A regular meeting of the Southold Town Board of Appeals
was held 7:30 P.M., Thursday, April 6, 1961, at the Town Clerk
Office, Main Road, $outhold, New York.
There were present: Messrs. Robert W. Glllispie, Jr.,
Chaiza~ln, Robert Bergen, Herbert Rosenberg, and Serge doyen, Jr.
Absent: Mr. Charles ~rigonis, Jr.

for this application?
MR. HEI~gOT HASS, Main Road, West Greenport, New York~ Every-
thing is on the application. There should be a directional sign
to the motel when they people reach Route 27A from Albertson Lane.
We need it badly. The people do not know which way to turn.
usually they don't want to turn back toward the city. If they
had a directional sign they would khow the motel is just down
the road a short way.
MR. ROSENBERG: Why is this sign to be so big?
MR. HASS: I am making it the same size as the Silver Sands
motel sign. I made a pattern of their sign. It won't be over
50 sq. ft. We need the area to attract attention.

RESOLVED that Helmut Hass, a/c Southold Town Beach Motel be
granted permission to erect and maintain directional sign on the
property of Alfred Teves, north side North Road at Albertson Lane,
(Arshamomaque), Greenport, New York. Sign size shall not exceed
50 sq. ft. in area and exterior dimensions shall be no greater than
6 ft. 6 in. by 12 ft. 6 in. and shall be located at least 5 ft.
from the property line and lower edge at least 4 ft. from the ground
level.
This sign is subject to the same regulations and controls
which affect non-conforming signs.

with the Zoning Ordinance, Article III, Section 300, Subsection 11,
for pexmission to erect and maintain directional sign on the
property of J. Wickham Estate, north side Main Road, west side
Albertson Lane, (Arshamomaque), Greenport, New York. Fee paid
$15.00.

believe the application speaks for itself. We need something to
get the people to turn at Albertson Lane when they come from the
information booth at Greenport, and also when they are coming from
the west. I want this to be a double faced sign.

permanently injured and the spirit of the Ordinance will be observed,
therefore be it

granted permission to erect and maintain directional sign on the
property of J. Wickham Estate, north side Main Road, west side
Albertson Lahe, (Arshamomaque), Greenport, New 'fork. Sign size
shall not exceed 50 sq. ft. in area and exterior dimensions shall
be no greater than 6 ft. 6 in. by 12 ft. 6 in., and shall be
located at least 5 ft. from the property line on Albertson Lane
and at least 20 ft. from the property line on Route 25 and lower
edge at least 4 ft. from the ground level.
This sign is subject to the same regulations and controls
which affect non,conforming signs.
The Board has dete~mined that the safety and traffic would
not be affected by the location of this sign, and at the suggestion
of Mr. Anderson of the State Highway Department, the 20 ft. set-
back from the State Highway was provided because the State may
change this intersection from a stop street intersection to a
y~eld type intersection.

Mr. Hass discussed other signs that he presently has and
some that he contemplates erecting.
PUBLIC HEARINGs Appeal No. 348 - 8=00 P.M. (E.S.T.), upon
application of Otis Horn, private road off Oriental Avenue,
Fishers Island, New York, for a special exception in accor~_ance

with the Zoning ordinance, Article X, Section 1007, Subsection (e),
for permission to replace a non-conforming accessory building. Lo-
cation of property~ private road off Oriental Avenue, Fishers
Island, New York, bounded north by West Harbor, east by Fishers
Island Estate~, south by Fishers Island Farms, and west by J~mes
V. Thurrott. Fee paid $15.00.

to its publication in'the official newspaper, and letters from
adjoining property owners stating their approval.
THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR. DOYEN= The proposed building will be located 13 ft. from
the rear yard line and will be 50 ft. by 12 ft. Mr. Horn is going
to remove the old buildings when this new one is erected. I called
Mr. May, President of the F/shers Island Estates and asked if he
had any objection to the building and he said he had none whatsoever.

