Barylski, dated October 19, 2019, is beyond Tidal Wetlands Act (Article 25) jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR Part 661), no Tidal Wetlands permit is required to conduct regulated activities landward of the 30-foot elevation contour (topographic crest). In addition, DEC has determined that the demolition of the slab and portion of the existing residence within Tidal Wetlands Act jurisdiction is greater than 75 feet from the tidal wetlands boundary and is listed in the Tidal Wetlands Land Use Regulations (6 NYCRR Part 661.5) as an activity that is not regulated. Therefore, no permit is required under the Tidal Wetlands Act. Be advised, any additional work or modification to the project as described, may require DEC authorization. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or disturbance within Article 25 jurisdiction which may result from your project.
