Box 814 Cutchogue, NY 11935 Re: Proposed Amended Site Plan for Reflecting Nature Landscaping Located approximately 314' north of CR 48, on the east side of Cox's Neck Road, known as 260 Cox's Neck Road, in Mattituck SCTM#1000-113-14-10 Zone: LB, Limited Business Dear Mr. Pawlowski: The following resolution was adopted at a meeting of the Southold Town Planning Board on Monday, November 8, 2004: WHEREAS, o~n October 27, 2003, the Southold Town Planning Board granted final approval on the surveys/dated August 29, 2002, and last revised on September 29, 2003, and authorized the Chairm~n to endorse this proposed site plan, to be known as the site plan for Reflecting Nature Landscaping, to construct a 2,520 square foot storage building and office on 1.1 acres in Mattituck; and WHEREAS, Paul Pawlowski is the owner of the property known and designated as Reflecting Nature Landscaping, 260 Cox's Neck Road, Mattituck, SCTM#1000-113-14-10; and WHEREAS, the applicant submitted an amended site plan prepared by Barret, Bonaci & Van Weele, P.C., dated October 20, 2004, detailing the as built changes; and WHEREAS, the Town'Engineer has reviewed the site plan for the as built changes and the Planning Board has accepted his recommendations for approval; be it therefore RESOLVED that the Southold Town Planning Board accept the site plan changes as noted on the amended site plan prepared by Barret, Bonaci & Van Weele, P.C. and dated October 20, 2004. The following resolution was adopted: WHEREAS, this proposed site plan, to be known as the site plan for Reflecting Nature Landscaping, is to construct a 2,520 square foot storage building and office on 1.1 acres in Mattituck; and WHEREAS, Paul Pawlowski is the owner of the property known and designated as Reflecting Nature Landscaping, 260 Cox's Neck Road, Mattituck, SCTM #1000-113-14- 10; and WHEREAS, a formal application for the approval of this site plan was submitted on August 29, 2002; and WHEREAS, the Southold Town Planning Board made a determination on January 13, 2003 that the proposed is a Type II Action and not subject to review pursuant to 6 NYCC Part 617.5; and WHEREAS, a variance was granted by the Zoning Board of Appeals (Application No. 5365), on September 11, 2003, to allow an 80' setback from Cox's Neck Road, and to Refiectin.q Nature - Paqe Two - October 27, 2003 further grant a Special Exception to al~oTM a landscaping business with storage and office areas in an LB zone; and WHEREAS, a final public hearing was closed on said application at Town Hall, Southold, New York on October 27, 2003; and WHEREAS, this site plan, dated August 29, 2002, and last revised on September 29, 2003, was certified by the Building inspector on October I7, 2003; and WHEREAS, the Town Engineer has reviewed the drainage calculations and the PIanning Board has accepted his recommendations for approval, but the ap¢icant is directed to contact the Town Engineer during construction and grading to verify drainage installations; and WHEREAS, on November 19, 2002, the Architectural Review Committee reviewed and approved the proposed site pian elements; and WHEREAS, on March 19, 2003, the applicant signed a statement agreeing not to Object to a new public hearing and Planning Board review of the revised application; and WHEREAS, the Southold Town PIanning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Site PIan Regulations of the Town of Southotd have been met; be it therefore RESOLVED that the Southold Town Planning Board grant final approval on the surveys, dated August 29, 2002, and last revised on September 29, 2003, and authorize the Chairman to endorse the fina~ surveys subiect to a one year review from the date of the building permit. In this review the Board determines that a landscape contractor business use is in harmony with the zoning ordinance and will not adversely affect the neighborhood when meeting the code requirements. 2. In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in Section 100-263 and finds that: A) The use of the property as a landscape contractor's office and related activi- ties in the proposed new building will not prevent the orderly and reasonable use in this zone district and adjacent districts. A landscape business in this LB Zone is a listed authorized use in the Zoning Code, allowed by Special Exception approval from the Board of Appeals and site plan approval from the Planning Board. C. The location of the proposed building will not cause traffic congestion on public streets, highways and sidewalks. D. There is availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent (whether liquid, solid, gaseous or otherwise) as a result of this use. E. The use or the materials incidental thereto will not give off obnoxious gases, odors, smoke or soot. The applicant's lot size does not meet ~he 80,000 bulk schedule size in the LB zone, with the existing 47,760 sq. ft. The setback is also required by the code to be 100 ft. from Cox Neck Road, and the easterly yard behind the proposed building is quite Iarge, aJlowing for an 80 ft. setback from Cox Neck Road, similar to the setback of the house on the northerly adjacent lot. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance for setbacks and the bulk schedule requirements in the LB Zone for a new business building. The applicant proposes a 60ft. setback from Cox Neck Road, aithough there is a targe amount of land available in the rear easterly section of the property. 3. The variance granted herein is substantial The applicant requested a 40% reduction from the code requirement, and the variance granted allows a 20% reduction. Also the size of the Iot is almost 50% less than the bulk schedule requirement of 80,000 sq. ft. The variance granted permits a 20 ft. reduction in the code required 100 ft. minimum, which equal to the setback of the adjacent northerly dwelling (ref. 3-24-82 updated survey prepared by Harold F. Tranchon, Jr., P.C.). 4. The difficulty was self-created when the new building was planned without conformity to the code setback requirement from Cox Neck Road that has been in effect since 1999. 5. Board members did have a concern that the property be used as a landscaping y~rd and not as a recycling yard for trees and stumps. The applicant assured the Board that the parcel would be used only for storage of landscaping equipment and not as a recycling yard, therefore there will not be adverse effect or impact on physical or environmenta~ conditions in the neighborhood or district. The proposed building and site witI also be subject to the requirements of Plannin9 Board in its review under the site plan regulations of the Zoning Code. 6. Grant of the alternative relief is the minimum action necessary and adequate enable the applicant to enjoy the benefit of a landscaping business, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The proposed grading of the stone blend parking area north east of the building should be modified slightly. A smalJ swaie or depression should be graded into the parking area with ~ow points established at the inlet grates of the proposed drainage pools. This item will not require a change in the plan itself, but the applicant should be notified that all runoff generated within the parking area shouM be directed into the proposed drainage poo~ and not a~owed to flow down in the direction of the transition buffer. The Town requires a coefficient of 60% for stone blend surfaces and 100% for asphalt pavement. Using these coefficients would increase the size of the drainage system req uired in "Area 2". It appears that one additional 8' diameter by 8' deep leaching pool should be provided. Drainage calculations and the site plan should be revised accordingly. The stone parking area should also be constructed with a %" blue Stone Blend. Recycled Concrete Aggregate is not permitted by code as a finish sun'ace material. The curb cut has also been reviewed with the highway superintendent. The new curbing proposed on the south side of the driveway that connects to the existing curb is permitted. The proposed curb on the north side of the drive should not extend out into the Town Right-of Way.
