Project Description: To remove existing rear slate patio; construct a ±12.8'x55'
irregular rear deck using wood or composite, 50 cubic feet to be excavated for
deck footings; steps on north side of deck to lead to ±16'x6' pebble walk at grade
with surrounding 4' fence and ±6'x5.3' outdoor shower; pebble walk to continue
under outdoor shower; establish and perpetually maintain a non-turf buffer
planted with native, non-fertilizer dependent vegetation seaward of deck;
establish and perpetually maintain a non-disturbance buffer from top of bank
seaward.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
site plan prepared by Harold F. Tranchon Jr. P.C., received on September 9,
2024, and stamped approved on September 18, 2024.
Special Conditions: None.
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

Cole Environmental Services on behalf of BRETT& KIM DOHNAL requests an Administrative
Permit to remove existing rear slate patio; construct a 12.5'x55' rear deck using wood or composite,
and ±50 cubic feet to be excavated for deck footings; corner step on north side of deck to lead to an
18'x6' pebble walk at grade with surrounding fence; install a 6'x5.3' outdoor shower; and to
establish and perpetually maintain a non-turf buffer area along the bank face and planted with
native, non-fertilizer dependent vegetation as needed with a 4'wide access path to water. Located:

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department and the records available to me, I recommend that the proposal is
INCONSISTENT with LWRP Policies and with the LWRP provided the following is considered to
further policy 6:
1. The deck is located 20' to tidal wetlands where a 100' setback is required.
In the event the action is approved:
2. Require a vegetated buffer incorporating existing to preserve water quality in this
low-flow tidal area. Retain trees.in a buffer and allow limbing up.
3. Due to the slope towards the water body—design a sand sink to capture surface
runoff.
4. Verify where the outdoor shower would drain.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Proposed ± 12.8'x 55'irregular rear deck. Existing rear slate patio to be removed. Deck to be wood or
composite and approximately 50 cubic feet to be excavated for deck footings. Steps on north side of
deck to lead to±16'x 6' pebble walk at grade with surrounding 4'fence and ±6'x 5.3' outdoor shower.
Pebble walk to continue under outdoor shower. Non-turf buffer to be established as shown on plans and
planted with native, non-fertilizer dependent vegetation as needed.

Dear Elizabeth,
Our clients, Kim and Brett Dohnal,seek an Administrative Wetland Permit for a rear deck and outdoor shower at
their property referenced above.
We have modified the deck configuration to address the concerns of Trustee Gillooly and the rest of the Board.
The proposed deck is nestled against the house and does not extend beyond the existing slate patio,which
maximizes the distance to the wetland to the maximum extent possible.
The existing slate patio sends water toward the wetlands; however,the deck will allow water to percolate
through. This will allow the ground beneath to capture some of the water, both reducing the amount and the
speed of runoff. The proposed project seeks to mitigate current erosion and prevent future erosion with a non-
turf buffer. While the area of the proposed buffer is already well vegetated,we are proposing supplemental
native vegetation as needed,which will help additionally to capture and slow runoff and prevent erosion. The
proposed project will not result in an adverse environmental impact and will not increase damage from erosion.
Therefore,the project addresses the concerns previously expressed by the Board and the LWRP Coordinator.
