Nicholas Krupski,Vice President e`0 �® P.O.Box 1179 Eric Sepenoski J�i Southold, New York 11971 Liz Gillooly rs' Telephone(631) 765-1892 Elizabeth Peeples • a� Fax(631) 765-6641 C®UN(Y,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD February 20, 2025 Kate Rummel Cole Environmental Services, Inc. 425 Montauk Highway East Quogue, NY 11942 RE: KIM & BRETT DOHNAL 1225 LONG CREEK DRIVE, SOUTHOLD SCTM# 1000-55-3-29 Dear Ms. Rummel: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, December 18, 2024 regarding the above matter: WHEREAS, En-Consultants on behalf of KIMA BRETT DOHNAL applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 5, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 18, 2024, again on November 13, 2024, and again on December 18, 2024, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of KIM & BRETT DOHNAL to construct a set of bank stairs off of permitted deck consisting of a 4'x7' Timbertech platform off deck to a 4' wide by approx. 24.5 linear foot long set of stairs with 36" high stainless steel cable guard railings; each step to be 12" deep and 7" high constructed with 4"x4" posts and open grate decking to be used on all treads; stairs not to extend seaward of mean high water; and existing pipe leading from southwest downspout to be abandoned with stormwater being rerouted to a perforated trenched pipe leading to a rain garden; and a 4' wide access path through the buffers for stair access and construction purposes; with the condition to establish and perpetually maintain a continuous vegetated non-turf buffer on the entire seaward side of the dwelling with a minimum of 7' from the top of bank on the northern side of the property; all as depicted on the site plan prepared by Cole Environmental Services, received on February 12, 2025, and stamped approved on February 13, 2025. As per the Board's comments,the plans have been modified to propose the stairs off the deck. Other locations were considered, however, based on preferences expressed by the Board on site,the proposed location allows for direct access off the deck in an area with a gentler slope than most of the bank. The stairs are more than 15' off the side property lines while also staying as far from the mucky area as possible. A small platform is proposed off the deck,which allows for access to the stairs without traversing the deck. The platform provides space to maneuver kayaks and carry them easily down the stairs. These locations, however, are too steep to achieve safe, elevated access. The contractor would need to disturb the bank to achieve both a safe slope and terminate before MHW. Additionally,trees would need to be removed on the bank to clear a path for the stairs. After considering multiple alternative locations,the proposed location was determined to be the best option for all parties. The proposed stairs are located in an area with a gradual slope. As such,the architect was able to modify the previous configuration and remove the upper portion of the stairs. This modification reduces the posts from eight(8)to six(6), minimizing disturbance. A 4' wide permeable walk will replace the upper portion of the stairs. Since the start elevation was modified to be lower and the distance to the beach is shorter,this allows for the stairs to be elevated and still terminate before MHW. While the proposed location is less than 15'from the property line,the stairs are elevated as per the Board's request, bank disturbance has been minimized, and no large trees need to be removed-all of which are more important environmentally.
