The inspection covered the footing and foundation for the alteration to the existing residential structure. This clause shall survive the termination or completion of the Agreement. 3) General Contractor shall at all times keep the Project free from accumulation of waste materials,rubbish and construction debris and, at the completion of the work,shall remove all its tools, scaffolding and surplus materials and shall leave its work broom clean or its equivalent. General Contractor shall daily, or less frequently as Owner may require, collect and shall remove the rubbish. BB. General Contractor and Subcontractors shall,upon completion of the work,promptly remove from the property any and all tools, scaffolding, equipment and surplus material and shall leave the work and premises"broom clean". 1)In the event the same shall not be removed by General Contractor and Subcontractors after five(5) days written notice,the Owner shall be entitled to remove and discard the same without further notice and without liability to General Contractor and Subcontractors, and General Contractor and Subcontractors shall be liable to the Owner for the costs so incurred by the Owner. CC. Neither General Contractor nor his Subcontractors shall place any signs, billboards or posters on any portion of the site, building, property or fences (temporary or permanent)except upon prior written permission received from the Owner and the Architect; and then only of a size,material, color and type, and at a location approved by the Architect. Sign shall be in conformance with all rules,regulations and ordinances of local jurisdiction. DD. General Contractor shall pay for and maintain portable sanitation unit on site for use by all subcontractors and workers. Unit shall remain in place until substantial completion of project. EE. All available and secured rebates from PSEG or any other agency or company shall be credited to Owner. FF. Contractor shall notify the Owner of the delay indicating the cause of the delay and the amount of time the Contractor was delayed. Failure to provide notice as provided herein shall be deemed to be a waiver of an extension of time that may otherwise be due under the Contract. GENERAL AND SUPPLEMENTAL CONDITIONS-4 SPECIFICATIONS GG. Notwithstanding anything to the contrary contained herein,the Contractor hereby waives any damages stemming from delays to the project regardless of fault, and the Contractor hereby agrees to accept an extension of time to complete as full compensation for any damages resulting from delays to the project. 2. PERMITS: A. The Building Permit from the governing municipality shall be paid for by the Owner. 1. General Contractor shall prepare, supply and file all documents necessary for release of required permits from the governing municipality. This shall include,but is not limited to the following: a) Insurance Forms b) Licenses B. General Contractor shall prepare and file application for all other required utility and other permits related to completion of construction. This shall include,but is not limited to the following: b) Propane Gas C. General Contractor shall obtain the forms and documents required in order to obtain all permits for the project, and Contractor shall provide same to the Owner for signatures and execution within 7 days of Contract Signing. Owner shall complete and execute the requisite forms provided by the Contractor and shall return them to the Contractor within 7 days of receipt from the Contractor. Contractor shall file the documents within 7 days of receipt of forms from the Owner. 3. SURVEYS: Owner shall supply and pay for all surveys as required 4. DEMOLITION AND REMOVAL: Work Included: A. The removal of existing windows,walls partitions,roofs,brick veneer, etc. as shown on the Plans and all other work as necessary to affect the work as shown including all utility disconnection letters and Health Dept. approvals. B. General Contractor shall coordinate with Owner regarding items to be salvaged and stored by Owner C. Remove all debris from the site. 1)General Contractor shall be responsible for the removal of all waste and debris from site. 2)General Contractor shall be responsible for the removal of all waste and debris in compliance with all local, state and federal laws and regulations and shall indemnify and hold the Owner and the Architect harmless from any losses or claims in connection therewith. This clause shall survive the termination or completion of the Agreement. D.Provide temporary bracing as required. E. General Contractor shall be responsible for removal and carting away from site of all trees at area of proposed construction, as required. Coordinate with Owner prior to removal. 