Engineering •Pla ni n ction Management 1200 Veterans Memorial Highwa , upp uge, ew York 11788 - (631) 348-7600 CHMAR 8, 2023 PHASE I ENVIRONMENTAL SITE ASSESSMENT FOR THE PROPERTY LOCATED AT: 2000 LIGHTHOUSE ROAD SOUTHOLD,NEW YORK SCTM#1000-50:5-1 EXECUTIVE SUMMARY This report outlines the findings of a Phase I Environmental Site Assessment(ESA) prepared for the Town of Southold by Cashin Associates, P.C. (CA) for the subject property located at 2000 Lighthouse Road, Southold, New York. The subject property consists of approximately 8.06 acres of former farmland occupied by a vacant barn. The subject property is located at the northeast intersection of Soundview Avenue and Lighthouse Road, in Southold, an unincorporated area of the Town of Southold, Suffolk County,NY. The field inspection was conducted on March 2, 2023 by an Environmental Professional from CA. CA accessed the parcel on a driveway from Soundview Avenue, and site access was arranged through the property owner representative, Kristen Conklin, as executor of the estate of the property owner. Based on the review of the available historical data for the past 70 years, the subject property appears to have historically been used for agricultural purposes, initially as a cultivated field, and then as a tree nursery. The property appears to have become overgrown over the past 10 to 20 years. The barn is masonry and metal construction, and was vacant at the time of the inspection. The barn was equipped with fueling equipment, and four underground storage tanks are present. The barn was reportedly used for storage of farm equipment. The site contains miscellaneous farm and other debris, but no structures except for the barn. ES-1 Cashin Associates,P.C. • Engineering 9 Planning • Construction Management The site does not appear on any of the reviewed environmental databases. There were no listings in the database that indicate an environmental risk to the subject property from nearby properties. The following Recognized Environmental Conditions (RECs) and Business Environmental Risk issues were identified by this assessment for the subject property. Recognized Environmental Conditions (RECs) Underground Fuel Storage Tanks — The property contains four underground storage tanks, reportedly about 500-gallons each in capacity, near the entrance to the barn. Fuel pumps for the tanks are located inside the barn. The tanks are believed to have been installed in about 1980, and were used to store diesel and gasoline for fueling farm equipment. The tanks do not appear i to have been registered with Suffolk County and New York State, and they have not been in use for an extended period of time. The tanks are not in compliance with current regulatory compliance, and there is no available documentation that they are secure and leak free. As such they represent a possible source of soil and groundwater contamination from leakage or other failure. Unless the tanks are going to be removed so that direct observation of the condition of the tanks and underlying soils can be made, soil borings would need to be installed to check for subsurface contamination from the tanks. In any case, the tanks are not in compliance and are no longer in use, so they should be removed in accordance with Suffolk County regulatory requirements. Business Environmental Risk Issues Asbestos Containing Material—Possible asbestos containing material (ACM) is present on the exterior of the masonry foundation of the barn. The foundation along the full perimeter of the barn is covered with what appears to be ACM-containing sheeting board. Suspect ACM piping is present among debris discarded near the barn. A line of translucent parcels along the wall of the barn appears to be fiberglass construction,but testing would be needed to determine if it is ACM. An ACM survey by a licensed asbestos investigator should be performed prior to building renovation or demolition to confirm the presence of ACM and identify proper ACM abatement needs. Suspect-Contaminated Soil — The floor of the barn consists of a concrete slab and bare soils. There was several areas of what appeared to be soil staining. As the building appears to have been used for vehicle fueling, and possible vehicle storage and maintenance, soils may have been affected`by leakage and spillage from vehicles. Soil testing in and around the barn should be performed to check for any soil contamination. On-Site Debris — Site inspection indicated that there are numerous areas of debris, including construction materials, old lead batteries, old farm equipment and soils with debris fragments, ES-3 Cashin Associates,P.C. 9 Engineering • Planning 9 Construction Management c _ some of which do not-appear to have been generated on the property. Although there were no obvious evidence of hazardous materials in the debris, further testing would be needed to check for potential contamination issues. Miscellaneous debris on the property, should be removed and properly disposed of as part of site