There were present~ Messrs. Robert W. Gillispie, Jr., Chai~,~n, Robert Bergen, Herbert Rosenberg, and C~rles Grigonis, Jr. Absent~ Mr. Serge Doyen, Jr. PUBLIC ~/~ING: Appeal No. 371 - 7:30 P.M. (E.D.S.T.), upon application of Millard A. Northridge, Circle Drive, Box 217, Jamesport, New York, for a spe cial exception in accord- ance with the Zoning Ordinance, Article X, Section 1007, Subsection (b), for permission to change type of use. Location of property: south side Route 25, Laurel, New York, Lot No. 2 on subdivision map .of G. I. Tuthill, bounded north by State Route 25, east by Sophie Kander, south by Katherine B. Tuthill, and west by John N. Venteau. Fee paid $15.00. Southold Town Board of Appeals -2- May 25, 1961 The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attest- ing to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this applicatioN? (There was no response. ) Mr. RRRGEN: I would like to say that if there is a business office there it would not have many cars parked around there. When it was a diner there were always cars parked in front. THE CHAIN: Is Mr. Northridge going to have the office himself~ MR. BE~RN: I understand it is to be rented to Noel Albrecht. This applicant seeks permission to change the present non-confoxming use of his building to a higher classification. The present structure has been a bakery and later a diner. It is proposed to remodel the interior and use the building as a real estate office. The applicant has been advised that this building may not be returned to its fozmer use and it is so stipulated. The Board finds that the public convenience and welfare and justice will be se~ed and the legally established or pez,~itted use of the neighborhood property will not be sub- stantially or pe~,anently injured and the spirit of the Ordinance will be observed, therefore On motion of Mr. Gillisple, seconded by Mr. Rosenberg, it was RESOLVED that Millard A. Northridge be granted permission to change the type of use of his building located on the south side Route 25, Laurel, New York to that of a real estate office. A condition of this special exception is that only signs permitted under ArticleIV, Section 408 be permitted. Young & Company, Osborne Avenue, and Route 58, Riverhead, New York, for a special exception in accor4~nce with the Zoning Ordinance, Article X, Section 1007, Subsection (e), for permission to rebuild an existing non-conforming building located on the east side Depot Lane, Cutchogue, New York, bounded north by Antone Chituk, east by Andrew Sybulski, south by Railroad and west by Depot Lane. Fee paid $15.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN~ I might call attention to the existing build- ing which we examined and photographed. It is well known the Board of Health each year makes the requirements for anybody who is housing anyone else a little tougher and it has reached the point where this camp, as I understand it from the application, it would be cheaper to replace the present building with a modern one of the same use and dimensions rather than spend more money on the existing building. The part of the Ordinance which covers this application I will read to you. (The Chairman read Article X, Section 1007e.) These requirements are permitted tot~ varied by the Board of Appeals as a special exception and the regulations in con- nection with granting a special exception concerns the general welfare of the Town. (The Chairman read the points the Board must deter~ine before granting a special exception.) The other part of the Ordinance which concerns itself with labor camps is Article X, Section 1003a. That means applicants will have to meet all requirements of the existing multiple residence law, also the increasingly tough Board of Health rules. (The Chairman read Article X, Section 1003a) This labor camp existed prior to the enactment of the Ordinance and the applicant wishes to upgrade it. Is there anyone present who wishes to speak for this application? Southold Town Board of Appeals -4- May 25, 1961 MR. JOSEPH COLEMAN, Riverhead, New York: I am a member of the firm of I. M. Young and Company. Th~xeis not a great deal I can say other than what appears in the application. We propose to replace the existinglabor camp which is there now operating under permit of the Board of Health, having been inspected after the first of the year and a new permit granted. We want a new modern up to date concrete building, all sanitary facilities, which will more than meet the specifications as required by the Board of Health. The capacity of the camp will be 24 and that is what the camp is designed for to meet the requirements. THE CHAIRMAN~ Is that the present capacity of the camp? MR. COLEMAN: The present capacity is greater than that. Due to the fact the camp was there we can continue. Under the new plan we also have more space. We will spend approximately 11,000.the We will have sanitary facility, on building. every entral heating, concrete block construction, 4 in. partitions between the rooms of concrete =cinder blocks. THE C~AIRMAN: What are the dimensions of the building? MR. CO?.R~EN: 20 ft. by 80 ft. T~E CHAIRMAN~ Is there anyone else present who wishes to speak for this application? (There was no response.) T~E CHAIRMAN, Is there anyone present who wishex to speak against this application? MR. JOSEPH S. ZUHOSKI, Depot Lane, Cutchogue, spoke in opposition, stating that he objected to the noise from juke box, screaming, bad language and drunks. He stated he is not in opposition to I. M. Young building a barracks but felt they should build it somewhere else. MRS. SOPHIE CYBULSKI, Depot Lane, Cutchogue, also spoke in opposition to the existence of the labor camp stating that when the men are working they are all right, but when they are not working they should have someone to look after them. Also she objected to the noise from the camp. Southold Town Board of Appeals -5- May 25, 1961 THE CHAIRMAN~ When was the original camp put up? MR. COT.RMAN~ About eight or nine years ago. THE C~2tIRMAN: Is there anyone else present who wishes to speak against this application? MR.