There were present~ Chairman, Robert Bergen, Jr. Messrso Robert W. Gillispie, Jr., Herbert Rosenberg and Charles Grigonis, Absents Mr. Serge Doyen, Jr. PUBLIC FR.%RING~ Appeal No. 360 - 7~30 P.M. (E.D.S.T.), upon application of Frederick E. Gordon, Fifth Street, Greenport, New York, a/c Louis Wagner, Bay View Drive, East Marion, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 304, for permission to reduce front yard setback. Location of property~ north side Bay View Drive, East Marion, New York, Lot 39 and part of 40, Section 2, Gardiner~ Bay Estates. Fee paid $15.00. THE CHAIRMAN= Is there anyone present who wishes to speak for this application~ MR. FREDERICK E. GORDON, Fifth Street, Greenport, New York= I would like to possibly help it along if I could by showing you the sketch. The lot to the west which was mentioned also belongs to Rev. Wagner~ The lot to the east is very low and faces Orchard Lane and if anyone did build they would without a doubt face the house to Orchard Lane rather than Bay View Road. THE CHAIRMAN: What is on the other side ~ Bay View Drive? MR. GO~ON: There are several k muses there. THE CHAIRMAN: Is there anyone else present who wishes to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) THE CHAIRMAN~ Mr. Gordon, what is the width of the roads in Gardiner's Bay Estates? MR. GORDON: I believe 30 f~ THE CHAIRMAN: The people in Gardiner's Bay Estates wish these roads to be private to discourage speeders and so forth, so I guess Mr. Wagner knows what he is getting into with respect to the Ordinance. MR. GORDON, That is right. I also might state that if anyone in Gardiner's Bay wishes to build or add on they must submit their plans to the Gardiner's Bay Assoc!ation for their approval. THE CHAIRMAN~ What are other setbacks in the area? MR. GORDON: They are all irregular. Others are less than 26 ft. which Rev. Wagner is requesting. Southold Town Board of Appeals -3- May 11, 1961 application The Board finds that strict/of the Ordinance would produce practical difficulties or unnecessary hardship because the home is so constructed that without the addition in the front the complete layout of the house would not be suitable for a year- around home. The hardship created is unique and would not be shared by all properties alike in the immediate viuinity of this property and in the same use district because this home is the only building on this street and the owner owns the land to the west on which no future construction is planned. The variance does observe the spirit of the Ordinance and would not change the character of the district because in the entire subdivision of Gardiner's Bay Estates there is no definite setbacks on any of the present construction; therefore On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVR~ that Frederick E. Gordon, Fifth Street, Greenport, New York, a/c Louis Wagner, Bay View Drive, East Marion, New York, be granted permission to reduce front yard setback to no less than 2 6 ft. on Bay View Road, East Marion, New York, Lots 39 and part of 40, Section 2, Gardiner's Bay Estates.' Vote of the Board~ Ayes:~ Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grlgonis. PUBLIC ~R~RING: Appeal No. 357 - 7:45 P.M. ~E.D.S.T.), upon application of Claudio Giovanelll and Frederick L. Schultze, d/b/a "G & S" Service Station, Route 25, Greenport, New York, for permission to extend the time limit for securing building permit. Location of property: south side Route 25, Greenport, New York, bounded north by Main Road, east by Robert Brown, south by Railroad, and west by E. E. JohnSon. Fee paid $15.00. The Chailman opened the hearing by reading application for permissive use, legal notice of hearing and affidavit attesting to its publication in the official newspaper. T~E CHAIRMAN: Is there anyone present who wishes to speak for this application? LEFFERTS P. EDSON, ESQ., Southold, New York: The reason for the applicants not having applied during the permitted time Southold Town Board of Appeals -4- May 11, 1961 is that they had taken over an additional gas station during the year and as that acquisition had take~ some of their cash set aside for the new project, they were held up in starting this new gas station and public garage. T~E CHAIP~AN~ Is there anyone else present who wishes to speak for this application? (There was no response.) ~ CHAIRMAN= Is there anyone present who wishes to speak against this application? (There was no response. ) THE CHAIRMAN~ I do not believe the main purpose of the Board was that the structure was to be erected within a certain time, but that a blank check was not given so the applicants could sell the property for speculation, and so forth. What would the extension of time be that they would need? MR. EDSON~ I would presume an additional year. THECHAIRMAN~ Are there any other questions ? (There was no response.) The Board of Appeals finds that applicants failed to secure building pex.Lit within time limit which was set in special ex- ception granted March 10, 1960 under Appeal No. 257, due to the fact they were unable to complete procedures necessary prior to filing application for a building permit for the erection of a gasoline service station and public garage. They are now ready to begin constructi~. The Board further finds that the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts; that the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the proposed use is to be located or of pe~.