Y. ~elephon¢ SO 5-~660 MINUTES SOUTHOLD TOWN BOARD OF APPEALS January 17, 1961 A meeting of the $outhold Town Board of Appeals was held at the call of the Chairman at lg00 P.M., Tuesday, January 17, 1961 at the Town Clerk Office, Main Road, Southold, New York. There were present: Messrs. Robert W. Gillispie, Jr., Chair,,an, Herbert Rosenberg, and Charles Grigonis, Jr. Absent: Messrs. Robert Bergen, and Serge Doyen, Jr. On motion of Mr. Rosenberg, seconded by Mr. Grigonis, and carried, the Board of Appeals set 7~30 P.M., Thursday, January 26, 1961, TOWn Clerk Office, Main Road, Southold, New York, as time and place for hearing upon application of Noel Albrecht, Mattituck, New York, a/c John Loper, Jr., Mattituck, New York, for a variance inaccor~nce with the Zoning Ordinance, Article III, Section 303, and Article X, Section 1000A, for permissi~n to reduce lot area and use as a single lot, property located on the west side Wells Road, Laurel, New York, bounded north by Katherine Tuthill, east by Wells Road, south by Katherine T~thill, and west by Katherine Tuthill. $outhold Town Board of Appeals -2- January 17, 1961 Vote of the Boards Ayes:- Mr. Gillispie, Mr. Rosenberg, and Mr. Grigonis. The Secretary was instructed to forward a letter to Mr. Noel Albrecht stating that the Board would like to have Mr. Loper~s deed available for examination the night of the public hearing. A letter was also forwarded to Mrs° Katherine Tuthill requesting her presence at the public hearing inasmuch as she is the owner of property on either side of the lot purchased by Mr. Loper. Resolution was offered by Mr. Grigonis, seconded by Mr. Rosenberg, and carried, setting 8200 P.M. (E.S.T.), Thursday, January 26, 1961, Town Clerk Office, Main Road, Southold, New York as time and place for hearing upon application of William M. Beebe, New Suffolk Lane, Cutchogue, New York, for a special exception inaccordance with the Zoning Ordinance, Article III, Section 300, Subsection 11, for permission to erect ~nd maintain commercial advertising sign on property of WilliamM. Beebe, south side Eugene Road, Cutchogue, New York, bounded north by Eugene Road, east by William Mo Beebe and others, south by William M. Beebe and others, and west by William M. Beebe and others. Vote of the Board: Ayes:- Mr. Glllispie, Mr. Rosenberg, and Mr. Grigonis. Mr. and Mrs. James Darden, Montauk Highway, Bridgehampton, New York, appeared before the Board of Appeals for an informal discussion relative to property they own on Main Road, Mattituck. On January 29, 1959 Mr. and Mrs. Darden were granted a variance to build on an undersized lot at Main Road, Mattituck. However the lot was located at the end of a private driveway and recognition of access was required. Mr. and Mrs. Darden were unable to secure an agreement from the adjoining property owner, Herman Hubbard to give one half of the access across his property. They now would like to secure recognition of access across 10 ft. of their own property. The Board advised that this seemed reasonable and they had an undue hardship, therefore they were advised to file for recognition of access under New York State Town Law Section 280A. On motion of Mr. Rosenberg, seconded by Mr. Grigonis, and carried, the Board of Appeals set 8:30 P.M. (E.S.T.), Thursday, Southold Town Boardof Appeals -3- January 17, 1961 January 26, 1961 as time and Town Clerk Office, Main Road, Southold, New York, as place for hearing upon application of James and Claudia Darden, Montauk Highway, Bridgehampton, New York, for recognition of access in accordance with New York State Town Law, Section 280A. Location of property= north side Main Road, Mattituck, New York, bounded north by land of Junius Hubbard, east by land of Herman Hubbard, south by land of Herman Hubbard, and west by land of Maston. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Rosenberg, and Mr. Grigonis. tt was FURTHER RESOLVED that legal notice of hearing be published /n the official newspaper under date of January 19, 1961. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Rosenberg, and Mr. Grigonis. The minutes of the meeting of January 5, 1961, on motion of Mr. Grigonis, seconded by Mr. Rosenberg, and carried, were approved as submitted. Vote of the Board= Ayes:- Mr. Gillispie, Mr. Rosenberg, and Mr. Grigonis. On motion of Mr. Rosenberg, seconded by Mr. Grigonis, and carried, it was RESOLV~ that meeting scheduled for 7~30 P.M., Thursday, January 19, 1961 be postponed to 7:30 P.M., Thursday, January 26, 1961 at the TOWn Clerk Office, Main Road, Southold, New York. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Rosenberg, and Mr. Grigonis. Meeting adjourned at 2:00 P.M. 9~ '~'Judlth T. Boken, Secretary