~ CHAIRMAN~ From what I understand of the situation, the
applicant wishes to replace two old buildings, which had been used
as dog kennels, with a new modern building 12 ft. by 50 ft. which
will be located in the rear yard area of the applicants pro~ty.
It is our understanding that upon completion of the new building
he will destroy or remove the old buildings. He also has received
letters of consent from both of his nearby neighbors, Robert
Waddington, Jr. and James V. Thurrott and Lillian H. Thurrott.
MR. DOYEN~ In area he is not actually expanding. The actual
floor space will be no more than the existing buildings.

Resolution was offered by Mr. Bergen, seconded by Mr. Rosenberg,
WHEREAS application of Otis Horn having been considered at Public Hear-
ing No. 348 on April 6, 1961, and the Board finding that the public
convenience and welfare and justice will be served and the legally
established or permitted use of the neighborhood property will not
be substantially or permanently injured and the spirit of the
Ordinance will be observed, therefore be it
RESOLV~ that Otis Horn be granted permission to replace non-
conforming accessory buildings with a new building 12 ft. by 50 ft.
This building to be located approximately 30 ft. from the northerly
property line and 13 ft. from the easterly property line. It is
stipulated that upon completion of the proposed kennel building,
the old buildings shall be destroyed or removed from the property.
The Board finds that this use will not prevent the reasonable
use of adjoining property~d in fact the neighbors have expressed
their approval of the proposed improvement. Further, the health
and welfare of the Town will be favorably affected by the proposed
improvement. It should be noted that Mr. Horn's deed permits him
to engage in this activity even though this is a highly restricted
residential area.
The Board also draws a distinction between the so-called
professional uses outlined in Article III, Section 300, Subsection
8 and the applicants Occupation which is the care and training of
dogs.
Vote of the Boards Ayes:- Mr. Gillispie, Mr. Bergen, Mr.
Rosenberg,and Mr. Doyen.
Mr. Tom Stark, Rlverhead, New York appeared before the Board with
Mr. and Mrs. William Victoria, for an informal discussion. In 1955
Mr. and Mrs. Victoria purchased 12 acres fronting on Bay View
Road, Southold. In 1955 they constructed 10 small cottage units
which they have been operating since 1956. When the Town Board
zoned Southold Town they did not make the Victoria property#B"
Business. Last Year Mr. and Mrs. Victoria decided they might
wish to expand their operation on the property and an architect
and engineer reco,~ended to them that another single building with

10 apartment units, rather than constructing any more cottages.
Last fall Mrs. Victoria approached the Town Board for a change
of zone from "A" Residential and Agricultural District to "M"
Multiple Residence District which the Town Board declined and
the Victoria's learned the reason was that it is quite a large
area in a residential zone to be changed to "M". After the
Town Board hearing Mrs. Victoria came before the Board of Appeals
seeking relief.
Mr. Gillispie explained that at the time of zoning the Town
there was no "M" Multiple Residence District and it would be a
matter of zoning the entire area "B" Business which would have
permitted any type of enterprise. Mr. Stark cited Article X,
Section 1007, Subsection (a), stating that he felt the Board
could grant a special exception under that section. It was
pointed out to Mr. Stark that what he was asking for was
permission to construct a non-conforming use in an "A" Zone
a%d the Board of Appeals has no authority to permit an "M"
use in an "A" zone.
After considerable discussion Mr. Stark advised he would
return to the Town Board for a change of zone from "A" to "M"
on a smaller tract of land rather than the 12 acres requested
previously.

application of Rev. Alphonse Cezmowski, a/c Our Lady of Ostrabrama
Church, Depot Lane, Cutcho~ue, New York, to erect and maintain
directional advertising sign on the premises of J. Henry Wolfe,
south side Main Road, opposite Depot Lane, Cutchogue, New York.
No fee required.

THE CHAIRMAN~ Where on Depot Lane is the church?
MR. DROSKOSKI~ It is about one-half way down Depot Lane
between Route 25 and Route 27~. The sign will be on the property
of Henry Wolfe across the street from Depot Lane on Route 25.
(There was a discussion relative to the size of the sign
and it was felt 3 ft. by 4 ft. as requested would not be large
enough for the wording and the Board felt the application should
be /ncreased to the maximum size of 6 ft. 6 in. by 12 ft. 6 in.
if he desired.)

