It has taken over three years to gain all approvals needed, with our final approval coming on December 21, 2022. There were considerable delays for this project due to: 1) permits required by DEC and Southold Town Trustees which required subsequent redesigns (both now approved and fully compliant with these entities, attached). 2) the onset of the COVID-19 pandemic that happened within months of this approval and the long-ranging impact this had on the ability for the DEC, Trustees and also the Suffolk County Department of Health to review, respond and approve this project 3) the cyber attacks on Suffolk County departments that delayed the review and subsequent approval of the proposed site plan which was submitted in 2020 and was just granted on December 21, 2022 ( attached). a) the special driveway covenant required by Suffolk County Health Dept to locate the septic system under drive as the only compliant location. This required the owner to hire a lawyer to produce. This covenant has now been approved (also attached). We're hoping that considering the many years it took for this project to receive all approvals, the Board will grant the extension of this approval not to exceed (3) consecutive years of(1) year terms. The architect was qt,iestioned about making the setback of the proposed garage the same as the proposed residence. The architect was amenable to this change. The existing dwelling structure was built in 1959 and the certificate of occupancy for a seasonal dwelling was issued in 1960. In December of 1969, a certificate of occupancy, was issued For an accessory storage building. 'I he residence altered and expanded to be converted to a full-time residence in 1972 with Certificate of Occupancy # Z- 4635. Also, a new sanitary systems proposed for this property,, which also limits the area where the residence can be placed. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions set forth in this decision. The applicant is proposing an UA sanitary system, which will mitigate the environmental effects of nitrogen loading in the adjacent creek and would bring this property into compliance with LWRP recommendations. The proposed residence has a proposed finished floor height of 10 ft above sea level, where a 6 ft height is required further mitigating the impact of the residence on the property, 5. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase" 6.
