SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated May 7, 2024 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 29, 2024. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed 22.2 percent lot coverage on the parcel is contrary to fostering a pattern of development in the Town of Southold that enhances community character, setting a precedent in the neighborhood. PROPERTY FACTS/DESCRIPTION: The subject,non-conforming 9,105 square feet,.21 acre,rectangular-shaped, corner property, located in the R40 Zoning District measures 100.11 feet along Champlin Avenue, then runs south 93.79 feet along a marina located on Sterling Basin,then runs 100 feet west along a residentially developed lot to the south and returns 88.32 feet along Atlantic Avenue to Champlin Place. The subject parcel is developed with a 2- story,wood-frame dwelling with covered front porch,entry stoops,two masonry retaining walls creating a plinth for the house, and an accessory wood-frame garage with attached concrete patio and driveway, as shown on the survey prepared by Harold F.Tranchon, Jr., Licensed Land Surveyor, and dated September 17, 2021. t Page 2,September 5,2024 #7932, Betancourt SCTM No. 1000-34-5-2.1 BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's April 19, 2024, Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; at; 1) located in other than the code permitted rear yard; 2) more than the code permitted maximum lot coverage of 20%; located at: 1050 Champlin Place, (Adj. to Sterling Creek Basin)Greenport,NY. SCTM No. 1000-34-5-2.1. RELIEF REQUESTED: The applicant requests two variances for the construction of an accessory swimming pool measuring 18 feet by 40 feet, to be located in a front yard location, where accessory structures are limited by the Zoning Code to rear yard locations only, and, for final lot coverage of 22.2%where the Code limits lot coverage to a maximum of 20% in the R40 Zoning District. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on August 8, 2024 submitted a site plan, prepared by Louis Schwartz, Licensed Professional Engineer, dated August 7, 2024, reducing the pool size from 18 feet by 40 feet(720 square feet)to 16 feet by 36 feet(576 square feet),maintaining the proposed front yard location and reducing the proposed lot coverage from 22.2%to 20.6%. ADDITIONAL INFORMATION: The applicant provided a pool plan and schematics, prepared by Christopher Thomas Labate, License Professional Engineer, dated February 29,2024. Included in the application are the following Certificates of Occupancy for improvements on the subject lot: #Z-4299 dated July 28, 1971 covering the construction of an accessory garage. #Z-25526 dated January 23, 1998 covering the Pre-Existing one-family dwelling. #Z-43311 dated August 4,2022 covering `as built' window replacement, interior alterations,and a deck landing to an existing single-family dwelling. Prior Zoning Board of Appeals relief was granted to this parcel, under file#1415, dated April 15, 1971 allowing the construction of an accessory garage in a front yard location, where accessory structures are only permitted in rear- yard locations. The garage was constructed with a front yard setback of 24 feet, where the principal residential structure requires a minimum front yard setback of 35 feet and a secondary front yard setback of 20 feet. Accessory garages of any size, or similar structures located in a non-compliant front yard location, are NOT common to the immediate neighborhood. The amended site plan illustrates the 16 feet by 36 feet inground swimming pool to be placed at the corner intersection of two well-traversed roads, 15 feet off of both Champlin Place and Atlantic Avenue, where prior Board relief for this parcel allowed the construction of an accessory structure in a front yard location with a setback of 24 feet from the roadway. During the public hearing on August 1, 2024, the applicant stated that the property owner would be willing to reduce the size of the inground pool to 16 feet by 32 feet, not the 16 feet by 36 feet as amended, thereby removing the need for one of the two variances (lot area) requested. The amended site plan did not reflect this discussion. The applicant illustrated that the subject parcel contains a difficult terrain ranging from 50% level to 20%moderate slope, to 30% steep slope, as evidenced by prior relief granted under file #1415. While not specified in the relief granted under appeal #1415, it was noted that the subject parcel contains a difficult slope and a shift in the terrain. The only `level' and undeveloped remaining location on the parcel is the front yard at the intersection of two roadways. As a result of the site's difficult topography, locating an inground swimming pool in a compliant rear yard location would also require Town of Southold Board of Trustees approval and potentially,authorization from the Department of Environmental Conservation as a result of its location close to Sterling Creek. The site is improved with retaining walls to support existing structures. F Page 3, September 5,2024 #7932, Betancourt SCTM No. 1000-34-5-2.1 The applicant provided nine(9)examples of prior relief granted by the Zoning Board of Appeals for variances relative to non-conforming setbacks, including one (1) for each lot coverage and/or other than compliant locations for accessory structures including file #'s: 7127, 6736, 5142, 4084, 4867, 1415, 7660, and 7367. In actuality, the applicant provided file#7367 twice and included relief on the subject parcel,#1415(garage in a front yard)in support of their application. The examples provided did not include Zoning Board of Appeals relief for the construction of an inground swimming pool in the front yard. No member of the public, or an immediate neighbor, spoke in favor of, or against,this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1, 2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject neighborhood consists of single-family homes in a suburban setting,predominately developed in the early 20t'century and many,recently updated to meet the needs of contemporary living. While most lots in the immediate vicinity are not code-conforming, relief has been granted to allow front,rear,side or combined side yard setbacks for the expansion of the primary residence or for the placement of an accessory building with reduced setbacks in compliant locations. Only in one case,file#1415(subject property; relief granted in 1971) did the applicant provide an example of an accessory structure being placed in a non- conforming front yard;the applicant's garage,not a pool. There are no known inground(or above ground)swimming pools in the area that have received Board relief for similar placement. Pools are not commonly found in this densely developed, small scale neighborhood, although one exists immediately across the street. This particular pool, uncommon to the neighborhood,was built with a building permit and did not require Zoning Board of Appeals relief since it is attached to the principal residence. Furthermore, both Champlin Place and Atlantic Avenues are well- traversed roads serving the entire community as a means to avoid Main Road traffic and to access the local hospital. The proposed inground swimming pool at an active corner location is not consistent with the community character of the immediate neighborhood 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue,other than an area variance. The applicant can locate the proposed inground swimming pool in a compliant rear yard location, free of a sanitary system as the result of the property being serviced within the Greenport Sewer District and reduce it in size, or attach it to the existing dwelling, to avoid the need for variance relief. While the property is encumbered with substantial shifts in terrain,the site is improved with retaining walls to level the ground around the house and a compliant pool can be placed in a similar fashion. 3. Town Law 4267-b(3)(b)(3). The variance for the pool to be located in a front yard location is mathematically substantial, representing 100% relief from the code. The variance for excessive lot coverage of 20.6%, as amended, is not mathematically substantial representing less than 3%relief from the code.It is uncommon and not characteristic of the community to place an inground swimming pool in a front yard location on a non-waterfront property. It has been shown that lot coverage, over the allowable 20%, is common, on similar small, less than code conforming lots, within the immediate neighborhood; however, not for the placement of an inground swimming pool in a front yard location with the benefit of an area variance for excessive lot coverage, no matter how de minimus the application may be. 4. Town Law 4267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The application has been determined to be LWRP INCONSISTENT. Page 4, September 5,2024 #7932, Betancourt SCTM No. 1000-34-5-2.1 5. Town Law 4267-bQ(b)(5). The difficulty has'been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an inground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