350 on April 6, 1961, and the Board finding that the public
convenience and welfare and justice will be served and the
legally established or permitted use of neighborhood property
will not be substantially or permanently injured and the spirit
of the Ordinance will be observed, therefore be it
RESOLVED that Rev. Alphonse Cezmowski, a/c Our Lady of
Ostrabrama Church be granted pe~ission to erect and maintain
a double faced directional advertising sign on the property of
J. Henry Wolfe, south side Main Road, opposite Depot Lane,
Cutchogue, New York, approximately 18 ft. southerly of New York
Telephone Company Pole No. 150. Sign size shall not exceed 50
sq. ft. in area and exterior dimensions shall be no greater
than 6 ft. 6 in. by 12 ft. 6 in., and shall be located at least
5 ft. from ~he easterly property line and 3 ft. above ground
level.
The Board finds that a larger sign than the requested 3 ft.
by 4 ft. would be in the interests of safety because a small
sign with a great deal of wording would tend to create a traffic
hazard.

my remarks of the previous hearing to apply to this hearing. This
sign is to be on the property of John Krupski.
THE CHAIRMAN~ Is this sign to be the same type of sign as
applied for under the previous application?
MR. DROSKOSKI~ Yes.

at the intersection with relation to the placement of this sign.)

RESOLVED that Rev. Alphonse Cezmowski, a/c Our Lady of

John Krupski, south west corner Depot Lane and Middle Road,
Cutchogue, New York, at least 30 feet west of the property line
on Depot Lane and at least 20 ft. south of the property line on
Middle Road (Route 27A). Sign size shall not exceed 50 sq. ft.
in area and exterior dimensions shall be no greater than 6~.

THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR. JOSEPH DROSKOSKI, Southold, New York: I would like my
remarks of the previou~ hearing to apply to this hearing. The
sign will be on the property of Mary Kujawski, Bay Avenue and
Leslie Road, Cutchogue, New York.
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(There was no response.)
THE CHAIRMAN: What is the purpose of this sign off the Main
Road, it certainly is not for transients. Anyone coming from the
east or west would pass the sign on the Wolfe property or the sign
on the Krupskilxoperty. Also, this sign would be in a residential
area, there are several developments down that way.
MR. DROSKOSKI: Possibly it was intended to attract the
attention of the residents in that area and also visitors they
might have.
THE CHAIRMAN: The Board does not feel it would be particularly
suitable to have a sign location in that area, a mile from the Main
Road, and in the opinion of the Board it would not attract summer
visitors and transients.
We will postpone decision and ask that Mr. Droskoski explain
to the Rev. Cezmowski the Board's objection to this sign location.
On motion of Mr. Doyen, seconded by Mr. Berge$,it was
RESOLVED that hearing upon application of Rev. Alphonse
Cezmowki, a/c Our Lady of Ostrabrama Church be recessed until
the next regular meeting of the Board of Appeals.

Mr. John Glander, Grathwohl Road, New Suffolk, appeared before
~e Board of Appeals for an informal discussion. Mr. Glander's wife

