Dear Mr.Maye;
We received your letter of August 23, 2023 requesting,a second one-year extension to comply with the
Zoning Board of Appeal's Condition#6 relating to"As Built"improvements to existing seasonal
cottages as described in the June 23,2022 decision which reads as follows:
The applicant must apply to the Building Department for a building permit for the "as built"
improvements) within 90 days of the date of this decision and submit same to the Office of the Zoning
Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the
reason(s)why the applicant was unable to obtain a building permit in the time allotted.
In your letter you explain that a building permit cannot issue until you receive final approvals from the
Suffolk County Department of Health and the New York Department of Conservation for a proposed
upgraded sanitary system.
During the September 7, 2023 Regular Meeting,the Zoning Board of Appeals granted your request for a
one-year extension,to expire on September 15, 2024. This extension is the last and final extension.

Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards The LWR,P Coordinator issued a recommendation dated May 27, 2021 'Based
upon the information provided on the LWRI' Consistency Assessment 'Form submitted to this department,
as well as the records available, it is recommended that the proposed action is INCONSISTENT with
LWRP policy standards and is therefore INCONSISTENT with the LMW.
Policy 1. Foster a pattern of develcInnent of the Town oJ%5o1,athold that. Enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a. coastal
location, and minimizes adverse effects of development.
The (as-built) structures are not supported by this policy as it dates not enhance community
character and sets precedent contrary to the Board's procedures and authority. With the submission of the
Zoning 'Board l'Appeals application and approval by the Board to grant the expansion of the, pre-existing
non-conforrnirag wises, the"'as built" actions can therefore become CONSISTENT with the 1:.*WRP.

located in the R-40 Zoning District. 'The northerly property line measures 27.31 feet, then slopes east at
29.79 feet, then drops southerly '72.16 feet., then east 34.00 feet then northerly at 50.24 feet, and is adjacent
to East Creek (Eugene Creek). The easterly property line measures 146.80 feet, the southerly property line
measures 98.11 feet and is adjacent to Fleetwood Road and the westerly property line measures 173.22 feet.
The property is improved with two single-family dwellings (aka as Cottage #1 and Cottage 92), Cottage
#I is located on the easterly portion of the property and is approximately 875 square feet with an attached
wooden deck at the rear of the frame dwelliag,. Cottace #2 is as frame dwelling, located on the westerly side

of the property and is approximately 835 square feet. The rear yard is very close to wetlands as shown on
the survey map prepared by John T. Metgzer. LS and dated October 29,2005 along with floor plan�drawings
of the two dwellings prepared by Louis Schwartz, PE, and dated February 11, 2021.
BASIS C7k APPLLQATIQN: Request for Variances from Article XXIII, Sections 280-123; Article XXIII,
Section 280-124; and the Building Inspector's November- 30, 2021 Notice of Disapproval based on an
application for a permit to legalize "as built" alterations (convert screen porch to living space, new heat,
waterside deck) to an existing seasonal cottage known as Cottage #1 and legalize "as built" alterations
(convert screen porch to living space, new heat)to are existing seasonal cottage known as Cottage# , at; 1)

RELIEF REQUESTED: The applicant requests variances to pen-nit as built alterations to Cottage #1, east
structure: (convert screen porch to living space; new heat; waterside deck) to an existing seasonal cottage
and Cottage#2,west structure: legalize"as built"alteration(convert screen porch to living space; new heat)
to an existing seasonal cottage at: 910 Fleetwood Road, Cutchogue,, NY, SCTM#1000-137-4-22. The as
built construction,on this non-conforming 11954 square foot lot in the R;40 Zoning District, is not allowed
pursuant to Article XXIII, Section 280-123, Article XXIII, Section 280-124 which states; "A
nonconforming building containing a non-conforming, use shall not be enlarged, reconstructed, or
structurally altered or moved, except as set forth below: unless the use of such building is changed toa
conforming use." Additionally, the as built deck on cottage #1 is not permitted pursuant to Article XXIII,
Section 280-123, Article XXIII, Section 280-124 which states: lots measuring less than 20,000 square feet
in total size require a minimum side yard setback of 10 feet. The survey shows the existing deck to be
located at 8.8 feet of the side yard property line.
ADIII rffj , LI� R'MATI,t�. During the Public Hearing held on June 2,2022 the applicant's husband,
Mr. Maye, told the Board that Mrs. Maye inherited this property from her aunt who purchased the property
in 1974. Between 1974 and 1976 work was performed on the two cottages to convert them from seasonal
to year-round dwellings as confirmed by the Certificate of Occupancy issued by Southold Town Building
Department in August of 1976. The Building Inspector stated that both dwellings had heating installed and
conform to the Town Code. The applicant simply wishes to legalize the improvements that were made in
order to receive a rental permit from the Town. As to the "as built deck" on cottage #1, the applicant
estimates the work was done in the early 2000s. They are seeking a variance for the side yard setback of
1.2 feet. Southold Board of Trustees approved the deck application September 20, 2021. In 2018 the
previous owner,Mrs. Maye's aunt, received Southold Board of Trustee approval for an "as built" 8 feet by
8 feet shed and (2) 6 feet. x 6 feet panels installed between the shed and bulkhead. There was a condition
on this approval that the owner establish and subsequently maintain a 10 ft. wide non-turf buffer area along
the landward edge of the bulkhead which has not been done. .
FINDINGS OF FACT/ REASONS FOR 1 IARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on June 2, 2022 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection
of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following
facts to be true and relevant and makes the following findings:
1. Town Law 267-b b)(1). Grant of the variances will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The cottages have existed in this

