The property is a corner lot with a road frontage of approximately 160.00 feet along Bridge Lane, then turns west for approximately 161.46 feet along County Road 48, then turns northwest for 161.75 feet, before returning 164.17 feet back to Bridge Lane. The property is improved with an existing two-story dwelling currently under construction with building permit # 49065, shown on a foundation location survey last revised July 25, 2023 The "As-Built" accessory swimming pool is subject to a stop work order from the Building Department dated January 18, 2024. BASIS OF APPLICAT1QN: Request for a Variance from Article III;, Section 280-15 and the Building.Inspector's January 4,2024, Amended January 19,2024,Notice of Disapproval based, on an application for a permit to legalize an `gas built" accessory in-ground swimming pool; at 1) located in other than the code permitted rear yard; located at: 5295 Bridge Lane, Cutchogue, NY. SCTM No. 1000-84-1-6.16. RELIEF REQUESTED: The applicant requests a variance to legalize an existing "as-built" accessory swimming pool located partially in a side yard where a rear yard location is required. ADDITIONAL 1NPORMA -ION, Asper testimony of the architect at the public hearing of May 2,2024,the subject pool was reconfigured during construction to a location partially out of the required rear yard,thereby generating the stop work order. The Board requested that the applicant submit a Landscape Plan showing arborvitae vegetative screening 8 to 10 feet in height to buffer visibility of the swimming pool from the two neighboring lots. Page 2, May 16,2024 #7899, 5295 Bridge Lane SCTM No. 1000-84-1-6.16 FINDINGS OF FACT/ REASONS, FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 2, 2024, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1, Town Law "267-b(3)(b)(1). Grant of the variance wil I not produce an Undesirable change in the character of the neighborhood or a detriment to nearby properties, The subject property is a comer lot with two front yards. The pool was originally proposed to be located in the designated rear yard. During construction, it was reconfigured to be partially into the side yard. However,the fact that the swimming pool is a non-liabi table two-dimensional accessory structure: with little visual impact on adjacent properties, a conforming rear yard location is limited on a property with two front yards, the owner's proposal to place evergreen screening along the side and rear property lines to screen the pool from the street and neighboring property, and the fact that the pool meets all the required setbacks for an accessory structure,the proposed pool location will not create any change in the character of the neighborhood. 2. Town Law §267-b(31(b IL._The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. While the pool would fit into the required rear yard,the fact that it Is"as-built" would require a substantial cost to the owner to move, Also, the majority of the pool is located in the required rear yard, so that the only course of relief is an area variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100% relief from the code. However,a ma.pority of the pool is located in the required rear yard,and only a small portion is located in the side yard. 4. Town Law §267-b(31(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 5. Town Law 4267-bQM The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4*267-b. Grant of the requested relief is the minimum action necessary and adequate enable the applicant to enjoy the benefit of an accessory swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. York Town Law 267-B,motion was offered by Member Lehnert, seconded by Member Weisman(Chairperson), and duly carried, to GRANT the variance as applied for and shown on the site plan sheet, "Pool Layout & Section" Page ZBA-01 prepared by Anthony Portillo, last revised January 24, 2024. SUBJEX'T TOTHE FOLLOWING CONDITIONS: 1. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a, written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted.
