Based on our determination the amount of removal would be approximately 74 SF limited to the reconstruction of the retaining wall and stairs necessary to make the descent of the bank safe for the home owner. The remainder of the structure is being repaired and is approximately 202 sf of repair work taking place. We do not believe this repair work would exceed 50%of the market value of the cabana and staircase. We have reached out to the Building Department for confirmation but may not receive an answer prior to 2pm today. 2. Reviewing the survey and the elevations,this could possibly be considered a bluff. Survey states bank. Typically our Site Plans rely on the licensed surveyor information, however based on the Definition in Town Code a Bluff slopes greater than 20%and has a height of greater than 20 Feet between the toe and top of bluff. Based on sheet WTL-02 the Bank is less than that as the Bottom starts at+6.6' Elevation and the Roof Deck which is above the Bank is noted at+23.3' This would make the Bank less than 16.7 feet tall and therefore should stay defined as a Bank.