community for many years. The neighborhood was a summer community and almost all the cottages s
have been converted to year-round dwellings. Many of the lots in the community are also non-conforming.

The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to pursue, other than an area variance-. The applicant inherited the property and
wishes to legalize the previous work.
3. Town 1,aw '207-b 3 b ILYL. The variances granted herein leer altering two pre-existing nonconforming
dwelling units are mathematically substantial, representing 100% relief from the code, The side yard.
setback relief is substantial representing 12% relief"from the code. However, these two cottages have not
enlarged their existing footprints and have existed on the subject property and continuously inhabited for
decades as part of the community character.

residential con°aaa unity will have, an adverse impact on the physical or environmental conditions in the
neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management
Code.
5. Town Law 67-b 3 b " . The difficulty has not been self-created. The applicant inherited the
property without knowledge of previous work.
6,Town Lawv 267 b. Grant of the requested relief is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of the two cottages while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.

under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member
Dantes, and duly carried,to
GRANT the variances as applied for, and shown on the survey map prepared by John T. Metgzer, LS and
dated October 29, 2005 and floor plan drawings prepared by Louis Schwartz, PE and dated February 11,
2021.
SUBJECT TO THE fOLLOWING CONDITIONS:

1. The applicant/owner In List submit evidence to the:,Zoning Board of Appeals and the Southold Town
Building Department that current 'Suffolk County Department of Health Services septic system
standards have been met, or in the alternative, make application to the Suffolk County Department
of Health Services to install an approved upgraded septic systems.
2. The 2018 condition of the Southold Board of Trustees for a 10 foot wide non-turf buffer area along
the landward edge of the bulkhead shall be installed.
3. The wooden deck on Cottage #1 shall remain open to the sky.
4, No further enlargement of the two cottages/dwellings shall be permitted without Zoning Board of
Appeals approval.
5. Only Off-Street, On-Site parking shall be allowed for subject property.
6. The applicant aaaaast apply to the Building Department for a building permit for the "as built"
improvernent(s) within 90 days of the date of this decision and subra°ait saane to the Office of the
Zoning Board of Appears, or submit a %,ratten request for an extension to the Dotard of Appeals
setting forth the reason(s) why the applicant was unable to obtain a building permit in the time

built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 12
months of this decision or submit a written request for an extension to the Board of Appeals
setting, forth the reason(s) why the applicant was Unable to obtain a Certificate of occupancy in
the time allotted.
This approval shall not be deetned effective until the required conditions have been met. At the
discretion of the Board of Appeabs,failure to conipty with the above conditions may render
this decision null and void

NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
Permits: TIDAL WETLANDS
1. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by Joan Chambers dated 7/31/2023, and sanitary systen details on
plans prepared by Louis Schwartz dated 2/3/2023, all stamped NYSDEC approved on 6/24/2024.
2. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project, the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
3. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
4. Install and Maintain Erosion Controls Staked hay or straw bales or other DEC-approved erosion
control measures are to be installed on the downslope edge of any disturbed areas. This barrier to
sediments is to be put in place before any disturbance of the ground occurs and is to be maintained in a
functional condition until all disturbed land is heavily vegetated.
5. Authorized Innovative/Alternative Onsite Wastewater Treatment Systems (I/A OWTS) Septic
Systems This permit authorizes the installation of any models of I/A OWTS septic system which have
received the approval of the Suffolk County Department of Health Services(SCDHS). If SCDHS
rescinds its approval of one or more of these models during the term of this permit,DEC will no longer
approve new installations of that model. The list of I/A OWTS systems which have received approval by
SCDHS are found on website-https:l/reelaimour .ater.info/

