SEQRA DETERMiNATiON: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type I~ category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 19,593 sq. ft. lot has 76.56 ft. frontage along the south side Founders Path and 75 feet along Hobart Road, and vadable depth of 268.94 feet on the north side and 253.54 feet along the south line. The property consists of two lot numbers referred to as #44 and #35 on the Map of Founders Estates, f~led May 10, 1927, and is improved with a single-family one-story frame dwelling situated at 61.6' from the front line facing Founders Path, and with existing side yards of 10.2 feet and 22.7 feet. A detached garage is also existing behind the dwelling with a 4 ft. setback from the northerly (side) lot Iine, as shown on the June 22, 1999 survey prepared by Joseph A. ]ngegno, L.S BASIS OF APPLICATION: Building Department's July 15, 2003 Notice of Disapproval, citing Section 100-244B, in its denial of a building permit application to construct an additions end alterations to the existin§ dwelling at less than 10 feet on a single side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 20, 2003, at which time written and ora~ evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: AppIicant wishes to construct a proposed wraparound addition, two sections of which will be 8 ft. and 8.33 feet from the south side line of the house, at its closest point, instead of the code required 10 feet, as shown on the site plan prepared by Garrett A. Strang, Architect, dated 7-14-03. revised 7-17-03. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Pa~e 2 - December 4, 2003 AppL Nc 5411 - Karen Brown CTM I000-64-4-3 and 6 (combined} 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-famiIy homes of similar size and scale, many with setbacks similar to that requested in this application. The applicant requests a reduction on the southerly side yard for a small triangular section resuitin§ in 24" reduction from the existing setback, and the remaining areas were noted as conforming to the code setback, height, and lot coverage requirements. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the appIicant to pursue, other than an area variance. The proposed additions are designed to architecturally bIend into the existing one-story style of the house, and the relief requested is relative onIy for the southerly side of the proposed additions, respectively two small triangular sections that fa~l within the 10 ft. side yard limitation resulting in variable side setbacks at 8 ft. and 8.33 feet. 3. The variance granted herein is not substantial. The side yard variance is minimal and permits a reduction in the code required I0 ft. minimum to 8 ft. for two small portions of the additions (24" or less). 4. The difficulty was self-created when a portion of the proposed additions was planned and designed without conformity to the current Code setback requirement. 5. There is no evidence that the grant of the relief requested will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: in considering ali of the above factors and applying the balancing test under New York Town Law 287-B, motion was offered by Member Tortora, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the site plan prepared by G. A. Strang, Architect, dated 7-14-03, revised 7-17-03, SUBJECT TO THE FOLLOWING CONDITION: That County Tax Map #1000-64-6-6 and 3 remain combined as one Iot, and the total land area not be reduced in size or subdivided. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Strang. MR. STRANG: Good afternoon. Garret Strang, Architect, representing Kamen Brown with respect to this application. Quick overview of the project here is we have an existing one-story, single-family cottage with two very small bedrooms and one bath which has been used as a part-time vacation residence, weekend residence. The proposal for this is to maintain it as a one-story, single-family residence, but to make it full-time use as the owner will be retiring here full time, and to enhance it so that it has three bedrooms and two baths. The additions that are being proposed are basically needed to meet not only the owner's criteria to convert this from a cottage tea full-time residence, but to address nonconforming bedroom sizes into code compliant bedroom sizes and create a master bedroom and bath area so that it would be compatible with full-time use. The challenges that we've met here is that the house is'on a 76 or 75 foot wide lot, and the house sits askew on that let. If it were parallel with the side lot lines we wouldn't really need to be before the Board. Unfortunately is sits askew, and the existing location ef the house dictates the location ef where the bedrooms are and where they will remain, be increased in size and to address the code issues with respect to the size. And there's really no other practical alternative available to us for placement of these expansions. Therefore, we need and are seeking the relief from this Board. Things that weVd like the Board to consider in making a determination is the fact that what we are seeking for relief is minimal since the areas that are or will become in violation te the codes are triangular in shape, they're stepped back from the property 24 25 line intentionalZy so as to minimize the impact on the side yard, and they total the -- how should I say -- the area that's nonconforming or will become nonconforming, November 20, 2003 1 2 3 5 6 ? 8 10 il 12 13 14 iS 16 17 18 19 2O 21 22 23 6O totals ten square feet and six square feet respectively, and they are in one-story addition; we're not going up a second story in the house. The remainder of all the additions are compliant with the zoning as are the front and rear total side yards. If the Board has any questions, certainly I~d be happy to address them at this time. CHAIRWONL~N OLIVA: I was there and is there any way on that one side yard instead of a 10.2 setback you couldn't -- it's just a tiny piece there that you're coming out. Could you just do that in line in the front and back instead of coming out? MR. STRANG: We investigated that and the addition to the rear of the house is for the master suite, and the addition toward the front is to create a little area that would be sort of a computer room or a little den or office toward the front° So that whole side of the house would basically be a master suite. The opposite side of the house is the other two guest bedrooms. If we can't come forward -- there's a bath in the middle now that we're going to enhance. We're trying to keep the plumbing and everything that's there in place. As I mentioned earlier, we did step it back to try and keep that