restoration, if the site is to be utilized as natural open space or parkland. Past Agricultural Pesticide Use — The subject property was historically used for farming, and pesticides and herbicides were likely used for an extended period of time. Regional contamination of shallow groundwater from pesticide use has been thoroughly documented for � 1 much of eastern Long Island. Soil contamination has also been documented for lands under long- term agricultural use in the North Fork. The property has not been used for farming in several decades and there has been no application of pesticides or herbicides. Nevertheless, pesticides and herbicides historically used on farmland can persist in soils for extended periods of time. The approximately 8-acre property was formerly used as farmland, but now mainly consists of vacant wooded land. A vacant barn, reportedly formerly used for storage of farm equipment, is also present, along with four (4) out- of-use petroleum-product (diesel fuel, gasoline) underground storage tanks (USTs) located at the front exterior of the barn. This Phase II was performed to investigate issues identified in a recent Phase I ESA (dated March 8, 2023) done by Cashin Associates, P.C. (CA) regarding the subject property, including the following: the potential presence of subsurface contamination from underground fuel tanks having leaked; possible contamination of on-site soils and debris piles from previous long-term agricultural use; and possible presence of asbestos-containing materials (ACMs). The findings of the Phase II investigation are summarized below and described in detail in this report. Four (4) Underground Storage Tanks (USTs) — Soil borings and testing found no evidence to indicate or suggest that the tanks have leaked and caused significant subsurface contamination. However, the four 1,000-gallon single-walled steel tanks have not been properly abandoned and still contain residual product, representing a risk of future leakage. These tanks should be properly removed in accordance with all applicable Suffolk County Dept of Health Services (SCDHS)requirements. On-Site Soils — Soils in the barn, soil piles on the property, and soils in the former farm fields were found to have elevated levels of pesticides, including DDT, DDE, DDD, Aldrin, Dieldrin, Chlordane and Endrin, in many cases in excess of New York State Dept of Environmental Conservation (NYSDEC)Part 375 "Unrestricted Use Soil Cleanup Objectives" (UUSCO's). The 1 elevated levels are most likely from residual pesticides associated with former agricultural activities/uses, as often found on properties subject to long-term agricultural use. The soils were t Cashin Associates,P.C. 9 Engineering 9 Planning • Construction Management not found with elevated levels of Volatile Organic Compounds (VOCs), Semi-Volatile Organic Compounds (SVOCs), or metals above SCDHS Article 12 Action Levels. The presence of elevated levels of pesticides indicates that remediation should be implemented based on the planned future use of the property. Remediation should be implemented if future use will involve potential human exposure (i.e. active recreational uses, playgrounds, etc.). A Soil Management Plan should be implemented for any construction activities involving significant disturbance of on-site soils. Given that the site is largely woodland, remediation involving the removal or covering (encapsulation) of existing soil may not be advisable, and the maintenance of soil undisturbed in-place would be most appropriate. if only limited areas of the site are proposed for active use, selective remediation could be performed just for the affected areas. Asbestos — The following two (2) asbestos-containing materials (ACMs) were confirmed at the site: Foundation Transite Board - located in few inch strips at barn exterior along building foundation at all sides of barn. Fibrous Pipe (as debris) - located as debris along rear/east side barn exterior (2 pieces of pipe as debris at ground). (CA) has been retained by the property owner (Ms. Elizabeth Lind) to serve as environmental consultant on this project and is pleased to submit this Underground Storage Tank Removal Work Plan as part of the tank closure application submittal to your Dept for this site(TC-23-00051). 