6. Maintenance of Installed Innovative/Alternative Onsite Wastewater Treatment Systems (I/A
OWTS) The permittee must maintain, service and repair the installed I/A OWTS in accordance with
the maintenance schedule set forth in the Suffolk County Department of Health Services (SCDHS)
permit issued for the system.
7. Establish Vegetated Buffer To protect the values of the tidal wetlands, a permanent vegetated
buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography
within an area extending 10 linear feet landward of the tidal wetland boundary.
8. Contain Stockpile and Disturbed Areas All disturbed areas where soil will be temporarily
exposed or stockpiled for longer than one week shall be contained by a continuous line of staked hay
bales/silt curtain (or other department-approved method)placed on the seaward side between the fill and
wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
9. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area(upland) and removed to
an approved upland area for disposal.No debris is permitted in wetlands and/or protected buffer areas.
10. No Disturbance to Vegetated Wetlands There shall be no disturbance to vegetated wetland areas
as a result of the permitted activities.
It. Concrete Leachate During construction,no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State,nor shall washings from ready-mixed concrete
trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.
12. Prohibited Toxic Materials The introduction of materials toxic to aquatic life, such as pesticides,
cleaning fluids,oils and chlorinated liquids is strictly prohibited in the absence of permit authorization.
13. No Equipment in Wetland Heavy equipment, including bulldozers,backhoes,payloaders, etc.,
shall not be operated in the wetland.
14. Equipment Storage 100' from Wetland,Water Body All equipment and machinery shall be
stored and safely contained greater than 100 feet landward of the regulated wetland or water body at the
end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances-into the
regulated area.
15. Storage of Equipment,Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 100 linear feet from the wetland
boundary.
16. Clean Fill Only All fill shall consist of clean soil, sand and/or gravel that is free of the following
substances: asphalt, slag, flyash, broken concrete, demolition debris, garbage, household refuse,tires,
woody materials including tree or landscape debris,and metal objects. The introduction of materials
toxic to aquatic life is expressly prohibited.
17. Seed,Mulch Disturbed Areas All areas of soil disturbance resulting from this project shall be
seeded with an appropriate perennial grass, and mulched with straw immediately upon completion of the
project;within two days of final grading, or by the expiration of the permit, whichever is first.

18. Temporary Mulch,Final Seeding If seeding is impracticable due to the time of year, a temporary
mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather
conditions favor germination and growth but not more than six months after project completion.
19. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants,epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.
20. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein authorized,or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free
navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the
State, or cause loss or destruction of the natural resources of the State,the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without
expense to the State, and if, upon the expiration or revocation of this permit,the structure, fill,
excavation,or other modification of the watercourse hereby authorized shall not be completed,the
owners, shall, without expense to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may require,remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable and flood capacity of the watercourse.
No claim shall be made against the State of New York on account of any such removal or alteration.
21. State May Require Site Restoration If upon the expiration or revocation of this permit,the
project hereby authorized has not been completed,the applicant shall,without expense to the State,and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
22. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future
operations undertaken by the State for the conservation or improvement of navigation, or for other
purposes, and no claim or right to compensation shall accrue from any such damage.

GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The permitted site or facility, including relevant records,
is subject to inspection at reasonable hours and intervals by an authorized representative of the
Department of Environmental Conservation(the Department)to determine whether the permittee is
complying with this permit and the ECL. Such representative may order the work suspended pursuant
to ECL 71- 0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals,Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal,modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal, modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal,modification or transfer are to be submitted to:

4. Submission of Renewal Application The permittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;

d. newly discovered material information or a material change in environmental conditions,
relevant technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the
Department of Environmental Conservation of the State of New York, its representatives, employees,
and agents("DEC") for all claims, suits, actions, and damages,to the extent attributable to the
permittee's acts or omissions in connection with the permittee's undertaking of activities in connection
with,or operation and maintenance of,the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims, suits, actions, or damages to the extent,attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under
Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
permittee's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the
riparian rights of others in order to perform the permitted work nor does it authorize the impairment of
any rights,title, or interest in real or personal property held or vested in a person not a party to the
permit.
