FINDINGS. DELIBERATIONS AND DETERMINATION

Adder~dum to Reasons for Board Action: On the basis of testimony presented, materials
· submitted and personal inspection, the Board makes the following findings:
1. Grant of the vadance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The neighborhood is primarily
developed with older homes on small non-conforming lots of 12,500 f. eet. The applicant
is requesting a variance for the construction of a garage in the side yard instead of the
required rear yard. The dimensions of the garage are 20'x20'x27' with a height of 21'.
This garage will only be used for storage and include electricity, no water.
2. The benefit sought by the applicant cannot be achieved by some other method.

yard setback of 24' instead of the required 35',)
3. The variance granted is substantial in relation to the code requirement. However, it is
not substantial in relation to the existing setbacks in the neighborhood due to the small
lots.
4. The alleged difficulty has been self -created because the applicant was aware of the
non-conformity of the lot when they purchased the tot.
5. No evidence has been submitted to suggest that the relief granted will have an
adverse impact on the physical or environmental conditions in the neighborhood. The
addition of a garage would be consistent with other properties in the neighborhood.
6. Granting of the requested vadance is the minimum necessary for the applicant to
enjoy a garage, while 13reserving and protecting the character of the neighborhood and
the health, safety, and welfare of the community.
