WITNESSETH,that the party of the first part, in consideration of One Million Six Hundred Eighty Thousand
and xx/100($1,680,000.00)dollars paid by the party of the second part, does hereby grant and release unto
the party of the second part,the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, in the Town of Southold,
County of Suffolk and State of New York, being known and designated as Lot 18 on a Map entitled, "Map of
Country Club Estates" and filed in the Suffolk County Clerk's Office on October 17, 1978 as Map No. 6736,
said lot is bounded and described as follows:
BEGINNING at a monument on the westerly side of Country Club Lane distant 431.63 feet northerly from the
extreme northerly end of an arc of a curve connecting the westerly side of Country Club Lane and the northerly
side of Linden Avenue(Moores Lane);
RUNNING THENCE along the division line of Lot Nos. 17 and 18 on the above mentioned map the following 2
courses and distances:
1. South 56 degrees 33 minutes 20 seconds West, 161.34 feet to a point;
2. North 89 degrees 39 minutes 40 seconds West,206.35 feet to land(now or formerly)of Country Club
Estates Property Owners Inc.;
THENCE North 03 degrees 24 minutes 20 seconds East along last mentioned land 147.87 feet to the division
line of Lot Nos. 18 and 19 on the above mentioned map;
THENCE North 76 degrees 55 minutes 50 seconds East along last mentioned division line 300.20 feet to a
monument on the westerly side of Country Club Lane;
THENCE along the westerly side of Country Club Lane the following 2 courses and distances:
1. South 13 degrees 04 minutes 10 seconds East,77.80 feet to a point;
2. along an arc of a curve bearing to the left having a radius of 160.00 feet and a length of 56.90 feet to
the point or place of BEGINNING.
THE POLICY TO BE ISSUED under this commitment will insure the title to such buildings and improvements
on the premises which by law constitute real property.
FOR CONVEYANCING ONLY: Together with all the right, title and interest of the party of the first part, of in
and to the land lying in the street in front of and adjoining said premises.
BEING AND INTENDED TO BE the same premises described in a deed made by Gunter Morchel and Gisela
Morchel and recorded June 25, 1987,in Liber 10350,at page 121.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this Conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word"party"shall be construed as if it read"parties"when ever the sense of this indenture so
requires.