~itted or legally established uses in adjacent use dis- tricts; that the safety, the health, the welfare, the comfort, the conven~nce or the order of the TOWn will not be adversely affected by the proposed use and its location; and the use will Southold Town Board of Appeals -5- May 11, 1961 be in harmony with and promote the general purposes and intent of the Ordinance, therefore On motion of Mr. Gillispie, seconded by Mr. Grigonis, it was RESOLVED that the time limit for securing building permit by Claudio GloFanelli and Frederick Schultze, d/b/a "G & S" Service Station, Route 25, Greenpo~t, for the erection of a publ~garage and gasoline service station at ~oute 25, Greenport, be extended for one year from the original expiration date of March 10, 1961, making the new termination date for filing application for a building permit March 10, 1962. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. PUBLIC FR~RING: Appeal No. 361 - 8:00 P.M. (E.D.S.T.), upon application of Robert Ketcham, Jr., Bay Lake Park, East Marion, New York, a/c Coronet Restaurant, Greenport, New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section g0, Subsection 11, for permission to erect and maintain directional sign on the property of A. W. Fismer Estate, south side Main Road, east of Bay Home Road, Southold, New York. Fee paid $15.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attestin~ to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? ROBERT KETCHAM, JR., Bay Lake Park, East Marion, New York: There isn't anything to add. The wording on the sign is all necessary. Without any of it the sign would be worthless. Charcoal Broil is sort of a trade mark of the Coronet. T~E CHAIRMAN: The sign you are requesting would be in the natureof an advertising sign rather than directional in~rmation for the traveling public. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) MR. BERGEN: Mr. Ketcham, do you own these signs and then rent them out? MR. KETCHAMz No, I just apply for the permit, put them up and then the customer pays me for the signs. THE C~AIRMAN~ Do you own any of these signs you erect? MR. KETCHAM~ No, I just sell them after I put them up. I do not rent any signs out. T~E C~AIRMAN~ With reference to the wording on the sign, the time 5~30 A.M. could be allowed because that is unusual and would be important to the traveling public. However, the only other wording that would be allowed would be~ the location in Greenport, Coronet Restaurant, and open 5z30 A.M. MR. KETCHAM~ I do not know if he would still take the sign if he has to eliminate charcoal broil, he feels that is most important in supplying the public. THE CHA~RMAN~ In May 1958 we startedgranting directional signs for restaurants, motels and hotels and not one has been granted anything that is not directional. Wou~ you like us to continue this hearing until next week so you can speak to the Coronet Restaurant again? MR. KETCHAM~ Yes, I would. On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that hearing upon application of Robert Ketcham, Jr. a/c Coronet Restaurant, Appeal No. 361, be continued until May 18, 1961. On moti~ of Mr. Glllispie, seconded by Mr. Rosenberg, it was RESOLVED that the Board of Appeals forward a letter to the Southold Town Board requesting the return to Mr. Lefferts P. Edson, the $15.00 fee for application for a special exception No. 358 dated April 14, 1961 made on behalf of Claudio Giovanelli and Frederick L. Schultze, d/b/a "G & S" Service Station. On April 24, 1961 Appeal No. 358~s withdrawn by Mr. Edson prior to its presentation to the Bc~rd of Appeal-. Vote of the Board~ Ayes=- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. (E.D.S.T.), upon application of Arnold and Mary Mitchell, Inc., Route 25, Orient, New York, for a special exception in accordance with the Zoning Ordinance, Article IV, Section 408, for permission to erect and maintain directional sign on the property of Gus A. Straussner, corner of North Road and Sound Avenue, Greenport, New York. fee paid $15.