For the benefit of the public, I would like to explain why. Currently the code does not permit accessory structures like detached garages and sheds, to be located in a side yard. So,when a property owner adds an addition to their house, like a front porch or rear yard deck, if that addition technically relocates a legally existing accessory structure partially or completely in a side yard,the Building Department is required to issue a Notice of Disapproval. The property owner then has to appeal to the ZBA with an application for a variance, with a fee, and then a public hearing must be held. This is true even if absolutely no changes are proposed to the existing structure and there are no additional adverse impacts. And these applications are more common than you might think. They are taking up time on the ZBA's very busy calendar of public hearings, thereby causing delays for other applications, and burdening property owners with unanticipated fees for variance relief that were not likely included in their home improvement budgets. For these reasons the Members of the Board of Appeals brought the idea of the proposed code charge to your attention. As you know the draft code before you was discussed by the Code Committee,the Chief Building Inspector,the Assistant Town Attorney,the Town Attorney and me, and reviewed by all the members of the ZBA before this final version was set for tonight's hearing.
