That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said Permittee will, at his or her awn expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to :pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold 8. That the said Board will be notified by the Permittee of the completion of the work auth- orized. 9. That the Permittee will obtain all other permits and consents'that may be required sup- plemental to this permit which may be subject to revoke upon failure to obtain same. Elizabeth Croake and I have sold our.house, property and dock to our next door neighbor, John Sideris. Closing date; Sept. 12, 1988. The Sideris family, as long time owners of property on the Lida Bartley Farm, have to date not exercised their right to a mooring on James Creek, although they have had access to ours and their boat is in place now at mooring #285. At this time we request that the mooring and dock-.permit both be transferred to John Sideris since he is .the new owner of our property and dock as of 9/12/88. John Sideris is enclosing the permit renewal fee of $15.00.. , If an additional. application fee is necessary please notify him at P.O. Box 1541, Mattituck, NY 11952, and I am sure he will comply.. This is based on information 1•have gathered from the previous owner, neighbors, current dock owner Dan Bassey and those boaters With moorings at the,creek—all of who are in agreement that the dock is associated with _ my property and has been for over 40 years. In addition, there are references to the, dockand rights to maintain one in-documentation associated'with,the previous sale. A description of the property is as follows comer property location on what was originally a larger parcel of land known as the estate of Lida Bartley. The property contains both a house, 2490(2460) Bay Avenue'and a cottage with a separate address on the,side block, 13 Bartley Road. The person who sold me the property- John Sideris-(along with his sister Eva Philippou as co-owners)does have a creek mooring there and explained to me that it is not transferable. However, John did have a fixed — wooden dock at the creek, ownership of which he stated heseceived with the purchase of the house. Additionally, 1 obtained through the realtor at the time of sale, a ryder attached to the seller's original deed which states docking rights (Note#2 on fax as follows, my copy here.is blurry I will fax to you — "Included with the property is existing authorization to place a dock of the right of-way known as Rochelle place at James Creek. You were provided with the necessary documentation to effectuate the transfer on the village records at the closing of.title." This transaction was the sale of 2490 (2460) Bay Avenue from co- owners Virginia Van Bokkelin and Elizabeth A. Croate in 1988 to John Sideris and his sister Eva Philippou as co-owners. Perhaps there is some record of this dock with the original owner of the property—Pileski(who sold the property to Virginia Van Bokkelin . and Elizabeth A. Croate in the early 1970's). Additionally, the neighborhood knows this dock to be attached to the property going back well over 40 years. To restate-the*house I purchased was co-owned by John Sideris and his-sister Eva, who had a failing out and were forced to self the house as a result(I believe this was a court imposed settlement). Noteably, John's sister remembered there being a dock as part of the property but she did not have the paperwork as her brother John managed. the property as a year round rental and used the dock for himself—indeed she agreed in writing that John and herself.relinquishany and all future rights to the dock in question upon the sale of the house to me. would like to have this dock repaired and officially recognized as owned by me as the neighborhood is in agreement that it belongs to my property- 1 can provide signatures of the residents upon request. . can be reached at 212 916 6062 during the day as well as my cell phone,--917 446 9811 at all times. The subject dock is located at the far right of the site and was last registered to John Sideris - former owner of my property located at the corner of Bay Avenue and Bartley Road (a private road) . My Address is 2490 (2460) Bay Avenue (main house) along with. 13 Bartley Road, (cottage)'. When I purchased the property John Sideris signed over to me any and all transferable rights to maintain a dock at the right of way known as Rochelle Place - this is recorded in the deed of sale (Lauren Standish has a copy of this document) . I would like to renew the permit in my name to use the dock and make repairs to the catwalk. I have a new 15' Boston Whaler with no plans to move to a larger boat and the dock would not need to be enlarged, also there are no boats placed to the right of the dock so there is ample room.
