SUBMISSION REQUIREMENTS 1. The applicant or agent shall submit'the following documents to the New York State Department of State, Division of Coastal Resources,41 State Street-8th Floor,Albany,New York 12231. a. Copy of original signed form. b. Copy of the completed federal agency application'. c. Other available information which would support the certification of consistency. 2. The applicant or agent shall also submit a copy of this completed form along with his/her application to the federal agency. 3. C.N0FFICE\WPW1MWPD0CSIfcaf2 (revised 10/15/99) Responses to Coastal Policies Applicant: Fishers Island Ferry District Location: Foot of Fox Lane, Fishers Island Maintenance Dredging Project F.3. The project is located in a State designated Tidal Wetlands and therefore must be consistent with Policy#44. The project does not involve the placement of depositing of debris or fill.into any area of tidal wetlands. The area where the proposed dredging is to take place in an existing channel where the depths are currently -12.40' - 17.40'ALW. According to the N.Y.S.D.E.C.'s Tidal Wetlands Inventory Maps "L.Z. Littoral Zone"- The tidal wetland zone that includes lands under tidal waters which are not included in any other category. There shall be no Littoral Zone under waters deeper than 6' at Mean Low Water." The project should not negatively impact those benefits derived from the preservation of tidal or freshwater wetlands. Those benefits include recreational opportunities, erosion, storm and flood control, natural pollution treatment, habitat for fish, shellfish or wildlife. It is felt that this project is consistent with this Policy. The project involves maintenance dredging and therefore must be consistent with Policy# 15 and Policy# 35. The project is consistent with Policy# 15 because the dredging shall not significantly interfere with the natural coastal processes which supply beach materials for adjacent lands and will not cause an increase in erosion of said lands. The project is consistent with Policy#35 because the proposed dredging and the disposal of the resultant spoil shall be undertaken meeting State permit requirements and will not impact significant fish and wildlife habitats, scenic resources, natural protective features, vegetated wetlands or agricultural lands. Since the project site is located adjacent to a State designated significant fish and wildlife habitat (Fishers Island Sound) it must be consistent with Policy V. The project is consistent with this Policy because the maintenance dredging shall not cause a change in substrate composition, there are no contaminants present that would be released for the sediments, no aquatic vegetation shall be removed and circulation patterns and sediment transport mechanisms shall be impacted. The dredging shall not cause any change to physical biological or chemical parameters at the project site. Since the proposed project shall require a State Water Quality Permit, the project must be consistent with Policy#30,Policy#38 and Policy#40. Policy#30 is not applicable to-this Policy since the project does not involve the discharge of any pollutants into coastal waters. Policy##3 8'is not applicable to this project because the project does not involve surface water or groundwater supplies. Policy#40 is not applicable to this project either since the project does not involve the discharge of effluent into coastal waters. Policy #2- The project involves the maintenance dredging of an existing channel leading to and from an existing ferry terminal. The purpose of the dredging is to insure safe navigation to the ferry docking facility which is considered water-dependent. The project is consistent with this Policy. Policy#21- The existing ferry terminal is considered a water-dependent use and therefore, this project is consistent with this Policy. Policy#22- The project as proposed-requires a waterfront site'and therefore must be consistent with this Policy. Policy 2- It is felt that this Policy is not applicable to this project since the proposed maintenance dredging will have no impact on any historic and archaeological resources of the Town of Southold. Policy 3- It is felt that this Policy is not applicable to this application since the project shall not involve the visual quality or scenic resources of the Town of Southold Policy 4-It is felt that this Policy is not applicable to this project because the project does not involve the construction of erosion of flood control devices. Policy 5-It is felt that this Policy is not applicable to this project because the project shall have no impacts on potable water quality or supply. Policy 6- The project as proposed should have no impact on certain natural . resources that contribute to the quality and biological diversity of the Town's ecosystem. The project(maintenance dredging)-of an existing dredged channel shall have a short(the duration of the actual dredging) one time impact on bethic communities while dredging when turbidity shall take place. In keeping in mind with the types of substrate to be dredged (sand and cobble)the amount of turbidity shall be lessened because of the heavy substrate as well as the fact of the currents in the area of the dredging shall quickly disperse any turbidity. Other regulatory agencies (N.Y.S.D.E.C. and U.S.D.O.A.)which are reviewing this project will place dredging "windows" on the project to protect such species such as the Winter Flounder, Ospreys and Piping Plovers. It is felt that this project is consistent with this Policy. Policy 7-It is felt that this Policy is not applicable to this project since the project shall have no impact upon air quality in the Town of Southold. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. General. This structure may include, but is not limited to, installation of a siltfence, hay bales, wood chip berm and silt booms. Policy 3- It is.felt that this Policy is not applicable to this application since the project shall not involve the visual quality or scenic resources of the Town of Southold. Policy 4- It is felt that this Policy is not applicable to this project because the project does not involve the construction of erosion of flood control devices. Policy 5- It is felt that this Policy is not applicable to this project because the project shall have no impacts on potable water quality or supply. Policy 6- The project as proposed should have no impact on certain natural resources that contribute to the quality and biological diversity of the Town's ecosystem. Those natural resources include freshwater wetlands, rare and endangered species and designed Significant Coastal Fish and Wildlife Habitats. The project (maintenance dredging) of an existing dredged channel shall have a short(the duration of the actual dredging) one time impact on bethic communities while dredging when turbidity shall take place. In keeping in mind with the types of substrate to be dredged (sand and cobble) the amount of turbidity shall be lessened because of the heavy substrate as well as the fact of the currents in the area of the dredging shall quickly disperse any turbidity. Other regulatory agencies (N.Y.S.D.E.C. and U.S.D.O.A.) which are reviewing this project will place dredging "windows" on the project to protect such species such as the Winter Flounder, Ospreys and Piping Plovers. it is felt that this project is consistent with this Policy. Policy 7- It is felt that this Policy is not applicable to this project since the project shall have no impact upon air quality in the Town of Southold. Policy 8- It is felt that this Policy is not applicable to this project since the project does not involve solid waste or hazardous substances and wastes. Policy 9- It is felt that this Policy is not applicable to this project because it will not impede public access to and recreational use of coastal waters, public lands and public resources of the Town of Southold. Policy 10- The project involves the maintenance dredging of an existing channel providing access to and from an existing ferry terminal. A ferry terminal is considered a "water-dependent" use. According to Policy Standards 10.1 (a) "Existing uses should be maintained and enhanced where possible and appropriate." It is felt that the project is consistent with this Policy. Policy 11- The project as proposed and with the proper dredging "windows" assigned to it shall not have negative impacts upon native stocks or populations of indigenous species of fish and wildlife, shall have no impact upon the commercial and/or recreational use of the Town's finfish, shellfish, crustaceans and marine plants. It is felt that this project is consistent with this Policy. Policy 12- It is felt that this Policy is not applicable to this project since the project does not involve agricultural lands. Policy 13- It is felt that this Policy is not applicable to this project since the project does not involve the use or development of energy or mineral resources.
