AMP Architecture on behalf of AJIT KUMAR & JENNIFER ECCLESTONE requests a
Wetland Permit for the existing two-story dwelling with entry stoops; to restore the
existing cabana with roof deck, cabana decking, steps with landings, and retaining wall
landward of cabana by replacing all footings under all structures with new, replace
northerly wood walk to cabana deck, replace southerly top landing with steps down to
cabana deck, replace cabana deck and steps down to a concrete slab at bottom of
bank; repair roof of deck above cabana with new roof membrane; replace all railings
with new; remove and replace in-place retaining wall landward of cabana; replace siding
on cabana; remove outdoor shower from cabana; existing steps to beach off bulkhead
to remain; install stepping stones landward of top of bank; install a drywell to contain
roof runoff; revegetate an approximately 2,057sq.ft. area throughout the bank face using
native species; and to establish and perpetually maintain a 623sq.ft. non-turf buffer
along the landward edge of the top of the bank. Located: 1490 Paradise Point Road,

Good Morning,
In further reviewing said application please provide this office with a determination of two items.
1. Given the scope of work proposed, is this considered a Demolition (as per Town Code Definition)? Based on
our determination the amount of removal would be approximately 74 SF limited to the reconstruction of the
retaining wall and stairs necessary to make the descent of the bank safe for the home owner. The remainder
of the structure is being repaired and is approximately 202 sf of repair work taking place. We do not believe
this repair work would exceed 50%of the market value of the cabana and staircase. We have reached out to
the Building Department for confirmation but may not receive an answer prior to 2pm today.
2. Reviewing the survey and the elevations,this could possibly be considered a bluff. Survey states bank.
Typically our Site Plans rely on the licensed surveyor information, however based on the Definition in Town
Code a Bluff slopes greater than 20%and has a height of greater than 20 Feet between the toe and top of
bluff. Based on sheet WTL-02 the Bank is less than that as the Bottom starts at+6.6' Elevation and the Roof
Deck which is above the Bank is noted at+23.3' This would make the Bank less than 16.7 feet tall and
therefore should stay defined as a Bank.
For both question please respond in writing your determination and how you came to each determination as soon as
possible.
If you could have this information by 2:OO13M today it would be helpful. Legal noticing to the local newspapers must be
submitted by end of day today.
