetty to contain 2+ years of the anticipated littoral transport. 4. Sand bypassing of the dredged sand around the existing boat basin channel to an approved deposition location north of the channel. 5. Monitoring and adaptive management plan to confirm dredging and bypassing rates and confirm project function. The existing permits (see Appendix A for copies of the current permits and a list of past permits) allow for annual dredging of the channel mouth. Unfortunately, experience at the site reveals that the seaward end of the boat channel fills in with sand more rapidly and thus the channel is not performing as intended. Aerial photographic analysis and direct observations at the site over the last two dredging seasons reveal that navigation is precluded within approximately 6 months of dredging. 2019/2020 Dredging Season The dredging window restrictions preclude dredging between January 1 and October 1 of any year thus, dredging is only allowed between October 1st and December 31st of any year. Dredging was completed prior to the December 31, 2019, cutoff date. The dredged channel and dredge material placement are clearly visible in the February 2020 aerial (Figure 4) However, by September 2020 (seven months) the shoal had already built across the mouth of the channel precluding navigation (Figure 5). This shoal can also be seen in the ground photos taken at low tide by First Coastal in September 2020 showing the shoal emergent at low tide. (Figure 6). By March of 2021, the shoal was emergent at high tide (Figure 7). Thus, within approximately seven months of dredging the channel was unusable and within one year of the dredging, the shoal had almost completely stopped tidal exchange between the boat basin and Peconic Bay. The channel was dredged just prior to the December 31 m, 2021 cutoff and was unusable for the 2022 boating season. Within a month of the dredging, First Coastal conducted a site visit to evaluate conditions. The shoal extended almost '/2 way across the mouth of the channel (see Figure 9 a, b and c from January 2022). These observations were quantified and confirmed by the hydrographic survey competed by Sea Level Mapping in February 2022, which clearly shows the shoal extending the majority of the way across the channel. The shoal is completely across the 30 foot wide channel and safe navigation is precluded for the majority of the boating season. An analysis of these two dredging events revealed that the sand shoal forming across the mouth of the 30-foot-wide channel is a narrow band approximately 50 feet from east to west. Thus, the vast majority of the boat basin and navigation channel is not impacted. Only the narrow band 50 feet wide at the seaward end of the two wooden jetties where the channel is the narrowest (30 feet wide). J i 4. Regulatory Compliance The proposed permit modification complies with the prevailing regulatory guidelines. The project site enjoys a current NYSDEC, USACE and Town of Southold dredging permits for the navigation channel and the boat basin. The permit history extends back at least to 1991 and includes dozens of permits for dredging as evidenced on the NYSDEC online permit system (DART). In 1996, the NYSDEC issued permits to establish a deposition basin (1-4738-00444-6, 7 & 8). The 'permit allowed 1,150 cubic yards of dredging with placement for beach nourishment. Those permits were extended to 2004 but subsequently expired (1-4738-00444- 2/11/13). A subsequent permit application to continue the dredging was filed in 2004 (1-4738- 00444-1 5/1 6/1 7). Those permit applications are listed as "insufficient information as of 8/1/2006" on the DART website. As a result, no permit was issued. The current permit to dredge 1,400 cubic yards of sand was issued in 2015 (1-4738- 00444-18/19/20) and was subsequently modified in 2018, 2019 and 2020. The permit is valid through 6/22/2025. The dozens of approvals granted to date all include dredging to maintain navigation with sand placement both north and south of the channel to promote coastal resilience and habitat enhancement. All of the sediment dredged to date meets the NYSDEC standard for onsite disposal as it is greater than 90% sand and less 5% Total Organic Carbon. Sediment samples in the proposed deposition basin were collected by Barron Environmental in conformance with the NYSDEC standard for sample collection. They were processed at Long Island Analytical Laboratories in April 2021. The sample results show that all of the material proposed to be dredged is greater than 90% sand and less than 5% Total Organic Carbon. Thus, these sediments also meet the standard for onsite disposal. See appendix C for a complete set of analytics. The current request is consistent with all previous approvals and represents an "Adaptive Management" approach to minimizing environmental disturbances by decreasing dredging frequency and providing for the bypass of sand to the downdrift beaches. Monitoring & Adaptive Management Plan The proposed monitoring and adaptive management plan are provided to ensure the boat basin channel mouth remains open and functional. All features of the maintenance dredging and deposition basins should be monitored annually. Monitoring Pre and post dredging monitoring consists of the following action steps: 1. Pre and post dredging hydrographic/topographic surveys of the dredging and disposal area 2. Pre and post dredging ground photographs of the dredging and disposal area 3. Pre and post dredging ortho-aerial imagery of the dredging and disposal area when available The proposed monitoring and adaptive management plan are provided to ensure the boat basin channel mouth remains open and functional and the downdrift beach is healthy and nourished. Adaptive Management/Maintenance If the monitoring reveals that there is unacceptable shoaling in the channel mouth or unanticipated changes in the disposal area, the existing design of the deposition basin and disposal area should be re-evaluated. Modification to the necessary permit(s) should be requested based on the monitoring data collected and reasonable adjustments to the design and operation of the dredging.