2000 Lighthouse Road,Southold,NY: The approximately 8-acre property was formerly used as farmland,but now mainly consists of vacant wooded land.A vacant barn,reportedly formerly used for storage of farm equipment, is also present, along with four (4) 1000-gallon out-of-use petroleum-product (diesel fuel, gasoline) underground storage tanks (USTs) located at the front exterior of the barn. It is anticipated that the barn structure will be demolished and removed from the property as part of future work, and that the property will be transferred to the Town of Southold for use as open natural space. A review of the applicable USGS topographic map (Southampton,NY Quadrangle) revealed that the subject property ranges from about 75 feet above mean sea level(msl)at its north end,to about 60 feet above msl at its south end, in an area that generally slopes downward to the north toward the shoreline of Long Island Sound. The surrounding area has undulating topography typical of the shoreline areas of the Long Island's North Fork near Long Island Sound. The review of the Suffolk County Water Table Contours Map online and the USGS depth to groundwater mapper indicated that the water table elevation at most of the subject property is expected to be approximately 5 feet above mean sea level (msl), or approximately 70 feet below ground surface(bgs).The regional groundwater flow direction is to the north,toward Long Island Sound. A recent Phase II ESA (dated May 5, 2023) was performed by CA to investigate environmental issues at the site including these tanks. Metal-detecting and ground-penetrating radar (GPR) equipment was used to identify and mark-out the locations and extents of the four (4) out-of-use USTs (gasoline, diesel fuel; estimated 1,000-gallons each) located at the front exterior of the barn (2 located on each side of the front barn door). A geoprobe unit was then used to advance four(4)soil borings to an approximate depth of 15 feet below ground surface(in 5-foot intervals) Page I 1 in the vicinity of the narked-out USTs, including SB-1 at the north side of the tanks, SB-2 at the south side of the tanks, SB-3 in the middle of the tanks, and SB-4 at the west side of the tanks. A sample was collected from the bottom depth interval (10-15') of each boring location and laboratory analyzed for the presence of Total Petroleum Hydrocarbons (TPH) and BTEX, contaminants/compounds of petroleum products and their breakdown constituents. Additionally, subsurface soil from each depth interval at each boring location was field checked by CA for visible and olfactory evidence of contamination, and was also screened using a Photo Ionization Detector (PID) to check for the presence of Volatile Organic Compounds (VOCs). No significant/indicative PID readings/VOC concentrations were detected and no other field evidence of contamination (i.e. discoloration, odors) was,observed in any of the soil boring intervals or samples, and all four (4) of the soil boring samples (collected from 10-15' depth interval) were laboratory analyzed and found to be non-detected for petroleum indicators including BTEX and TPH. As such, these tanks do not appear to have leaked and caused significant subsurface (petroleum)contamination at the site. 2.0 Scope of Work Since the performance of the above-noted Phase H ESA in May 2023, these tanks have been properly registered with the SCDHS Office of Pollution Control (OPC) under Registration Application No. T-HM-23-00182 (copy enclosed) and the owner has retained Terra Tech Site Development to properly remove these tanks under Tank Closure Application No.TC-23-00051 which has been submitted and received by OPC. The tank closure/removal project will entail two excavations (with two side-by-side USTs removed from each) performed at the front exterior of the barn to remove the sets of side- by-side tanks located on each side of the front barn door(i.e. each excavation will be for two 1,000-gallon gasoline/diesel fuel tanks).Per GPR markout,each 1,000-gallon UST measures approximately 12' x 51,and as such,each of the two pairs of side-by-side tanks is expected to generate an approximately 10' x 12' excavation(120 square feet each excavation). All supply and vent lines associated with the tanks will also be)removed. Prior to their removal, any residual liquids that may be present in the tanks will be pumped-out/removed and properly disposed of by the tank removal contractor. Page 12 A Site Plan indicating the locations of the USTs/excavations/End Point sampling at the front of the barn structure is enclosed. On behalf of the owner and in support of the above contractor scope of work, CA will provide the following services: • Coordination with the tank removal contractor and SCDHS OPC regarding the scheduling of the tank removals. • Provide on-site oversight/inspection(in conjunction with on-site SCDHS representation) of the tank excavations/removals to verify that proper procedures are followed. • Proper collection and laboratory analysis (VOCs, SVOCs) of appropriate End-Point soil samples from beneath each tank and from the side walls of each excavation(per SCDHS requirements). • Generation and issuance of a Closure Report to SCDHS OPC confirming the proper abandonment of the USTs including satisfactory End-Point sample results(to be compared i to SCDHS Article 12 Cleanup Objectives) for the purpose of obtaining a No Further Action required letter from the Department regarding the subject site. 3.0 End-Point Sampling Per SCDHS, a minimum of 1 soil sample must be collected per 5 linear feet from beneath each tank, and a minimum of 4 side wall samples must be collected from each combined excavation. Each tank is approximately 12 linear feet long,requiring 2 samples from beneath each tank (total of 8 samples from beneath the 4 tanks). Additionally, each of the two (combined) excavations (2 tanks removed from each) will require 4 side wall samples (north, east, south, west walls) from each excavation (total of 8 sidewall samples from the 2 excavations). 