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing, affidavit attesting to its publication in the official newspaper, and letter of permission from the property owner Gus Straussner. TBE CHA/RMAN~ I took a picture of the area where you wish to erect your sign, and there are three billboards, another sign for the Townsend Manor Inn, one for Rhodos Pavilion, and one for the Lions Club. THE CHAIRMAN~ 90~ of the informstion you have in the proposed sign is considered advertising and would not be pe~a, itted. You are only permitted Orient point Inn, Restaurant, Hotel, and the number of miles and a directional arrow if you desire it. Such words as Seaview rooms, cocktail lounge, special luncheon are out. They are not in the way of directional for the traveling public. MR. MITCHELL: Could I have on the water? THE CHAIRMAN: I believe that would be permitted. (At this point Mr. Mitchell made a sketch of what he would have on the proposed sign and present it to the Board. The wording to be: On the water, Orient Point Inn, Restaurant, Hotel, with an arrow.) The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of the neighborhood property will not be substantially or permanently injured and the spirit of the Ordinance will be observed, therefore On motion of Mr. Gillispie, seconded by Mr. Grigonis, it was RESOLVR~ that Arnold and Mary Mitchell, Inc., Route 25, Orient, New 'fork, be granted permission to erect a directional sign on the property of Gus A. Straussner, corner of North Road and Sound Avenue, Greenport, New York. Sign size shall not exceed 50 sq. ft. in area and exterior dimensions shall be no greater than 6 ft. 6 in. by 12 ft. 6 in., and shall be located at least 5 ft. from Route 25 and approximately 102 ft. from Sound Avenue, and 4 ft. above the ground level, upper edge no higher than 15~. 6 in. from the ground level. The wording on this sign shall be: "On the Water, Orient Point Inn, Restaurant, Hotel," with a directional arrow. Number of miles maybe indicated. This sign is subject to the same regulations and control which affect non-conforming signs. Krupski, southwest corner of Depot Lane and Route 27A, Cutchogue, ~ew York. Fee paid $15.00. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of the neighborhood property will not be substantially or permanently injured and the spirit of the Ordinance will be observed, therefore On motion of Mr. Gillispie, seconded by Mr. Rosenberg, it was RESOLVED that Frederick C. Bernhardt, Bernhardt's Shore Motel, Depot Lane, Cutchogue, New York, be granted permission to erect and maintain directional sign on the property of John P. Krupski, Depot Lane and Route 27A, Cutchogue. Bernhardt, a/c Bernhardt's Shore Motel, Depot Lane, Cutchogue, New York, be granted permission to erect directional sign on the property of John P. Krupski, Oregon Road and Depot Lane, Cutchogue, New York. Sign size shall not exceed 50 sq. ft. in area and exterior dimensions shall be no greater than 6 ft. 6 in. by 12 ft. 6 in. in length, shall be located at the northwest corner of intersection of Oregon Road and Depot Lane and Duck Point Road, 8 ft. from the property line. This is a test well location. This sign shall be at least 4 ft. above the ground level and upper edge no higher than 15 ft. 6 in. from the ground level. This is an arrow sign with the words: "Bernhardt's ~tel." This sign is subject to the same regulations and controls which affect non-conforming signs. Sign shall be no greater than 50 sq. ft. in area and exterior dimensions mhall not exceed 6 ft. 6 in. in height by 12 ft. 6 in. in length, and shall be located at least 3 5 ft. from Elijah Lane and at least 5 ft. from the property line on Middle Road, and shall~.~be at least 4 ft. above the ground level and upper edge no higher than 15 ft. 6 in. from the ground level. Wording~ "Bernhardt's Shore Motel and Restaurant, Next Left Turn." This sign is subject to the same regulations and controls which affect non-conforming signs. Henry Wolf, south side Route 25, opposite Depot Lane, Cutchogue, New York. Fee paid $15.00. Bernhardt, a/c Bernhardt's Shore Motel, Depot Lane, Cutchogue, New York, be granted permission to erect and maintain directional sign on the property of J. Henry Wolf, Main Road at Depot Lane, Cutchogue, New York. Sign shal~ not exceed 50.sq. ft. in area and e~terior d~mensions shall be no greater than 6 ft. 6 in. in height by 12 ft. 6 in. in length, and shall be located at least 5 ft. from the easterly property line and at least 3 ft. south of the "Our Lady of Ostrabrama" sign. Sign shall be at least 4 ft. from the ground level and upper edge no higher than 15 ft. 6 in. from the ground level. Wording: "Bernhardt's Shore Motel and Restaurant, Turn Left." This sign is subject to the same regulations and controls which affect non-conforming signs. Vote of the Boards Ayes~- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. Mr. Walter Grabie next spoke to the Board in connection with the public hearing to be held at 9:00 P.M. this date on his appeal for a special exception. Mr. Grabie stated that he had decided to put the sign where it belonged and if he would Southold Town Board of Appeals -14- May 11, 1961 still be permitted to do that if he is denied permission to put the sign closer to the property line than 5 ft. The Chairman advised that if he is denied permission he will still be able to erect a sign complying with the requirements of the Ordinance. The Chairman then asked Mr. Grabie if he still wished the Board to proceed with the hearing and he said yes. PUBLIC ~R~-~ING, Appeal