RESERVING A LIFE ESTATE FOR THE BENEFIT OF KATHLEEN LAKE.
THE GRANTOR HEREIN RESERVES A LIFE ESTATE in the premises and further
reserves the power to appoint,in whole or in part,the property conveyed hereunder to or for
the benefit of any one or more persons with the exception of the Grantor, the Grantor's
estate, creditors of the Grantor or creditors of the Grantor's estate in such proportions,
outright or upon such trusts, terms and conditions as the Grantor may specify by any
acknowledged writing. Failure to record notice of any such exercise of this power in the
Suffolk County Clerk's Office within sixty (60) days of-the Grantor's death shall be
conclusively treated as a default in the exercise of power. A release of the power reserved
hereunder, in whole or in part, shall be effective when recorded with the Suffolk County
Clerk's Office. Any exercise or release of the foregoing power may be made by the
Grantor's attorney-in-fact,acting under a durable power of attorney
BEING AND INTENDED TO BE the same premises conveyed to Grantor,by Deed dated
August 19, 1985 and recorded in the Suffolk County Clerk's Office on September 25, 1985
in Liber D9880 at Page 334.
Together with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
Together with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
To have and to hold the premises herein granted unto the party of the second part,the heirs
or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be applied first for the purpose of
paying the cost of the improvement and will apply the same first to the payment of the cost
of the improvement before using any part of the total of the same for any other purpose.