8 samples from beneath four tanks+8 samples from side walls of two excavations= 16 total end-point soil samples to be collected for the four tanks/two excavations. Page 13 i /1 I Note: Based on the expected depth to groundwater at the site(approx. 70 feet below ground surface),groundwater sampling is not anticipated or planned to be part of this project. Cashin will collect and deliver these (16) samples under proper chain-of-custody procedures to a New York State-certified laboratory (Long Island Analytical Laboratories, Inc. in Holbrook,NY; NYSDOH ELAP#11693)for proper analysis(Suffolk County List VOCs,SVOCs).The samples will be collected according to any/all applicable sampling guidelines, proper personal protective equipment will be used during sample collection, and all field equipment will be properly decontaminated(via-Alconox solution)before and after each sample collection. A Site Plan indicating the locations of the USTs/excavations/End Point sampling at the front of the barn structure is enclosed. 4.0 Closure Report Following the completion of the field work and receipt of the laboratory results, CA will prepare and issue to SCDHS a UST Closure Report, including all procedures, protocols, methods, samplings, and analyses utilized during the investigation, and including conclusions and recommendations based on the findings of the investigation, which will be based on CA's comparison of sampling results to applicable regulatory (SCDHS Article 12) cleanup criteria. A site plan, laboratory analytical results, site photographs, and other relevant materials/documents will be included as appendices to the report. Page I 1 Since the performance of the above-noted Phase II ESA in May 2023, these tanks have been properly registered with the SCDHS Office of Pollution Control (OPC) under Registration Application No. T-HM-23-00182 and the owner has retained a qualified contractor to properly remove these tanks under Tank Closure Application No. TC-23-00051, which has been submitted and approved by OPC (including UST Removal Work Plan with End-Point Sampling). 2.0 Underground Storage Tank Removal Activities The following underground storage tank removal activities were performed on November 2,2023 as per the SCDHS-approved UST Removal Work Plan and in the presence of an on-site environmental professional from CA and a representative of SCDHS OPC(Mr. Ethan Helgans). The tank removals included two excavations performed at the front exterior of the barn. Each excavation (approximately 10' x 12') was for two side-by-side 1,000-gallon gasoline/diesel fuel tanks. In summation and per the Work Plan, the four(4) gasoline/diesel fuel USTs (including all associated supply/vent lines and dispensing equipment) were properly exposed, opened, pumped out, cleaned out, inspected,removed, secured in a container for transport, and taken by truck from site for proper disposal by the contractor, under the supervision and to the satisfaction of the on- site representatives from CA and SCDHS OPC.Both CA and SCDHS observed the removed tanks to be in good condition with no obvious holes,pitting, or other degradation indicative of the tanks having leaked, and the subsurface soil in the excavations appeared to be clean and did not,indicate any visual or olfactory evidence of possible contamination. 3.0 End-Point Sampling Per SCDHS requirements, a minimum of 1 soil sample had to be collected per 5 linear feet from beneath each tank,and a minimum of 4 side wall samples had to be collected from each combined excavation. Each tank was approximately 12 linear feet long, requiring 2 samples from beneath each tank(total of 8 samples from beneath the 4 tanks).Additionally, each of the two (combined) excavations (2 tanks removed from each) required 4 side wall samples (north, east, south, west walls) from each excavation (total of 8 sidewall samples from the 2 excavations). As such, 8 samples were collected from beneath the four tanks and 8 samples were collected from the side Page 12 walls of the two excavations, totaling 16 end-point soil samples collected for the four tanks/two excavations. On November 2, 2023 (day of tank removals), CA collected the above-required (16) end-point samples and delivered them under proper chain-of-custody procedures to a New York State- certified laboratory(Long Island Analytical Laboratories,Inc. in Holbrook,NY;NYSDOH ELAP #11693) for the SCDHS-required analysis (Suffolk County List VOCs, SVOCs). The samples were collected according to applicable sampling guidelines,proper personal protective equipment was used during sample collection, and all field equipment was properly decontaminated (via Alconox solution) before and after each sample collection. The excavations were partially backfilled after performance of the tank removals and end-point sampling and the backfilling was to be completed by the contractor within a couple of days. A Site Plan indicating the locations of the UST excavations at the front of the barn and the End- Point samples collected from each is enclosed. 