It is our understanding that there was recently an inspection requesting an architect certify the framing, rough plumbing, and insulation for this structure. To the best of my knowledge the insulation met the code requirements necessary at the time of the structure was built. Based on a probe into the existing wall, we have also visually confirmed the use of insulation in the bathroom. See image 1. The client recently installed necessary plumbing vents for both the bathroom and kitchen. See image 2, 3, and 4. Based on the attached Building Department Town of Southold Housing Code Inspection report dated 13 November 1994 the framing for the accessory building was already inspected and certified by the Department of buildings. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1), Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.The addition behind the former garage is not visible from the road. And both structures have legally existed on the subject property since 1996. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the•applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The"as built"addition was constructed to join the existing garage and the existing shed to make the accessory apartment.