wishes to have a bridal consultant business in her home. She
would take order s from sample dresses and give advice on bridal
matters. She does not wish to have signs or window displays,
nor will there be any advertising in the local newspapers.
Advertising would be by personal contact and through information
secured from the newspapers.
The Board determined that this is a permitted use of the
premises under Article III, Section 300, Subsection 8, "uses
customarily incidental." Mr. Glander was instructed not to
advertise on the property nor display in the window. The only
sign permitted is a 2 ft. by 3 ft. sign bearing the name and
occupation (words only) of the practitioner.
Mr. Robert Ketcham, Jr., appeared before the Board for an
informal discussion. Mr. Ketcham had ~ mind taking over the
Greenport Lumber Company advertising sign located east of Albertson
Lane on Route 27A, Greenport, and renting it to local motels and
restaurants as a directional sign. Mr. Ketcham was advised that
the sign is non-confo~ing and if the business discontinues then
the sign would have to be removed. If Mr. Ketcham wished to
secure that site he would have to go through the usual procedures
of applying for a special exception.
Mr. Ketcham discussed with the Board the possibility of a
lumber yard making a sign to be displayed at the site of a new
building advertising the lumber company and the builder. The
Board advised that this would ~efinitely be out of order, and
the signs the builders present,se are only temporary signs
and must be removed at the time ofcompletion of the building.
The primary purpose of the signs is to aid delivery trucks in
finding the correct lot.
Mr. Ketcham next spoke to the Board with reference to per-
mission granted the Booth House for the erection of a~rectional
sign on the property of Fismer on Route 25, east of Bay Home Road,
Southold. The Booth House has now decided they do not want the
sign location and Mr. Ketcham would like to rent it to someone
else for a year. The Board advised Mr. Ketcham that he would
have to reapply for a special exception if someone other than
the Booth House uses the location.

Walsh, Montauk Avenue, Fishers Island, New York, for a variance
in accordance with the Zoning Ordinance, Article III, Section 300,
Subsection 7, for permission to locate private garage with reduced
setback. Location of property= south side Montauk Avenue, Fishers
Island, New 'fork, bounded north by Montauk Avenue, east by Annie
Daniels & Davis, south byA. J. Walsh, and west by right-of-way.
Fee paid $15.00.
The Chairman opened the hearing by reading letter of dis-
approval issued by the Building Inspector, application for a
variance,legal notice of hearing and affidavit attesting to its
publication in the official newspaper.
THE CHAIRMAN~ Is there anyone present who wishes to speak
for this application?
MR. HO~RD TERRY, Building Inspector: After looking the
situation over I do not believe he has much choice but the
location chosen. The sight line will not interfere with any-
thing because of the setback of the other buildings there.
THE CHAIRM~N~ Is there anyone present who wishes to speak
against this application?
(There was no~sponse.)
MR. BERGEN: I believe they should be required to back into
the gaXage because of the traffic hazard involved if they back
into traffic.
MR. TERRY~ I do not think putting up a garage will cut down
his sight line more than 3 ft. from what he has now over the bank.
There is an area dug out of the hill that he parks his car in now.
(The location of the proposed garage was thoroughly discussed.)
Resolution was offered by Mr. Rosenberg, seconded by Mr.
Bergen, and carried, WHEREAS application of Arthur Walsh having
been considered at Public Hearing No. 349 on April 6, 1961, and
the Board finding that strict application of the Ordinance would
produce undue hardship because applicant cannot locate garage in
the rear yard area because the house is built in the rear of the
lot which tapers to 47.4 ft. The present excavation on the front
of the lot was completed prior to Zoning and has been used for

parking the car since that time. The hardship created is unique
and would not be shared by all properties alike in the immediate
vicinity and in the same use district because this is the only
lot in the area with such unusual terrain. The variance does
observe the spirit of the Ordinance and would not change the
character of the district because other buildings in the area
have approximately the same setback and appearance, therefore
be it
P~SOL¥~U that Arthur Walsh be granted permission to locate
private garage with a 3 ft. setback from~he northerly property
line on Montauk Avenue and no close than 2 ft. to the easterly
property line.
The Board finds that due to the unusually rocky terrain
surrounding the proposed garage site and also due to the fact
an excavation had been made prior to the enactment of the Zoning
laws in the Town, that granting this variance is justified. It
is the feeling of the Board that it will not change the character
of the neighborhood because the buildings to the west are as close
as one foot to the property line and the area is zoned "B" Business.
It is also the Board's belief that unless extreme care is
used in entering and exiting from this garage that a traffic
hazard may be created.
Vote of the Board~ Ayes:- Mr. Gillispie, Mr. Bergen, Mr.
Rosenberg, and Mr. Doyen.

Catholic War Veterans, Post No. 730, Greenport, New York, for
a variance in a ccor~ance with the Zoning Ordinance, Article II,

Section 202, for permission to operate a temporary amusement