4.0 Findings, Conclusions and Recommendations Per SCDHS requirements, all end-point samples were laboratory analyzed for the presence of Volatile Organic Compounds (VOCs; via EPA Method 8260) and Semi-Volatile Organic Compounds (SVOCs; via EPA Method 8270) and the results were compared to the regulatory cleanup objectives put forth in SCDHS Article 12—Standard Operating Procedure No.9-95 Pump- out and Soil Cleanup Criteria. None of the(16)SCDHS-required bottom and sidewall end-point samples collected from the two tank removal excavations had exceedances of SCDHS Article 12 Cleanup Objectives for VOCs or SVOCs. Copies of the laboratory analytical results and sample chain-of-custody document for the endpoint sampling are provided in the appendices of this report. A Table of the analytical results including SCDHS Article 12 Cleanup Criteria is also provided. Page 3 1 In conclusion: • The recent May 2023 Phase II ESA found no evidence(in subsurface soil borings/samples) that the tanks had leaked or caused significant subsurface contamination at the site. • In August 2023, the tanks were properly registered by owner with SCDHS OPC (Registration Application No. T-HM-23-00182). • On November 2, 2023, the tanks were removed under on-site SCDHS supervision and according to the SCDHS-approved UST Removal Work Plan that was submitted as part of Tank Closure Application No. TC-23-00051. • At the time of removal, both CA and SCDHS observed the removed tanks to be in good condition with no obvious holes,pitting,or dither degradation indicative of the tanks having leaked, and the subsurface soil in the excavations appeared to be clean and did not indicate any visual or olfactory evidence of possible contamination. • None of the(16) SCDHS-required bottom and sidewall end-point samples collected from the two tank removal excavations had exceedances of SCDHS Article 12 Cleanup Objectives for VOCs or SVOCs. Based on all of the above, and the protocols and requirements of SCDHS, no further remedial action regarding this tank removal project, or subject property overall, appears warranted or is recommended by CA at this time, and CA requests that SCDHS OPC issue a No Further Action required letter(or equivalent)to the owner regarding the subject site. Engineeringon Management 1200 Veterans Memorial Hiw York 11788- (631) 348-7600 NOVENMER 17, 2023 REPORT ON CLEAN-UP OF PROPERTY AT 2000 LIGHTHOUSE ROAD SOUTHOLD,NEW YORK INTRODUCTION This report presents the findings of site inspections performed by Cashin Associates, P.C.(CA)for clean-up of the above.referenced property. A Phase I Environmental Site Assessment dated March 8, 2023 and a Phase II Environmental Site Assessment dated May 5, 2023, both prepared by CA, identified several environmental issues that required clean-up.These issues were: 1) Out-of-Use Underground.Fuel Storage Tanks — Four gasoline and diesel tanks require removal in accordance with Suffolk County Department of Health Services (SCDHS) requirements. Soil borings conducted during the Phase II study indicated that the tanks had not leaked, but proper abandonment/removal was required for the tanks under County regulations. 2) Asbestos—The Phase II investigation included an asbestos survey which indicated that transite boards along the barn's foundation,as well as several discarded pipes are asbestos containing material(ACM)and require proper removal and disposal in accordance with New York State Department of Labor(NYSDOL) requirements. 3) Soil/Debris Piles—The Phase I Assessment identified numerous piles of soil, construction debris and f miscellaneous debris on the property. The Phase II report indicated that soil/debris piles contained contaminated soil. It was recommended that the soil and debris piles by removed, along with miscellaneous debris observed on the site. FINDINGS At the request of the property owner's representative (Kristen Conklin), CA conducted several site inspections to confirm that the clean-up outlined above was completed by contractors hired by the owner. Inspections were performed as follows: • After the asbestos removal,August 3,2023 • After removal of some debris piles, October 31,2023 • During the tank removal, November 2,2023 r Cashin Associates,P.C. • Engineering • Planning • Construction Management �_. • After completion of all work on site as reported by the contractor, November 11,2023 The inspections confirmed the following: • The asbestos containing materials were removed by the contractor, and no residual ACM was observed on the property. • Interim and final inspection confirmed that the soil/debris piles had been removed from the property. • The four underground fuel tanks were