beneficiary under the Last Will and Testament of ANNE M. WERBER (who died 09/07/1997)
pursuant to a Last Will and Testament filed with the Nassau County Surrogates Court, file no.
303398, residing at 5090 Indian Neck Lane, Peconic, New York 11958 , party of the first part, and
FRANCIS J. WERBER JR., ROBERT J. WERBER and JOHN C. WERBER as tenants in common,
residing at 5090 Indian Neck Lane, Peconic, New York 11958, party of the second part,
WITNESSETH, that the party of the first part in consideration of TEN DOLLARS and other valuable
consideration paid by party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part, forever,

party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
AND the said Executor does covenant, promise and agree, to and with the said Grantee, his heirs or
successors and assigns, by these presents, that the said Grantor has not done, committed or
knowingly or willingly suffered to be done or committed, any act, matter or thing whatsoever
whereby the premises hereby granted, or any part thereof, is are, shall or may be impeached,
charged or encumbered, in title, charge, estate, or otherwise howsoever.

erected, situate lying and being in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at a point on the Southerly side of Indian Neck Road where the same is
intersected by the Easterly side of land now or formerly of Jefferson and Smith and others;
THENCE along the Southerly side of Indian Neck Road North 77000' East 73.00 feet
to the land now or formerly of Messenger;