5. OMISSIONS: A. The Drawings and Specifications are intended to coordinate. Anything found on the Drawings and not mentioned in the Specifications or vice versa, or anything not expressly set forth in either,but which is reasonably implied, shall be furnished as though specifically shown and mentioned in both, without extra charge. GENERAL AND SUPPLEMENTAL CONDITIONS-5 SPECIFICATIONS SECTION 1 —EXCAVATING AND GRADING 1. GENERAL: A. Contractor shall do all excavating as required on the Drawings. B. Earth banks shall be braced against caving in the work area. C. The bottoms of all footing excavations shall be exactly level on solid undisturbed earth. D.Excavations are to be kept free of standing water. E. Contractor is to carefully examine the site to determine character and amount of clearing, excavation and grading as indicated on Drawings. F. Contractor shall notify all required authorities and utilities ten(10)day prior to excavation for verification and location of all underground utilities(800.962.000) G. Contractor shall provide all professional certifications required by governing municipality for building excavation, sanitary system and drywell installations. 2. CLEARING SITE AND REPAIR: A.All obstructions to the progress of the work are to be removed. B.Pavings,walks, curbs, etc. damaged during construction, shall be repaired. C.Existing trees which are to remain shall be suitably barricaded to protect them from damage during construction. 3. TOPSOIL REMOVAL: A.Remove all top soil at new addition area and for a distance of ten(10)feet beyond the out side walls. Place same in a neat pile on the lot as directed. No top soil shall be removed from the site. 4. GRADING: A. Contractor shall bring the finish grades to the lines shown on the Drawings with stockpiled top soil. B. If additional dirt is needed or excess dirt is to be hauled away, Contractor shall be responsible for same. C. When the walls are built to grade line, Contractor shall backfill against them. 5. TRENCH EXCAVATING: A.Dig all trenches for foundation walls and footings to minimum depth and dimension as shown on Drawings AND to virgin soil with an assumed load bearing capacity of 2 tons/SF. Contractor shall verify in field. B. Sewer trench shall be pitched with a uniform fall and the trench backfilled upon completion of the installation and after proper inspection. 6. BACKFILL: A.All walls, foundations,trenches as necessary. B.No backfilling shall be done before footings and foundation walls have been constructed on undisturbed earth and all foundation walls adequately braced. 7. MASONRY 3-1 SPECIFICATIONS SECTION 5—CARPENTRY AND MILLWORK 1. WORK INCLUDED: The Contractor shall furnish and install all work under this section as specified herein and shown on the Plans.All work shall be done by mechanics skilled in their trade and workmanship shall be of the best quality. 2. MATERIALS: The Carpenter shall do all cutting and fitting of his woodwork required by the Plumbing,Heating and Electrical Contractors or any other mechanics to install their work. A. General Contractor shall supply and install all required hold-down, overturning and strapping devices as required by the current Building Code of the State of New York AND the governing municipality Building Department Official: SEE PLANS B. Cutting of the floor joists to a depth of 1/6 of the joist depth shall be permitted except in the middle half of the span. B. All work shall bear a written one(1)year guarantee from the Roofing Contractor from the date of Owner's acceptance. ROOFING 8-1 SPECIFICATIONS SECTION 9—PAINTING AND STAINING 1. WORK INCLUDED: A.The work to be done by the Painting Contractor shall include the furnishing of all materials, labor, and tools and equipment required to complete the painting and decorating of the building as specified. B. The submission of a bid by this contractor confirms an understanding of all conditions pertaining to this work and proper application of materials specified C. Coordinate scope of painting work with Owner. 2. WORKMANSHIP: A.All materials shall be applied free from runs, sags,wrinkles, streaks, shiners and brush work B.All materials shall be applied uniformly. If any reduction of the coating's viscosity is necessary, it shall be done in accordance with the manufacturer's label directions. C.A minimum interior temperature of 65°F.shall be maintained during the actual application and drying of the paint, and until occupancy of the building occurs. Adequate ventilation shall be maintained at all times to control excessive humidity which will adversely affect the curing of coatings. General Contractor is solely responsible for maintaining suitable temperatures and ventilation. D.Before painting begins, all other crafts shall have completed their work, and shall have removed all dirt and debris resulting therefrom. The rooms or areas are to be left in broom clean condition. E.Enamel and varnish undercoats are to be sanded smooth prior to re-coating. Tops and bottoms of doors are to be finished in the same manner as door faces,after carpenters complete fitting of them. F.No exterior painting or staining shall be undertaken if air or surface temperature is below 50' F.,not immediately following rain or until frost, dew or condensation has evaporated. Surfaces should always be tested with moisture meter before proceeding. 