properly removed from the property in full accordance with Suffolk County Department of Health requirements. At the request of the property owner, CA prepared a work plan and closure report for the tank removals and submitted the reports to the County. CA was present during the removals of the tanks from the property. A County inspector was also present.As part of the removal work,CA collected end-point soil samples and forwarded the samples to the laboratory per SCDHS requirements.The samples indicated no contamination present.The soil excavations were properly backfilled with clean soil.Upon submission and review of the closure report,SCDHS issued a No Further Action letter dated November 15,2023.The tank closure work plan,closure report and SCDHS letter are included in Appendix 1. CONCLUSION The remediation items identified for the property have been completed,and no further action is required regarding those clean-up issues at the site. And then there is one property to the west, the left of the red, that has a white label on it . That is Hummel ' s Pond. That is owned by the Town of Southold in our open space program. So that is Hummel ' s Pond. It ' s known as Hummel ' s Pond across the street . Hummel ' s Pond -- probably was when it was colder, a very popular skating area . And there is a walking trail around Hummel ' s Pond. Hummel ' s Pond is also in February 14, 2023 Regular Meeting 14 the deer program. The property across the street will be a great expansion of that . And expansion in addition to that . It will allow future expansion of a walking trail and likely expansion of harbor view management area . The property was farmed, - I believe, in the past . There is a nursery. The nursery was left . The Committee members and I have both walked the property. And supports the Town proceeding with the acquisition of this important property that will expand our open space . Although it is a smaller property, you ' can see on the map, you can see its expansion and preserved property. The Town is acquiring this property with Community Preservation Funds . PROOF OF LOSS In the event the Company is unable to determine the amount of loss.or damage,the Company may,at its option,require as a condition of payment that the Insured Claimant furnish a signed proof of loss. The proof of loss must describe the defect, lien,encumbrance,.or other matter insured against by this policy that constitutes the basis of loss or damage and shall state,to the extent possible,the basis of calculating the amount of the loss or damage. -. 5. DEFENSE AND PROSECUTION OF ACTIONS (a) Upon written request by the Insured,and subject to the options contained in Section 7 of these Conditions,the Company,at its own cost and without unreasonable delay,shall provide for the defense of an Insured in litigation in which any third party asserts a claim covered by this policy adverse to,the Insured. This obligation is limited to only those stated causes of action alleging matters insured against by this policy. The Company shall have the right to select counsel of its choice (subject to the right of the Insured to object for reasonable cause) to represent the Insured as to those stated causes of action. It shall not be liable for and will not pay the fees of any other counsel.. The Company will not pay any fees, costs,or expenses incurred by the Insured in the defense of those causes of action that allege matters not insured against by this policy. (b) The Company shall have the right, in addition W the options'contained in Section 7 of these Conditions,.at its own cost, to institute and prosecute any action or proceeding or to do any other act that in its opinion may be necessary or desirable to establish the Title,as insured; or to prevent or reduce loss or damage to the Insured. DUTY OF INSURED CLAIMANT TO COOPERATE (a) In all cases where this policy permits or requires the Company to prosecute or provide for the defense of any action or proceeding and any appeals,the Insured shall secure to the Company the right to so prosecute or provide defense in the action or proceeding,including the right to use, at its option, the name of the Insured for this purpose. If requested by the Company,the Insured Claimant shall execute documents to.evidence the transfer to the Company of these rights and,remedies. The Insured Claimant shall permit the Company to sue, compromise, or settle in the name of the Insured Claimant and to use the name of the Insured Claimant in any transaction or litigation involving these rights and remedies. If a payment on account of a claim does not fully cover the loss of the Insured Claimant,the Company shall defer the exercise of its right to recover until after the Insured Claimant shall have recovered its loss. (b) The Company's right of subrogation includes the rights of the Insured to indemnities, guaranties, other policies of insurance, or bopas notwithstanding any terms or conditions contained in those instruments that address subrogation rights. 14.