No. 367 - 9,00 P.M. (E.D.S.T.), upon application of Walter Grabie, Main Road, Mattituck, New York, for a spec ial exception in accordance with the Zoning Ordinance, Article IV,'Sectlon 408, for pe~lssion to locate sign with reduced setback. Location of property, (property of Silkworth) Grabie Appliance Store, south side Main Road, Mattituck, New York. Fee paid $15.00. The chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attest- ingto its publication in the official newspaper. THE CHA/RMAN, Is there anyone present who wishes to speak for this application? MR. ~ALTER ~ABIE, Mattituck, New York~ I have never seen anyone walk the full length of the sidewalk, so I don't think it would be in anyones way. If I put it where the Ordinance requires it would stick out where cars and trucks drive in and ou~ and cause a hazard and cut down the size of the parking field. THE CHAIRMAN, The main objections to locating the sign closer than 5 ft. are~ 1. The affect that the location of the sign will have upon undue increase of vehicular traffic con- gestion. The affect it would have on people trying to come in and go out of the parking lot. The affect it would have on vi~ibility of people traveling east from the city. 2. Mr. Anderson of the State Highway Department has specifically asked that on co~ners things be placed back 25 ft. This is not a corner but it is a very sharp curve and it is at a dangerous intersection. MR, GRABIE, I can understand that. I do not want anything that would not be permitted anyone else. I will put the sign in the right place according to the Ordinance. Southold Town Board of Appeals -15- May 11, 1961 After repeated visits by members of the Board, the con-- tention that a permitted sign five ft. from the property line would not be visible from certain approaches is not borne out. The applicant's premises have 13 show windows, approximately 444 sq. ft. and is plainly visible from any direction. All of his windows are well illuminated and at present have the customary signs. He is permitted a large wall sign and a large detached sign and may place the detached sign five ft. from his property line. He claims that a 5 ft. setback would render his detached sign valueless as it could not be seen from certain approaches. ~his is not borne out, in fact his windows are more clearly visible than any detached sign. As a result of these investigations the Board determined that there was ~o reason why a sign should be placed closer than permitted all others, where ample space was provided. By pexmitting such erection substantial injustice would be done other property owners and the public convenience and welfare and justice would not be served and the legally established or permitted use of the neighborhood property would be substantially or permanently injured and the spirit of the Ordinance would not be observed, therefore On motion of Mr. Gillispie, seconded by Mr. Rosenberg, it was RESOLV~ that Walter C. Grabie be denied permission to locate sign with reduced setback on his property (leased from Sllkworth), south side Main Road, Mattituck, New York. This action does not in any way interfere with the appli- cant's right to erect and maintain a wall sign and a detached sign in accora~nce with the provisions of the Building Zone Ordinance. Vote of the Board~ Ayes~- Mr. Glllispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. Vote of the Board, Ayesz- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. It was further RESOLVED that legal notice of hearing be published in the official newspaper on May 19, 1961. Vote of the' Boards Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. The Board also received application for temporary access by Stanley J.&Evel~F~' Poliwoda, Bay View Road, Southold, to a lot in proposed subdivision to be known as Peconic Bay Oaks, Indian Neck, Peconic. It was determined that this application should be returned to the build/ng department for temporary access inasmuch as this map is in the process of being filed. Southold Town Board of Appeals -17- May 11, 1961 Mrs. Helen Reiter from "The Barge", Southold, New York, appeared before the Board with reference to directional and advertising signs. She would like to erect a directional sign (arrow) above the Koke Bros. "Oldsmobile" sign on,he north side of Main Road opl~site the west entrance to the old State Road, near,he Barge." She also wished to re-erect and relocate a for~er panel sign on the waterfront of her business lot so that it would be visible to boats entering Mill Creek channel from the Bay. The third sign would be on "The Barge" itself, either above the "Clam Bar" sign on the northerly end, or a sign on the ridge of the roof. The Board members stated that they would like to look at the area and the building before setting up the applications for hearings. The next meeting of the Southold Town Board of Appeals will be held 7~30 P.M., Thursda~May 18, 1961 at the Town Clerk Office, Main Road, Southold, New York. Meeting adjourned at 11:15 P.M.