reduction. If we were to try and come forward and maintain that 10.2, that room in the front would be unusable in size and not compliant with the code as far as the minimal dimensions that are recruited by code. CHAIRWOMAN OLIVA: Mrs. Tortora. BOARD MEMBER TORTORA: The one story addition is going to be how many bedrooms you said? MR. STRANG: The total in the house will go to three bedrooms. BOARD MEMBER TORTORA: So in the 14 by 27 addition that you're doing? MR. STRANG: The 14 by 27 foot addition encompasses the master bedroom and 24 25 master bath. The other two bedrooms are enhanced by the addition on the opposite side of the house. CHAIRWOMAN OLIVA: It's my November 20, 2003 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 61 understanding that this is an A frame house, a cathedral ceiling? MR. STRANG: It's a cathedral ceiling in the living area, which is in the middle of the house. Obviously the house was a little tiny cottage and had some bumps put on it over the years. BOARD MEMBER TORTORA: The ten foot setback line, is that where you have marked 27 on the survey, there's a variegated line. And it says on the line it's almost even where the measurement 27, is that the ten foot setback? MR. STRANG: The ten foot setback is basically the corner of the existing, where it says 10.2 in the unhighlighted area or the clear area, it says 10.2 on the front of the house, that corner on the property line is 10.2 as it presently exists. BOARD MEMBER TORTORA: I was trying to visually see which, of what portion of those juts are nonconforming and there's no way for me to ascertain that on this survey? MR. S~RANG: · only have one copy of this, but I'd be happy it to share, leave it with you. BOARD MEMBER TORTORA: This line here. MR. STRANG: Right. That is the ten foot setback required by zoning. BOARD MEMBER TORTORA: A couple of things, on the face of it, those little juts are insignificant. MR. STRANG: Yes. BOARD MEMBER TORTORA: However, if we grant it, if the Board were so inclined to grant an eight foot minimum setback, it would be only for these plans? MR. STRANG: That's perfectly fine. BOARD MEMBER TORTORA: So if they were modified to increase that, and it would be very specific to that little juts and these plans so, if the Board -- so that you couldn't 24 25 come back and say oh, my gosh, we're going to go all along the property line. MR. STRANG: No, I do have a floor plan already prepared and submitted to the November 20, 2003 1 2 3 4 5 6 7 8 9 i0 11 12 13 14 15 16 17 18 19 2O 21 22 23 62 owner for their review and have given a positive response to which relates to the relief that we're seeking here. So. BOARD MEMBER TORTOP~: You would agree -- this relief plans in so concerned? next? MR. BOARD MEMBER GOEHRINGER: I'll even go a little bit farther than that and that is the plans are generic or site specific to this particular one-story structure and that there be no further trying or attempting to develop that vacant piece of property, which I know has a garage on it, but would have a significant impact if the Board were so inclined to grant this to create another lot on Hobart? MR. STRANG: I believe the lots are merged. BOARD HEMBER GOEBRINGER: understand they're merged. But one never knows whatVs going to happen te zoning in hamlet areas. BOARD MEMBER TORTORA: He's got a garage on there. BOARD MEMBER GOEHRINGER: Wouldn't make any difference. It's still succinct and still separate from the existing house. It would double the lot coverage if they tried te split that elf. Again, I would like to .mention within the decision assuming the Board was so inclined. MR. STPJ~NG: If the Board was se inclined to grant what's been applied for here with the condition on that -- I~m just trying 24 25 not to put my client in a corner, if you will -- could that condition be read tkat they have to come back before this Board if they were to entertain the idea of splitting that November 20, 2003 1 2 3 5 7 8 9 10 12 13 14 15 16 17 18 19 20 21 22 23 63 off? I don't know that they have any intention. BOARD MEMBER GOEHRINGER: They would have to anyway. CHAIRWO~AN OLIVA: They would have to anyway, Garrett. BOARD MEMBER TORTORA: The feeling here is that we're looking at one lot now. BOARD MEMBER GOEHRINGER: Right. MR. STRANG: Exactly. BOARD MEMBER TORTORA: We're looking at a plan to develop one lot. If there are planning to be two lots, I wouldn't be inclined to grant any variances because it would be overcrowded. MR. STRANG: There's no plans to that nature to my knowledge. BOARD MEMBER TORTORA: · think that's where we're all going here. MR. STRANG: I don't have a challenge with it. I just, if the wording is such that they'd have to come back and there's no guarantee the Board would grant that lot be split off, I'm just -- BOARD MEMBER GOEHRINGER: Well, mainly because it would be probably be 24 percent lot coverage then or maybe even greater, or it may be 34. MR. STRANG: It would depend on the ground where that lot line fell it would necessitate a rear yard variance. It's not the intention of my client to split that lot. Right now they enjoy a nice view from their rear yard of their house and their deck across that vacant piece of property to that creek. Fortunately, the neighbors across Hobart are staggered in such a way that they do have a view of that creek, and I think that they'd want to maintain that so there's never been a discussion or intention to try and split that lot. CHAIRWOMAN OLIVA: Mr. Borning. BOARD MEMBER HORNING: No questions. Wait, I do have a question. On 24 25 the eastern side of the survey you have with the master bedroom suite, et cetera, is that hallway, that narrow hallway connecting? This is the proposed floor plan that the original wall of the house is along here, actually, it's along here comes across here. It's not a hallway, it's a bump te accommodate the master bath, part of which is already in this area as the only existing bath in the house. The hallway~s internal. BOARD HEHBER HORNING: This is actually original; where is the original -- HR. STRANG: The original building line is about where the fireplace is here. BOARD MEMBER HORNING: This way? MR. STRANG: That way it's pretty much about here. Actually may be all the way out, I'm sorry. It may be all the way out. I don't have the existing condition overlay te relate to that. BOARD MEMBER HORNING: I was just curious about this little piece here, I mean if there was a wall on either side it would make me wonder. HR. STRANG: No. There's net a wall. The exterior wall will be removed. MS. KOWALSKI: Would any beard merabers like extra copies of it? BOARD HEMBER TORTORA: I have to write this thing so it might be helpful. HR.