~DSEPH ~ROHOSKI, Depot Lane, Cutchogue, stated that there is a labor camp not more than a mile away down Depot Lane and I. M. Young should move there. Mr. Coleman stated that that is a cooperative labor camp. THE C~%~RMAN~ I wish to make it clear that we cannot abolish this labor camp and the applicant is practically free to spend as much money as he wants to on the inside of the building. MR. COLEMAN~ If we can receive permission we are going to raze the present building and build a new one. We feel we would be doing everyone a favor by tearing down the old one and putting up one that is by far, interiorly and exteriorly better looking and more appealing than the or~ that is there now. THE CHAIRMAN~ If you had a use before the Ordinance was passed no Ordinance can take that away from you. MR. CYBULSKI~ Why are they asking for the permit? THE CHAIRMAN= Because they are not permitted to replace the present structure with a new structure costing more than 50~ of the fair value of the present structure, however they are permitted under the Ordinance to improve the ~oncconforming use. Mr. Coleman, what would it cost to mee~ the Boar~ of Health requirements? MR. COT.RMAN: At the present time it has met the Board of Health requirements and has a peri, it. We just want to put up a nice building to present better working conditions so that we may obtain a better class of help. If you have a fairly nice labor camp then you are in a position to about pick the crew you desire. THEC~AIRMAN~ Is there anyone else present who wishes to speak in connection with this application? (There was no response.~ THE CHAIRMAN~ I hope you all understand that the Board of Southold Town Board of Appeals -6- May 25, 1961 Appeals has no authority to order the discontinuance of an existing labor camp. This applicant has a right to improve the existing building. (Most of the people present felt the present building should be. remodeled but would not give their reasons why.) T~E CHAIRMAN~ Is there anything else? (There was no response.) This applicant requests permission to rebuild an existing barracks. The Board is very familiar with this structure, it having been constructed and in active use since 1952. The present building has a Board of Health pezmit for 1961. In order to provide better housing and facilities for the workers a modern building is proposed. This will be of concrete block or cement block construction with 4 inch interior walls and far exceeding any present or forseeable future Board of Health regulations. The present building has accomodations for 30 workers. The proposed building will accomodate 24. In consequence there is no enlargement and this Board looks with favor on any reasonable up grading of facilities for seasonal workers, particularly where the personnel are employed on the premises. This is a potato grading station where the surrounding farms dispose of their crop. This is not a new enterprise and the I. M. Young Company may improve the present facility not to exceed 50~ of its value. (Section 1007-e.) The Board feels that it is far better for the welfare of the workers and of the surrounding farms that pe£mission be granted to demolish the present structure and erect a modern building with full facilities. The Board finds that the public convenience and welfare and justice will be served and the legally established or pe;-mitted use of the neighborhood property will not be sub- stantially or permanently injured and the spirit of the Ordinance will be observed, therefore On motion of Mr. Gillispie, seconded by Mr. Grigonis, it was Southold Town Board of Appeals -7- May 25, 1961 RESOLVED that I, M. Young Company, Osborne. Avenue, Riverhead, be granted permission to rebuild existing rDn-conforming building located on the east side Depot Lane, Cutchogue. The size of this building will be 20 ft. by 80 ft. and occupancy shall be no greater than 24 persons. A building permit for the construction of this building must be obtained within one year from date of this hear- ing, May 25, 1961. Vote of the Board.. Ayes..- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. The minutes of the meeting of May 11, 1961, on motion of Mr. Gillispie, seconded by Mr. Rosenberg, were approved as submitted. Vote of the Board.. Ayes~- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. On motion of Mr. Bergen, seconded by Mr. Rosenberg, the Board of Appeals set 7..30 P.M. (E.D.S.T.), Thursday, June 15, 1961, Town Clerk Office, Main Road, Southold, New York, as time and place for hearing upon application of Antone Petranich, Oaklawn Avenue Extension, Southold, New York, for a variance in accordance with the ~oning Ordinance, Article III, Section 303 and Article X, Section 1000A, for pormission to reduce area and use as a single lot property located c~ the east side of Oaklawn Avenue Extension, Southold, New York, bounded north by Barton Foster, east by Sarah Gagen, south by other land of Antone Petranich, and west by Oaklawn Avenue Extension. Vote of the Board: /~es=- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. It was further RESOLVED that legal notice of hearing be pub- lished in the official newspaper on June 9, 1961. Vote of the Board.. Ayes..- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grlgonis.
