Minutes & Discussion Notes from Meeting held
Tuesday, September 3, 2024 at 7:00 p.m.
This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold Town
Hall Annex, 54375 Route 25 (Main Road), Southold, New York.
The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did not
have access to a computer or smartphone, there was an option to listen in via telephone.
Comments from the public may not be solicited nor received without an appointment. It is expected that the
Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of
discussing applications regarding proposed acquisitions of real property where publicity would substantially
affect the value thereof. The public is not allowed to attend, view, or listen to Executive Session.

Committee Minutes and Administration
• Acceptance of LPC meeting minutes from May 28, 2024

General Preservation
• Summary of 2024 Amendments to Town Law 64-e [continued from 8/20]
Lilly continued reviewing the impending Town Law 64-e amendments. The Committee further discussed
the mandate that 10% of annual revenue be spent to benefit disadvantaged communities, noting that this
mandate in particular is vague and fails to define what constitutes a "benefit."
• Proposed Code re: Easement Violations
The Committee reviewed a draft amendment to Chapter 70 that would impose penalties for violations of
Town development rights easements. Lilly explained that the language draws from Easthampton Town
Code and County Code Chapter 8. The Committee members agreed that it is important for the Town to
have recourse against bad actors that does not require suing landowners in Supreme court. However,
Committee members were concerned that the current draft could lead to overzealous, inconsistent, and
disproportionate application of the penalty provisions, especially if those decisions do not involve
individuals knowledgeable about farming and how harmful particular violations are. Committee members
noted that the Town needs meaningful deterrents to serious easement violations without deterring farmers
from participating in the Land Preservation program altogether. Committee members discussed the need
for clear language regarding the process and ability to resolve violations before reaching the penalty
phase, and the Town's ultimate goal of restoration. What would be required for restoration? What would
be the procedure for restoration? The fines being from $3,000 to $10,000 is vague. The Committee
members requested additional time to review the language and intend to discuss at the next regular
meeting. The Committee members would also like to share comments with the Agricultural Advisory
Committee.