3. MATERIALS: A. Bids are to be based on coatings as manufactured by Benjamin Moore&Co. and Cabots Stain,except as otherwise specified. B. Colors shall be those approved by the Owner. A duplicate color-chipped schedule will be supplied to the Painting Contractor. All primers and undercoats are to be tinted to the approximate shade of the selected finish coat. All paint colors shall be"standard colors". Paint and stain colors to be selected by Owner. C.All paint and coatings must be delivered to the job site in manufacturer's original containers. D. General Contractor shall prepare proper size acceptable samples of each color and sheen required for approval by the Architect. E. It is to be understood by General Contractor and Painting Contractor that all coatings must conform to all State and local regulations including VOC/VOS rules at the time of application. 4. GENERAL PREPARATION OF SURFACES: A.Painting Contractor shall be wholly responsible for the quality of his work, and is not to commence any part of it until surface is in proper condition. B. If Painting Contractor considers any surface unsuitable for proper finishing, he is to notify the Architect of this fact in writing. He is not to apply any material until corrective measures have been taken, or the Architect has instructed him to proceed C. All surfaces are to be clean; if for any reason the surface cannot be cleaned,this condition shall be promptly reported to the General Contractor. PAINTING AND STAINING 9-1 SPECIFICATIONS D. If Painting Contractor has been instructed by General Contractor to begin painting under conditions and circumstances he believes could result in poor performance and early failure of the coatings,he shall request, in writing, a decision from the Owner E. The prime coat should be applied soon after surface preparation has been completed,to prevent contamination of the substrate. 5. STORAGE: General Contractor will provide for a secure space for the storage of all painting materials and equipment, for the exclusive use of Painting Contractor,who will be responsible for maintaining it and leaving it free from fire hazards relating to improperly stored rags or thinners. 6. INSPECTION: Any work not conforming to the Specifications or not meeting with the approval of the Architect, shall be removed or corrected and/or repainted as requested by the Architect. 7. REMOVAL: A.Upon completion of a room or area, it shall be left in a clean and orderly condition, and all paint spatters, contaminated rags and trash shall be removed. B. Upon completion of the job,Painting Contractor is to remove all surplus materials, scaffolds, etc. from the premises that relate to his trade. He shall clean all window glass free of excess paint and spatters, and remove paint that has been misplaced on other surfaces. 8. SURFACE PREPARATION: A. Interior surfaces: 1) Wood surfaces to be painted: a) All surfaces shall be dry and sanded smooth and free of loose dirt, dust or grit. b) Putty all nail holes, cracks and blemishes after undercoater has been applied. Knots are to be coated with Moore's#023 Primer before overall coat of Moore's Enamel Underbody is applied. c) All coats must be thoroughly dry before applying succeeding coats, and lightly sanded between coats. d) Avoid general use of shellac as an undercoat. e) After fitting by the carpenter,tops and bottoms of all doors must be primed and painted the same as the faces of doors. 2) Wood surfaces to be stained (clear finish): Natural wood(clear finish) a) All surfaces shall be dry and sanded smooth; free of loose dirt, dust or grit. b) Fill all nail holes, cracks and blemishes after staining with filler tinted to match the color of the wood or stain. c) After fitting by the carpenter,tops and bottoms of all doors must be sealed with a clear coating. 3) Drywall: a) All surfaces must be free of sanding dust,and joint treatment cement should be thoroughly dry. b) Damaged or defective surfaces are to be repaired by spackling or by other appropriate measures. c) Steel corner beading is to be coated with Moore's SPS before applying water-thinned coatings.
