Located: 1490 Paradise Point Road, Southold. SCTM# 1000-81-3-20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the LWRP. 1. The as-builts do not meet policy 6.3 which supports the Boards authority and permit process. 2. The Cabana is an unpermitted structure on a bank usually subject to erosion and storm damage. 3. If approved, it is recommended to retain trees but allow "limbing up" to establish views if necessary. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Proposed restoration of cabana with roof deck, restoration of frame steps and landings, reconstruction of retaining wall, and proposed drywell. Proposed 623 sf. non-turf buffer at top of bank, proposed native revegetation at bank, approx. 2,057 sf., and proposed stepping stones w/40% open space 44 sf. Located: 1490 Paradise Point Road, Southold. SCTM#81-3-20 Inspected by: Carol Brown, Nancy May The CAC does Not Support the application because the area is environmentally unsound and the cabana is over 100 sf. Given the scope of work proposed, is this considered a Demolition (as per Town Code Definition)? Based on our determination the amount of removal would be approximately 74 SF limited to the reconstruction of the retaining wall and stairs necessary to make the descent of the bank safe for the home owner. The remainder of the structure is being repaired and is approximately 202 sf of repair work taking place. We do not believe this repair work would exceed 50%of the market value of the cabana and staircase. We have reached out to the Building Department for confirmation but may not receive an answer prior to 2pm today. 2. Reviewing the survey and the elevations, this could possibly be considered a bluff. Survey states bank. Typically our Site Plans rely on the licensed surveyor information, however based on the Definition in Town Code a Bluff slopes greater than 20%and has a height of greater than 20 Feet between the toe and top of bluff. Based on sheet WTL-02 the Bank is less than that as the Bottom starts at+6.6' Elevation and the Roof Deck which is above the Bank is noted at+23.3' This would make the Bank less than 16.7 feet tall and therefore should stay defined as a Bank. For both question please respond in writing your determination and how you came to each determination as soon as possible. If you could have this information by 2:OO13M today it would be helpful. Legal noticing to the local newspapers must be submitted by end of day today. 1 1 Elizabeth Cantrell Administrative Assistant Town of Southold Board of Trustees Phone: (631)765-1892 Fax: (631)765-6641 2 Glenn Goldsmith,President ¢ SO&P Town Hall Annex A.Nicholas Krupski,Vice President a`d 54375 Route 25 P.O.Box 1179 Eric 5epenoski / Southold,New York 11971 Liz Gillooly CA r Elizabeth Peeples ® Telephone (631) 765-1892 Fax(631) 765-'6641 C " EVE D BOARD OF TOWN TRUSTEES JUN 2 8 2024 DI TOWN OF SOUTHOLD This Section For Office Use Only Southold Town Coastal Erosion Permit Application Board of Trustees Wetland Permit Application Administrative Permit --Amendment/Transfer/Extension . Received Application: t}`Ytr- y Received Fee: $ 1- _ Completed Application: Incomplete: .
